AN ORDINANCE OF THE CITY OF ANNA, TEXAS, DECLARING ALL AREAS
RECEIVING LONGSTANDING TREATMENT AS PART OF THE CITY AS BEING
INCLUDED IN THE CITY'S CORPORATE LIMITS; PROVIDING FOR SAVINGS,
SEVERABILITY, AND REPEALING CLAUSES; PROVIDING FOR AN EFFECTIVE
DATE; AND PROVIDING FOR THE PUBLICATION OF THE CAPTION HEREOF.
WHEREAS, the City Council of the City of Anna, Texas ("City Council") has determined
and finds that the records of the City of Anna, Texas ("City") indicate that the areas
designated in the attached Exhibit A as the "Included Area" and the "Included Area Strip
5' Wide" (said areas collectively referenced herein as the "Declared Areas") are
adjacent to, part of, and have been a part of the City for at least the preceding 20 years;
and
WHEREAS, the City Council has determined and finds that the City has provided
municipal services, including police protection, to the Declared Areas and has otherwise
treated the Declared Areas as part of the City during the preceding 20 years; and
WHEREAS, the City Council has determined and finds that there has not been a final
judicial determination during the preceding 20 years that the Declared Areas or any
part(s) thereof are outside the boundaries of the City; and
WHEREAS, the City Council has determined and finds that there is no pending lawsuit
that challenges the inclusion of the Declared Areas or any part(s) thereof as part of the
City;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ANNA, TEXAS, THAT;

The above -referenced recitals constitute findings and determinations by the City Council
and are incorporated into this ordinance as if set forth in full herein for all purposes.
The requirements of Texas Local Government Code Section 41.003 for
inclusion of the Declared Areas into the City's corporate limits have been fulfilled, the
inclusion of the Declared Areas in the City's corporate limits is hereby declared and
shall not be contestable in any manner. The attached document labeled "Exhibit A" is
hereby adopted and is incorporated as part of this ordinance for all purposes. The
Declared Areas consist of and include: (1) all of that area of land shown to be colored in
red and designated as "INCLUDED AREA" in the map legend set forth on the attached

Exhibit A; and (2) a five-foot wide strip of land forming a closed loop with said strip
running in the center of the area shown to be a solid black line surrounded by a yellow
border and designated as "INCLUDED AREA STRIP 5'WIDE" in the map legend set
forth on the attached Exhibit A.
Section 3. Savings, Severability and Repealing Clauses.
All ordinances of the City in conflict with the provisions of this ordinance are repealed to
the extent of that conflict. If any provision of this ordinance shall be held to be invalid or
unconstitutional, the remainder of this ordinance shall continue in full force and effect
the same as if such invalid or unconstitutional provision had never been a part hereof.
The City declares that it would have passed this ordinance, and each section,
subsection, sentence, clause, or phrase thereof irrespective of the fact that any one or
more sections, subsections, sentences, clauses, and phrases be declared
unconstitutional or invalid.
Section 4. Publication of the Caption Hereof and Effective Date.
This ordinance shall be in full force and effective from and after its adoption by the City
Council.
