Lot 3 of the 455175 Business Addition
AN ORDINANCE OF THE CITY OF ANNA, TEXAS AMENDING THE CITY'S
COMPREHENSIVE PLAN, ZONING MAP, AND ZONING ORDINANCE AND CHANGING THE
ZONING OF CERTAIN PROPERTIES AS DESCRIBED HEREIN; PROVIDING FOR
SAVINGS, REPEALING AND SEVERABILITY CLAUSES; PROVIDING FOR AN EFFECTIVE
DATE; PROVIDING FOR A PENALTY CLAUSE NOT TO EXCEED $2,000 OR THE HIGHEST
PENALTY AMOUNT ALLOWED BY LAW, WHICHEVER IS LESS; AND, PROVIDING FOR
THE PUBLICATION OF THE CAp·nON HEREOF.
WHEREAS, the owner of the property described in Exhibit A attached hereto has requested a
certain zoning for said property; and
WHEREAS, the Planning and Zoning Commission of the City of Anna and the City Council of
the City of Anna have given the requisite notices by publication and otherwise and have held the
public hearings as required by law and afforded a full and fair hearing to all property owners
generally and to all persons interested in and situated in the affected area and in the vicinity
thereof, the City Council of the City of Anna has concluded that the Zoning Ordinance of the City
of Anna should be amended as follows:
NOW THEREFORE BE IT ORDAINED BY ·rHE CITY COUNCIL OF THE CITY OF ANNA,
TEXAS:
Section 1. The Comprehensive Zoning Ordinance of the City of Anna, Texas, is amended by
granting a Specific Use Permit for the tract described in Exhibit A, attached hereto and made an
integral part of this Ordinance. The Specific Use Permit shall include the following components.
1. Officelwarehouse as an allowable use of the Property.
2. All other provisions of the C-2 General Commercial District in the existing City of Anna
Zoning Ordinance are applicable to the tract and any uses of the tract.
Section 2. The official Zoning Map of the City of Anna shall be corrected to reflect the change
in zoning described herein.
Section 3. Any violation of any of the terms of this ordinance, whether denominated in this
ordinance as unlawful or not, shall be deemed a misdemeanor. Any person convicted of any
such violation shall be fined in an amount not to exceed $2,000 for each incidence of violation.
Each violation is considered a separate offense and will be punished separately.
Section 4. All ordinances of the City of Anna in conflict with the provisions of this ordinance are
repealed to the extent of that conflict. If any provision of this ordinance shall be held to be invalid
or unconstitutional, the remainder of such ordinance shall continue in full force and effect the
same as if such invalid or unconstitutional provision had never been a part hereof. The City
declares that it would have passed this ordinance, and each section, subsection, clause, or
phrase thereof irrespective of the fact that anyone or more sections, subsections, sentences,
clauses, and phrases be declared unconstitutional or invalid.

Section 5. This ordinance shall be in full force and effective from and after its passage and
upon the posting and/or publication, if required by law, of its caption and the City Secretary is
hereby directed to implement such posting and/or publication.

BEING a tract of land located in the THOMAS RATIAN SURVEY, ABSTRACT NO.
782, in the City of Anna, Col1in County, Texas and being a part of Lot 2, Block A of
Lots 1 & 2, Block A, 455/75 Business Addition according to the Plat thereof recorded
in Cabinet 2006, Slide 689, Map Records, Collin County, Texas and being more
particularly described as follows:
BEGINNING at a 112 inch iron rod with a red plastic cap stamped "RPLS 5674" set at
the Southwest comer of Lot 1, Block A of said Addition~
THENCE South 88 degrees 43 minutes 30 seconds West (Basis of bearings derived
from the Texas State Plane Coordinate System, North Central Zone, NAD 83), a
distance of 150.00 feet to a 112 inch iron rod with a red plastic cap stamped "RPLS
5674" set for comer;
THENCE North 01 degrees 16 minutes 30 seconds West, a distance of 368.89 feet to a
112 inch iron rod with a red plastic cap stamped "RPLS 5674" set for comer, said point
being South 66 degrees 24 minutes 09 seconds East, a distance of 83453 feet from a
5/8 inch iron rod with a yellow plastic cap stamped "PITTS 4595" found for comer;
THENCE North 88 degrees 43 minutes 30 seconds East, a distance of 150.00 feet to an
"X" set for comer in concrete paving in said East line of Lot 2 and said West line of Lot
1, said point being South 48 degrees 19 minutes 35 seconds West, a distance of 541.76
feet from a 112 inch iron rod with a red plastic cap stamped "GM GEER 3258" found
for corner;
THENCE South 01 degrees 16 minutes 30 seconds East, along the common line of said
Lots 1 and 2, a distance of 368.89 feet to the POINT OF BEGINNING and containing
55,333 square feet or 1.270 acres of land, more or less.
