HomeMy WebLinkAboutOrd 541-2011 Wooden Truss Warning Signs.pdfCITY OF ANNA, TEXAS ORDINANCE NO. 541-2011 AN ORDINANCE OF THE CITY OF ANNA, TEXAS, AMENDING THE ANNA CITY CODE OF ORDINANCES BY AMENDING PART II, ARTICLE 21, ADDING A NEW SECTION 5 (WOODEN TRUSS WARNING SIGNS); PROVIDING FOR A PENALTY FOR ANY VIOLATION OF THIS ORDINANCE NOT TO EXCEED $2,000; PROVIDING FOR SAVINGS, SEVERABILITY, AND REPEALING CLAUSES; PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING FOR THE PUBLICATION OF THE CAPTION HEREOF. WHEREAS, the City of Anna Fire Department may become involved in handling fires within buildings or structures constructed with wooden truss roofs and floors; and WHEREAS, wooden truss roofs and floors can present a serious risk to fire suppression personnel because of structural failure as a result of exposure to fire; and WHEREAS, structural collapse of wooden truss roofs and floors can occur within the early stages of fire suppression activities; and WHEREAS, numerous fire suppression personnel throughout the United States have been killed or seriously injured as a result of structural failure of wooden truss roofs and floors which have been exposed to fire; and WHEREAS. the need exists for fire suppression personnel and incident commanders to recognize these particular construction features, during the early phases of ground operations; and WHEREAS, the Anna City Council has determined that a need exists for the marking of those commercial, industrial and certain residential structures within the City of Anna which have wooden truss roof and floor assemblies. in order to insure the safety of Fire Department personnel; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS, THAT: Section 1. Recitals Incorporated. The above-referenced recitals are incorporated herein as if set forth in full for all purposes. Section 2. Amendments. In accordance with Part II, Article 1. Section 9 ofthe Anna Code, Part II, Article 21 ofthe Anna Code is amended by adding new Section 5 to read as follows: CITY OF ANNA, TEXAS ORDINANCE NO. 541-2011 PAGE 1 OF3 Section 5. Wooden Truss Warning Signs 5.01 Definitions For the purpose of this section, the following terms, phrases and words shall have the following meaning: Warning Sign means a twelve (12) inches by twelve (12) inches sign of the design shown on Exhibit 1 attached hereto. Property Owner or Owner means any person, firm or corporation having a legal ownership interest in the property. Wooden Truss means a wooden roof or floor structure consisting of a group of triangles arranged in a single plan in such a manner that loads applied at the points of the intersections of the structural members will cause only direct stresses, tension or compression within the structural members. Wooden Truss may include, but are not limited to, the following constructions: bowstring, warren, sawtooth, k truss, scissors, cambered fink, hammerbeam, pratt, fink and inverted queen posts and floor truss. Multi-Familv Residential Structure means any residential structure having three (3) or more units that have restricted access through locked doors and have a common corridor for access to living units. 5.02 Required signage The Owner of any commercial, industrial or Multi-Family Residential Structure which has a Wooden Truss assembly shall be required to mount Warning Signs meeting the following minimum requirements: (a) Size and Construction. Each Warning Sign required to be installed in accordance with this section shall be of the size and construction as defined in Section 5.01. (b) Mounting Locations and Height From Finished Grade. A Warning Sign shall be mounted directly to the right of each series of entrance doors (front, rear and sides of the building or structure) at a height of five (5) feet up from finished grade. Additional Warning Signs may be required by the Fire Chief when the distance between entrance doors or the length of a series of entrances doors would require additional Warning Signs for visibility by Fire Department personnel. If the structure has a wall-mounted safe that holds building keys for firefighters and EMTs to retrieve in emer encies such as a "Knox 80x", a Warnin Si n shall be located CITY OF ANNA, TEXAS ORDINANCE NO. 541-2011 PAGE ZOF 3 directly above any such wall-mounted safe. (c) Property Owner Responsibilitv. It shall be the responsibility of each Property Owner to purchase, mount, maintain and prevent obstruction of any Warning Signs required to be mounted on a building or structure. Section 3. Penalty. Any violation of any of the terms of this ordinance, whether denominated in this ordinance as unlawful or not, shall be deemed a misdemeanor. Any person convicted of any such violation shall be fined in an amount not to exceed $2,000 for each incidence of violation. Each violation is considered a separate offense and will be punished separately. Section 4. Savings, Severability and Repealing Clauses. All ordinances of the City in conflict with the provisions of this ordinance are repealed to the extent of that conflict. If any provision of this ordinance shall be held to be invalid or unconstitutional, the remainder of such ordinance shall continue in full force and effect the same as if such invalid or unconstitutional provision had never been a part hereof. The City declares that it would have passed this ordinance, and each section, subsection, sentence, clause, or phrase thereof irrespective of the fact that anyone or more sections, subsections, sentences, clauses, and phrases be declared unconstitutional or invalid. Section 5. Publication of the Caption Hereof and Effective Date. This ordinance shall be in full force and effective from and after its passage and upon the posting and/or publication, if required by law, of its caption and the City Secretary is hereby directed to implement such posting and/or publication.
