HomeMy WebLinkAbout2003-09-20 Special Meeting MinutesMINUTES CITY OF ANNA SPECIAL CITY COUNCIL MEETING September 20, 2003 9:00 AM, CITY IIALL The City Council of the City of Anna met in Regular Session at 7:30 p.m., Tuesday, September 20, 2003, at the Anna City Hall, 101 N. Powell Parkway, and considered the following items: Call to Order. Mayor Kenneth L. Pelham called the meeting to order at 9:19 a.m. 2. Roll Call and Establishment of Quorum. All members were present, excepting Councilman John Geren. 3. Public hearing REVISION OF ZONING ORDINANCE AND ZONING MAP The City Council of the City of Anna, Texas, will conduct a public hearing to consider public comment, both written and oral, regarding a major revision of the City of Anna Zoning Ordinance and Zoning Map. Most existing developed areas will not be subject to changes under the revised ordinance. However, some retail/commercial areas and areas expected to become retail/commercial may be subject to some changes regarding permitted uses and other zoning regulations. Written comments on the proposed revisions to the zoning ordinance and map are welcomed and will be accepted until 5 p.m., September 19, 2003, at the office of the City Secretary, Anna City Hall, or may be brought to the public hearing and presented at the hearing. In order to hear and consider as many citizen comments as possible, the amount of time available for individual speakers at the public hearing may be limited. Speakers at the hearing will be heard according to their order on a listing to be established for such purpose by the City Secretary. Public Hearing was opened at 10:07 a.m. Peter Kavanaugh of 1620 Handley Drive, Dallas, Texas, representing Dr. Weaver's property. He noted that be sent letter to City on prior day stating that some things need to be revised to increase clarity. Section 13.4 on page 39 addresses multifamily lot size and densities and is not clear. He noted that section creating the Food -Beverage Overlay District provides that no such store can be located within 500 feet of another such store. The language here would include beverage machines, which the City probably does not want to include. Also, the provision allows the first person in the market to control the market, which is not a good idea. 09-20-03 Council Minutes-Special.doc Page 1 of 2 09/20/2003 Section 32 creates a building site. Mr. Kavanaugh expressed concern about existing building lot language and suggested that lot should not have to comply with minimum lot size as defined in the ordinance. He suggested that the ordinance was not yet ready for adoption. Mr. Lawrence responded by noting that the draft ordinance allows specific use permits to be issued for food -beverage stores within 500 feet of other such stores, as long as there are no traffic, parking, or other problems created by the issuance of such permit. Also, vending machines could be exempted from the provisions of this section of the ordinance. Mr. Montgomery and Mr. Mosier indicated concern that the food -beverage store section of ordinance is problematic. Mr. Montgomery suggested that a percentage of sales provision might be the best way of addressing the issue. Mr. Pelham stated that his preference would be to proceed with adoption of the ordinance and work out the specific concerns and language over the next few months. Hearing was closed at 10:18 a.m 4. Consider action to adopt revised zoning ordinance and zoning map, upon recommendation of Planning and Zoning Commission. Councilman Finley made a motion to accept the recommendation of the Planning and Zoning Commission. Councilman Montgomery seconded the motion. 3 Aye 1 Nay 0 Abstained (Councilman Mosier voted nay.) 5. Adjourn. Councilman Caldwell made a motion to adjourn.
