HomeMy WebLinkAboutOrd 463-2009 Amending Public Information Sect 2 and Sect 8.pdfCITY OF ANNA, TEXAS ORDINANCE NO.463-2009 AN ORDINANCE OF THE CITY OF ANNA, TEXAS, AMENDING THE ANNA CITY CODE OF ORDINANCES BY AMENDING PART 11, ARTICLE 48 PUBLIC INFORMATION, SECTION 2 AND SECTION 8, AND ADDING A NEW SECTION 9; PROVIDING A DEFINITION FOR OFFICER OF PUBLIC INFORMATION; PROVIDING FOR REASONABLE PROCEDURES FOR SUBMITTING A PUBLIC INFORMATION REQUEST; PROVIDING FOR IMPLEMENTATION; AND AMENDING THE CITY OF ANNA PERSONNEL POLICY MANUAL REGARDING ROUTING OF PUBLIC INFORMATION REQUESTS. WHEREAS, the City of Anna,Public InformationOrdinance •i -• as Part 11, Article 48 of The Anna City Code of Ordinances ("Anna Code"); and WHEREAS, the City has previously adopted the City of Anna Personnel Policy ("the Manual"), which describes guidelines ani policies for personnel; an• WHEREAS, the City Council for the City of Anna, Texas ("City Council) has determined that it will be beneficial to the City and to those seeking public information to make requests in accordance with uniform and reasonable procedures; and WHEREAS, the City Council has determined that it will be beneficial for the City's employees to have additional instruction on the proper routing procedure for requests for public information to allow for prompt and appropriate handling of said requests. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS, THAT: Section 1. Recitals Incorporated. The above -referenced recitals are incorporated herein as if set forth in full for all purposes- .1= 7 In accordance with Part 11, Article 1, Section 9 of the Anna Code, the following amendments are made to Part 11, Article 48 Public Information. 2.01 Part 11, Article 48 Public Information, Section 2 of the Anna Code is amended as follows: Ord. 463-2009 Procedures for submitting PlFrs.doc PAGE 1 OF 4 09-08-09 (Ord. No. 463-2009, adopted 09108109) Public Information Request a/k/a "Open Records Request" means a request for public information made in accordance with Texas Government Code, Chapter 552 and in accordance with this Part, as amended. (Ord No. 463-2009, adopted 09108109)__ 2.02 Part 11, Article 48 Public Information, Section 8 of the Anna Code is amended as follows: Section 8. (a) In order to be considered valid and treated as a Public Information Request, a request seeking information from the City or any of its departments must: (1) be addressed conspicuously to the attention of and delivered only to the Officer for Public Information at a mailing address, Physical address, email address, or facsimile number provided by the Officer for Public Information; (2) be in writing, state that it is a request for public information, and state the requestor's name, mailing address, telephone number, and all additional information necessary to allow a response to be sent to a particular place o address, and (3) include a description of the information requested that is sufficiently specific to enable the City to accurately identify and locate any information that may be responsive to the request. (b) A Public Information Request may be delivered by hand, mail, facsimile, email, or private courier or commercial service. (c) Any email or facsimile submission addressed or delivered to any person other than the Officer for Public Information shall not be considered a Public Information Request. rd No. 463-2009, adopted 09108109) 2.03 Part 11, Article 48 Public Information of the Anna Code is amended by adding Section 9 as follows: Ord. 463-2009 Procedures for submitting PlKs.doc PAGE 2 OF 4 09-08-09 Section 9. Section 16 of the City of Anna Personnel Policy Manual is hereby amended by adding Subsection 16.13 as follows: 16.13 Response to Public Information Requests Requests for Public Information are to be handled solely by the City Secretary or other City employee designated by the City Manager. If any employee other than the City Secretary receives a request for information by facsimile or email, that employee must reply to the sender of the email or facsimile with a uniform response provided by the City Manager, stating or referencing information that specifies the proper method for submitting requests under Part 11, Article 48, Section 8 of The Anna City Code of Ordinances. If any employee other than the City Secretary receives a request for information other than by e-mail or facsimile, the employee shall immediately forward the request to the employee's department head who shall immediately forward the request to the City Secretary. Section 4. Savings, Severability and Repealing Clauses. All ordinances of the City in conflict with the provisions of this ordinance are repealed to the extent of that conflict. If any provision of this ordinance shall be held to be invalid or unconstitutional, the remainder of such ordinance shall continue in full force and effect the same as if such invalid or unconstitutional provision had never been a part hereof. The City declares that it would have passed this ordinance, and each section, subsection, sentence, clause, or phrase thereof irrespective of the fact that any one or more section, subsection, sentence, clause, and phrase be declared unconstitutional or invalid. Section 5. Publication of the Caption Hereof and Effective Date. This ordinance shall be in full force and effective from and after its passage and upon the posting and/or publication, if required by law, of its caption and the City Secretary is hereby directed to implement such posting and/or publication.
