HomeMy WebLinkAboutOrd 451-2009 Canceling the September 14, 2009 Special ElectionCITY OF ANNA, TEXAS ORDINANCE NO. 451-2009 lei Z a I I 4Vf_1 J I L*j ii I ' 14 :4 401 WHEREAS, a special election in the City of Anna, Texas ("City"), called for September 14, 2009, was ordered by the City Council of the City of Anna, Texas ("City Council") on June 9, 2009 by Ordinance No. 446-2009, for the purpose of electing the following City official: Council Place No.4 to the City Council; and; WHEREAS, the City Secretary has certified in writing, in accordance with Section 2.052, Texas Election Code, that there is no proposition on the ballot, that no person has made a declaration of write-in candidacy, and that there is a single unopposed candidate for the special election to the office of Council Place No.4, said Certification having been attached hereto as Exhibit A; and WHEREAS, the City Council hereby accepts the above -referenced certification by the City Secretary; and WHEREAS, under these circumstances, Section 2.053, Texas Election Code, authorizes the City Council to declare the unopposed candidate elected to office and cancel the special election. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS, THAT: Section 1. Recitals incorporated. The above -referenced recitals are incorporated herein as if set forth in full for all purposes. Section 2. Declaration. In accordance with SectionTexas Election Code, the following unopposed candidate in the September 14, 2009 special election in the City is hereby 1edared elected to the office shown, and shall be issued a certificate of election and become eligible to serve in said office after the previously called September 14, 2009 • John Geren — City Council Piece No. 4 Ord. 451-2009 Cano"M Sept 14,2009 SPWM Ebctkm.cbc PAGE 1 OF 2 07-211-09 Section 3. Cancellation. Section 4. Savings, Severability and Repealing Clauses. Ali ordinances of the City in conflict with the provisions of this ordinance are repealed to the extent of that conflict. If any section, subsection, sentence, clause, or phrase of this ordinance, or its application to a particular set of persons or circumstances, is declared invalid or adjudged unconstitutional by a court of competent jurisdiction, it does not affect the remaining portions of this ordinance, as the various portions and provisions of this ordinance are severable. The City Council, declares that it would have passed each and every part of this ordinance notwithstanding the omission of any part that is declared invalid or unconstitutional. Section 5.
