HomeMy WebLinkAboutOrd 456-2009 Amending Personnel Policy Manual-COLA.pdfORDINANCE NO. 466-2009 AN ORDINANCE OF THE CITY OF ANNA, TEXAS, AMENDING THE CITY OF ANNA PERSONNEL POLICY MANUAL REGARDING PERSONNEL COST -OF -LIVING ADJUSTMENTS TO SALARY WHEREAS, the City of Anna, Texas ("the City") has previously adopted the City of Anna Personnel Policy Manual ("the Manual"), which describes guidelines and policies for the City's personnel; and WHEREAS, the City of Anna, Texas City Council ("City Council") has determined that the Manual is in need of updating with respect to personnel cost -of -living adjustments. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS, THAT: Section 1. Recitals Incorporated. The above -referenced recitals are incorporated herein as if set forth in full for all purposes. Section 2. Amendment to Personnel Policy Manual. Section 3 of the Manual is hereby amended by adding a new subsection 3.04 as follows: 3.04 Cost -of -Living Adiustments As part of the City's annual budget and capital program, the City Manager may recommend to the City Council a cost -of -living adjustment ("COLA") for employee salaries based on factors relevant to changes in the local cost of living and the availability of City funds, and a COLA may only occur upon approval of the City Council as part of the City's approval of the annual budget and capital program. A COLA is a fixed percentage increase or decrease in base salary. Every COLA approved by the City Council shall apply the same percentage increase or decrease to the base salary of every City employee, including but not limited to the City Secretary and the City Manager. For purposes of this subsection, "base salary' does not include the value of any benefits, vacation, sick time, leave, or any other employee advantage or gain. Section 3. Savings, Severability and Repealing Clauses. Ord. 4W2009 Amend Personnel Policy Manual -COLA Adj. Page 1 of 2 08-26-09 All ordinances of the City in conflict with the provisions of this ordinance are repealed to the extent of that conflict. If any section, subsection, sentence, clause, or phrase of this ordinance, or its application to a particular set of persons or circumstances, is declared invalid or adjudged unconstitutional by a court of competent jurisdiction, it does not affect the remaining portions of this ordinance, as the various portions and provisions of this ordinance are severable. The City Council, declares that it would have passed each and every part of this ordinance notwithstanding the omission of any part that is declared invalid or unconstitutional. Section 4.
