HomeMy WebLinkAboutOrd 501-2010 Amending Ord No 495-2010 Certifications of Fire Dept Personnel.pdfCITY OF ANNA, TEXAS ORDINANCE NO. 501-2010 AN ORDINANCE OF THE CITY OF ANNA, TEXAS, AMENDING ORDINANCE NO. 495-2010; AMENDING SECTION 6.01 REGARDING CERTIFICATIONS AND QUALIFICATIONS OF FIRE DEPARTMENT PERSONNEL; PROVIDING FOR SAVINGS, SEVERABILITY, AND REPEALER CLAUSES; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, On April 27, 2010 the City Council of the City of Anna, Texas (the "City Council") approved Ordinance No. 495-2010 creating a City fire department; and WHEREAS, the City Council has determined that it is in the public interest to amend the qualifications for members of the department in Section 6.01 of Ordinance No. 495-2010; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS: Section 1. Recitals Incorporated The above-referenced recitals are incorporated herein as if set forth in full for all purposes. Section 2. Amendments to Ordinance No. 495-2010, Section 6.01 Section 6.01 of Ordinance No. 495-2010 of the City of Anna, Texas is hereby amended as follows: 6.01 General The Fire Chief and each member of the Anna Fire Department shall be trained, tested and certified as a fire figRter by aRd pl-JFSuant to the 8taRdards of the to the extent required by the Texas Commission of Fire Protection ("Commission"), under Chapter 419, Texas Government Code, and all other applicable law and regulations, as such laws and regulations pertain to each member's position, and shall receive any additional training, testing and certification determined to be necessary and appropriate by the Fire Chief, subject to the City Manager's approval and funding availability. must be traiRed, tested aRd oertified by the CommissioR to these same staRdards. Savings, Severability and Repealing Clauses All ordinances of the City in conflict with the provisions of this ordinance are repealed to the extent of that conflict. If any provision of this ordinance shall be held to be invalid or unconstitutional, the remainder of such ordinance shall continue in full force and effect the same as if such invalid or unconstitutional provision had never been a part hereof. The City declares that it would have passed this ordinance, and each section, subsection, sentence, clause, or phrase thereof irrespective of the fact that anyone or more sections, subsections, sentences, clauses, and phrases be declared unconstitutional or invalid. Section 4. Publication of the Caption Hereof and Effective Date This ordinance shall be in full force and effective from and after its passage and upon the posting and/or publication, if required by law, of its caption and the City Secretary is hereby directed to implement such posting and/or publication.
