ORDINANCE NO. 480-2010
AN ORDINANCE OF "rHE CITY OF ANNA, TEXAS, AUTHORIZING A DESIGNATED
REPRESENTATIVE TO DETERMINE THE METHOD OF PURCHASE THAT
PROVIDES THE BEST VALUE FOR CITY PURCHASES; PROVIDING FOR
SAVINGS, SEVERABILITY, AND REPEALING CLAUSES; PROVIDING FOR AN
EFFECTIVE DATE; AND PROVIDING FOR THE PUBLICATION OF "rHE CAPTION
HEREOF.
WHEREAS, the City Council of the City of Anna, Texas ("City Council") has previously
adopted ordinances, rules and regulations authorizing the City Manager to procure
certain purchases and contracts on the City's behalf; and
WHEREAS, the Texas Local Government Code requires that certain purchases be
expressly authorized by the City Council; and
WHEREAS, Texas Local Government Code §252.021 (c) permits a city to delegate to a
designated representative a city council's duty to determine the method of purchase that
provides the best value to a city; and
WHEREAS, the City Council has determined that it is in the best interests of the City
and the general public for the City Council to generally delegate to the City Manager the
duty to determine the method of purchase that provides the best value for purchases by
the City and that such delegation shall remain in full force and effect unless expressly
revoked by the City Council; and
WHEREAS, the City Council 'finds and determines that the delegation of said duty
provided for in this ordinance does not include the delegation of the authority to approve
or award a purchase or contract, which authority remains vested in the City Council,
except as delegated or authorized by other valid ordinance or resolution;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ANNA, TEXAS, THAT:
Section 1. Recitals Incorporated.
The above-referenced recitals are incorporated herein as if set forth in full for all
purposes.
Section 2. Delegation to Determine Purchasing Method.
The City Council hereby selects as its designated representative the City Manager of
the City of Anna, Texas to discharge on its behalf any duty it may have now or in the

future with respect to any purchase or contract to determine the method(s) of purchase
that will provide the best value to the City.
Section 3. Savings, Severability and Repealing Clauses.
All ordinances of the City in conflict with the provisions of this ordinance are repealed to
the extent of that conflict. If any provision of this ordinance shall be held to be invalid or
unconstitutional, the remainder of this ordinance shall continue in full force and effect
the same as if such invalid or unconstitutional provision had never been a part hereof.
The City declares that it would have passed this ordinance, and each section,
subsection, clause, or phrase thereof irrespective of the fact that anyone or more
sections, subsections, sentences, clauses, and phrases be declared unconstitutional or
invalid.
Section 4. Publication of the Caption Hereof and Effective Date.
This ordinance shall be in full force and effective from and after its passage and upon
the posting and/or publication, if required by law, of its caption and the City Secretary is
hereby directed to implement such posting and/or publication.
