HomeMy WebLinkAbout2003-06-24 Regular Meeting MinutesMINUTES CITY OF ANNA REGULAR CITY COUNCIL MEETING June 24, 2003 7:30 PM, CITY HALL The City Council of the City of Anna will met in Special Session at 7:30 p.m., Tuesday, June 24, 2003, at the Anna City Hall, 101 N. Powell Parkway, and considered the following items: 1. Call to Order. The Mayor Pro -Tem called the meeting to order at 7:35 p.m. 2. Roll Call and Establishment of Quorum. The following members were present and participating: Mayor Pro -Tem Mark Montgomery, Councilman J. W. Finley, Jr., Councilman Lynn Mosier, Councilman John Geren, and Councilman Chris Caldwell. The following members were absent: Mayor Kenneth L. Pelham. 3. Citizen Participation. No comments from the public 4. Public Hearing: The public Hearings were started at 7:37 p.m. The City Council of Anna will hold a public hearing regarding annexation of a 344.33 acre tract in the J. M. Kinkaid Survey, Abstract No. 509, Joseph Boyle Survey, Abstract 105 and the John Coffman Survey, Abstract 197, owner being Dr. William Weaver, located on the north and south sides of W. White Street between S. Central Expressway and Hurricane Creek. No Comments from the public. 5. Public Hearing: The City Council of Anna will hold a public hearing regarding annexation of a 98.17 acre tract in the W. S. Rattan Survey, Abstract No. 752, and the Thomas Rattan Survey, Abstract No. 782, owner being I. K. Kim, located at the northeast corner of S. Central Expressway and W. White Street (excluding 10 acres in Driver's Truck Stop tract). No Comments from the public. 6. Public Hearing: The City Council of Anna will hold a public hearing regarding annexation of a 2.46 acre tract in the Martin Moore Survey, Abstract No. 649, owner being City of Anna, located at 1111 CR 370. 06-24-03 Council Minutes-Regular.doc Page 1 of 5 06/24/2003 No Comments from the public. 7. Public Hearing: The City Council of Anna will hold a public hearing regarding annexation of a 59.534 acre tract in the Martin Moore Survey, Abstract No. 649, owner being Wayne Asbury, located at 1001 CR 370. No Comments from the public. 8. Public Hearing: The City Council of Anna will hold a public hearing regarding annexation of a 6.952 acre tract in the W. E. Throckmorton Survey, Abstract No. 899, owner being William Vitz, located at southwest corner of S. Central Expressway and Foster Crossing Road. No Comments from the public. 9. Public Hearing: The City Council of Anna will hold a public hearing regarding annexation of a 14.629 acre tract in the Thomas Rattan Survey, Abstract No. 782, owner being Lee R. Purser, located at 2301 W. White Street. No Comments from the public. 10. Public Hearing: The City Council of Anna will hold a public hearing regarding annexation of a 33.10 acre tract in the Thomas Rattan Survey, Abstract No. 782, owner being Anna 33, L.P., located at 2601 W. White Street. No Comments from the public. 11. Public Hearing: The City Council of Anna will hold a public hearing regarding annexation of a 36 acre tract in the J. Schluter Survey, Abstract No. 856, owner being John H. Rattan, located at 1401 W. White Street. No Comments from the public. 12. Public Hearing: The City Council of Anna will hold a public hearing regarding annexation of a 9.061 acre tract in the F. T. Daffau Survey, Abstract No. 288, owner being Robert Fagala, located at 2700 W. White Street. No Comments from the public. Public Hearing: The City Council of Anna will hold a public hearing to consider comments regarding a zoning request by Harow Texas Property Trust for a 50.961 acre tract located at 2401 West White Street, in the Thomas Rattan Survey, Abstract 782. Petitioner requests zoning of the property as Planned Development — Single Family Residential. The Mayor Pro -Tem opened the public hearing at 7:44 p.m. The developer presented information on the development. There were no comments from the public. The Mayor Pro -Tem closed the hearing at 8:13 p.m. 14. Consider action on ordinance establishing zoning for a 50.962 acre tract located at 2401 West White Street, in the Thomas Rattan Survey, Abstract 782. Councilman Mosier moved to approve the PD with changes from 20 foot setback to 25 foot setbacks, change the wording of Neighborhood Park to Open Space and to strike item 7 under additional request for approval worded as "Min. Street center line radius for street B shall be 225' for curve between street A and Street C and 125' for curve south of court B". Councilman Geren seconded the motion. 4 Aye 1 Nay (Caldwell) 0 Abstain Motion Carried 15. Public Hearing: The City Council of Anna will hold a public hearing to consider comments regarding a zoning request by Trey and Heather Hughes for a 3.953 acre tract located at 604 West White Street, located in the J. C. Farris Survey, Abstract 331. Petitioner requests amendment of Planned Development 12-2003 to permit stucco exterior construction and to permit construction of building(s) not to exceed a total of 20,000 square feet in size. The Mayor Pro -Tem opened the public hearing at 8:34 p.m. The owner and architect presented information on the request to amend the Planned Development including permitting stucco and construction of buildings not to exceed 20,000 square feet. The stucco would be regular three cote stucco as approved by the International Building Code. There was no comment from the public. The hearing was closed at 8:40 16. Consider action on ordinance amending Planned Development 12-2003 for a 3.953 acre tract located at 604 West White Street, located in the J. C. Farris Survey, Abstract 331, to permit stucco exterior construction and to permit construction of building(s) not to exceed a total of 20,000 square feet in size. Councilman Finley moved to approve the ordinance amending a minimum of 40% of masonry as described in the Ordinance and remainder in Stucco and allow up to 20,000 maximum square feet buildings. Councilman Caldwell seconded the motion. 5 Aye 0 Nay 0 Abstain Unanimous Motion Carried 17. Councilman Finley seconded the motion. 5 Aye 0 Nay 0 Abstain Unanimous Motion Carried 18. Consider recommendation of Planning and Zoning Commission regarding amendment to zoning ordinance to provide regulations relating to sale of beer, wine, and alcoholic beverages. No action was taken by the City Council. 19. Consider action on ordinance adopting fee schedules for commercial finish out applications. Councilman Mosier moved to approve an ordinance adopting fee schedules for commercial finish out applications. Councilman Finley seconded the motion. 5 Aye 0 Nay 0 Abstain Unanimous Motion Carried 20. Consider action on ordinance adopting inspection procedures. Councilman Mosier moved to approve the ordinance. Councilman Finley seconded the motion. 5 Aye 0 Nay 0 Abstain Unanimous Motion Carried 21. Consider action on appointments to Planning and Zoning Commission, Park Board, Community Development Corporation, and Economic Development Corporation. Councilman Finley moved to appoint Robert R. Woods, Jr., to replace Ty Chapman and Hubert M. (Trey) Hughes III, to replace Kenneth Pelham on the Park Board. Councilman Caldwell seconded the motion. 5 Aye 0 Nay 0 Abstain Unanimous Motion Carried Councilman Mosier moved to appoint Susan Barnes to the Community Development Corporation. Councilman Finley seconded the motion. 5 Aye 0 Nay 0 Abstain Unanimous Motion Carried 22. Consider approval of location of temporary storage building at softball field. Councilman Mosier moved to allow the building at Ty Chapman's discretion for up to one year. Councilman Caldwell seconded the motion. 5 Aye 0 Nay 0 Abstain Unanimous Motion Carried 23. Consider approval of Minutes of meetings of May 6th, May 13th, May 27th and May 31st Councilman Mosier moved to approve the minutes with a correction to the minutes.
