ORDINANCE NO.449-2009
AN ORDINANCE OF THE CITY OF ANNA, TEXAS, AMENDING THE ANNA CITY
CODE OF ORDINANCES BY AMENDING PART 11, ARTICLE 49, SECTIONS 7.03
AND 7.07; AMENDING PART IV, SCHEDULE OF FEES, ARTICLE VII, SECTIONS 3
AND 4 RELATING TO UTILITY TAP FEES; PROVIDING FOR A PENALTY FOR ANY
VIOLATION OF THIS ORDINANCE NOT TO EXCEED $600; PROVIDING FOR
SAVINGS, SEVERABILITY, AND REPEALING CLAUSES; PROVIDING FOR AN
EFFECTIVE DATE; AND PROVIDING FOR THE PUBLICATION OF THE CAPTION
HEREOF.
WHEREAS, the City of Anna, Texas ("the City") has previously adopted ordinances,
rules and regulations governing Schedule of Fees; and
WHEREAS, the City of Anna, Texas City Council has investigated and determined
that it would be advantageous and beneficial to the City and its citizens to amend
Part IV, Article VI1, Sections 3 and 4 of The Anna City Code of Ordinances ("Anna
Code") by adding the water tap fees in Section 3 and adding a 1 f" water meter
deposit fee in Section 4 and to amend related provisions of Anna Code Part 11,
Article 49, Sections 7.03 and 7.07.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ANNA, TEXAS, THAT;
Section 1. Recitals Incorporated.
The above -referenced recitals are incorporated herein as if set forth in full for all
purposes.
Section 2. Amendment.
2.01 In accordance with Part 11, Article 1, Section 9 of the Anna Code, the following
amendments are made to Part 11, Article 49, Sections 7.03 and 7.07:
7.03 Deposits, Connection and transfer Fees for Water

place with the City a water meterlsecurity deposit for each account or meter. Such
water meter/security deposit shall be iA the fellewin mounts are set forth in Part IV

All GensuFneFs Persons that are disconnected for nonpayment of a bill more than two
times in a 12 month period must increase their deposit by 100% before the account
may be reconnected.

Section 3. Water and Sewer Tap Fees

Persons to whom water or sewer taps
apply are solely responsible for any costs associated with any necessary boring of
under or around a -public streets or other public facilities.

Section 4. Water Meter Deposit
The following fees shall be paid to the City at the time of approval of the utility
application to pay for water meters where no meter is installed:
3/4" meter $150.00
1 " meter $200.00
1 '/2 " meter $350.00
2" meter $500.00

With back flow prevention $1, 500.00

A customer desiring to use a fire hydrant meter shall pay a deposit of $1,500 to the City
of Anna at the time of application for connection as security for payment of bills for
water service and/or damage to and/or loss of City facilities. The deposit shall be
retained by the City until the customer is disconnected from the City's facilities and has
returned the fire hydrant meter undamaged.

Section 3. Penalty.

Any violation of any of the terms of this ordinance, whether denominated in this
ordinance as unlawful or not, shall be deemed a misdemeanor. Any person convicted of
any such violation shall be fined in an amount not to exceed $500 for each incidence of
violation. Each violation is considered a separate offense and will be punished
separately.
Section 4. Savings, Severability and Repealing Clauses.
All ordinances of the City in conflict with the provisions of this ordinance are repealed to
the extent of that conflict. If any provision of this ordinance shall be held to be invalid or
unconstitutional, the remainder of such ordinance shall continue in full force and effect
the same as if such invalid or unconstitutional provision had never been a part hereof.
The City declares that it would have passed this ordinance, and each section,
subsection, clause, or phrase thereof irrespective of the fact that any one or more
sections, subsections, sentences, clauses, and phrases be declared unconstitutional or
invalid.
