HomeMy WebLinkAbout2003-12-09 Regular Meeting MinutesMINUTES REGULAR CITY COUNCIL MEETING December 9, 2003 7:30 PM Community Room, Texas Star Bank The City Council of the City of Anna met in Regular Session at 7:30 p.m., Tuesday, December 9, 2003, at the Community Room, Texas Star Bank, located at 402 W. White Street (FM 455). Call to Order. Meeting was called to order at 7:30 p.m. 2. Roll Call and Establishment of Quorum. Members present and participating: Mayor Kenneth Pelham, Mayor Pm Tem, Mark Montgomery, Councilman John Geren, Councilman Chris Caldwell, Councilman J. W. Finley Jr. Members absent: Councilman Lynn Mosier. 3. Consider citizen comments and presentations. Councilman Lynn Mosier arrived at 7:35 p.m. Mr. Mike Snider gave a presentation on building a web site for the City of Anna. There were no other presentations at this time. 4. Anna Volunteer Fire Department The monthly reports were presented and reviewed by council. Fire Chief David Hunt presented the Council with monthly reports for the Fire Department, and answered questions from the council. Mr. Hunt also noted that the Anna Christmas parade is Saturday December 13", and starts at 2:00 p.m. Public Hearing Public Hearing Opened at 7:50 p.m. Consider public comment on request for annexation by Kerry Burleson for a 52.71 acre tract in the J. C. Brantley Survey, Abstract No. 114, located at 12300 CR 425. Mr. Lee Lawrence noted where the property was located and noted that the 1" Street railroad crossing being closed in order for this project to work. There was no other comment at this time. Public Hearing: 1209-03 Council Minutes-Regulandoc 1 of 7 12-09-2003 Public Hearing opened at 7:55 p.m., To consider public comment on a zoning request by Mr. Don W. Collins, for an 8.00 acre tract and a 7.52 acre tract in the F. T. Daffan Survey, A-288, being Lot 2, Block E and Lot 1, Block D of The Falls, at approximately 1900 and 2100 W. White Street. Petitioner requests re -zoning of the tract from C-1 Restricted Commercial to C-2 General Commercial. Mr. Don Collins was present to answer questions. There were no other comments at this time. 6b. Consider recommendation of the Planning and Zoning Commission on a zoning request by Mr. Don W. Collins, for 8.00 acre tract and 7.52 acre tract in the F. T. Daffau Survey, A-288, being Lot 2, Block E and Lot 1, Block D of The Falls, at approximately 1900 and 2100 W. White Street. Petitioner requests re -zoning of the tract from C-1 Restricted Commercial to C-2 General Commercial. Mayor Pro Tem Montgomery made a motion to approve the revised C-2 zoning as recommended by the Planning and Zoning Commission. Councilman Caldwell seconded the motion 5 Aye 0 Nay 0 Abstained Motion carried unanimously. 7a. Public Hearing: Public Hearing opened at 8:07 p.m. To consider public comment on a zoning request by Mr. I. K. Kim for a 98.17 acre tract located in the W. S. Rattan Survey, A-752 and the Thomas Rattan Survey, A-782, located at 2800 W. White Street. Petitioner requests zoning as Planned Development, including General Commercial and Single Family Residential elements. Mr. Lawrence spoke briefly on the recommendation of the P & Z. Mr. Don Collins was present to answer any question the council may have. Public Hearing closed at 8:12 p.m. 7b. Consider recommendation on a zoning request by Mr. I. K. Kim for a 98.17 acre tract located in the W. S. Rattan Survey, A-752 and the Thomas Rattan Survey, A-782, located at 2800 W. White Street. Petitioner requests zoning as Planned Development, including General Commercial and Single Family Residential elements. Councilman Finley made a motion to approve the zoning, removing the residential elements as recommended by the Planning and Zoning Commission. T. Daffm Survey, Abstract No. 288, located at 2700 W. White Street. Petitioner requests zoning as Planned Development, including General Commercial and Single Family Residential elements. There were no comments at this time. Public Hearing closed at 8:16 p.m. 8b. Consider recommendation on a zoning request by Mr. Robert Fagala for a 9.061 acre tract in the F. T. Daffau Survey, Abstract No. 288, located at 2700 W. White Street. Petitioner requests zoning as Planned Development, including General Commercial and Single Family Residential elements. Mayor Pro Tem Montgomery made a motion to approve the zoning, removing the residential elements as recommended by the Planning and Zoning Commission. Public Hearing: Public Hearing opened at 8:17 p.m. To consider public comment on a zoning request by Mr. George West and Mr. A. L. Geer for a approximately 305 acre tract in the Henry Brantley Survey, Abstract No. 71 and the J. C. Farris Survey, Abstract No. 331, located on the north side of W. White Street along the west side of Slayter Creek. Petitioner requests zoning as Planned Development, including Retail/Commercial and Single Family Residential elements. Mr. Lawrence noted to the Council that this zoning request went before the P & Z one year ago. Mr. George West was present to answer any question and presented the council with information on this project. Mr. John Baker was also present. He asked that the council approve the zoning request with a cap at 1188 units. Mr. Phil Griesbach made a comment to send back to the P & Z Commission. Public Hearing closed at 9:07 p.m. 9b. Consider recommendation on a zoning request by Mr. George West and Mr. A. L. Geer for an approximately 305 acre tract in the Henry Brantley Survey, Abstract No. 71 and the J. C. Farris Survey, Abstract No. 331, located on the north side of W. White Street along the west side of Slayter Creek. Petitioner requests zoning as Planned Development, including Retail/Commercial and Single Family Residential elements. Mayor Pro Tem Montgomery made a motion to deny without prejudice, with a recommendation that petitioner return to P&Z for review of density requirements and masonry requirements. Public Hearing: Public Hearing opened at 9:12 p.m. To consider public comment on a request by Mr. Billy C. Cook for a Specific Use Permit to locate a manufactured home at 12360 CR 425. The property is approximately 2 acres in the J. C. Brantley Survey, A-114; located on the west side of CR 425 approximately 0.3 miles north of intersection of FM 2862 and CR 425. Mr. Billy Cook was present to answer questions. Public Hearing was closed at 9:18 p.m. 10b. Consider recommendation of the Planning and Zoning Commission on a request by Mr. Billy C. Cook for a Specific Use Permit to locate a manufactured home at 12360 CR 425. The property is approximately 2 acres, in the J. C. Brantley Survey, A-114; located on the west side of CR 425 approximately 0.3 miles north of intersection of FM 2862 and CR 425. Councilman Finley made a motion to approve the specific use permit with 2 years to tear down the existing residential unit. Councilman Mosier seconded the motion 5 Aye 0 Nay 0 Abstained Motion carried unanimously. l la. Councilman Caldwell made a motion to approve amendment Councilman Finley seconded the motion 5 Aye 0 Nay 0 Abstained Motion carried unanimously. 12. Consider recommendation regarding plat for Sonic Drive -In Addition. Councilman Mosier made a motion to accept plat for Sonic Drive -In Addition. Councilman Finley seconded the motion. 5 Aye 0 Nay 0 Abstained Unanimous Motion carried 13. Consider action on request by Mr. George Field for City participation in Housing Infrastructure Fund project for property in east Anna. 12-09-03 council Minutes-Regular.doc 4 of 7 12-092003 Jessica Kaltenbach gave a presentation on low Income Housing. She also noted that there is 10 Anna residents on the waiting list for the City of McKinney project. Mr. George Fields requested for City' participation with project. Tammy & Dooley were present and do not like the idea of low income housing going in be hind their house and would like the City Council to not participate in this. 14. Consider action on contract with DFWAir for location of intemet wireless facilities on City property. Mr. Lawrence spoke briefly on other contracts with other cities and their lease agreements with other cities. Councilman Mosier made a motion to authorize Mayor, Mr. Lawrence, and City Attorney to negotiate contract with DFWAir. Councilman Finley seconded the motion 5 Aye 0 Nay 0 Abstained Motion carried unanimously. 15a. Public Hearing opened at 11:06 p.m. Public Hearing to consider the following amendments to the Subdivision Ordinance (Ord. No. 2001-01) of the City of Anna: a. Amending Section 6.1 relating to park, recreation, and open space fees. b. Adding Section 8A relating to requirement for submittal of a development plat for certain types of development within the City and its extraterritorial jurisdiction. C. Amending Section 5.1 regarding requirements for preliminary plat. d. Amending Section 8.4 to prohibit cross-lot drainage. Mr. Lawrence asked the Council to remove item C from the discussion. Park and recreation and open space fees are 750.00 per platted lot at time of permitting. Mr. Lawrence also asked to defer action on item B also at this time. There was no other public comment Public Hearing closed at 11:15 p.m. 15b. Consider action on ordinance adopting amendments to the Subdivision Ordinance (Ord. Amending Section 5.1 regarding requirements for preliminary plat. d. Amending Section 8.4 to prohibit cross-lot drainage. Councilman Caldwell made a motion to adopt amendments A & D, excluding B & C. Councilman Mosier seconded the motion 5 Aye 0 Nay 0 Abstained Motion carried unanimously. 16a. Public Hearing: Public Hearing Opened at 11:17 p.m. 1MM3 Cound Minutes-Regular.doc 5 of 7 12-09-2003 To consider public comment regarding establishment of speed limits on East Seventh Street from Sherley Street to the eastern terminus of East Seventh Street, Easton Street between East Seventh Street and East Eighth Street, and East Eighth Street from Easton Street to Smith Street. Public Hearing Closed at 11:20 p.m. 16b. Consider action establishing speed limits on East Seventh Street from Sherley Street to the easter terminus of East Seventh Street, Easton Street between East Seventh Street and East Eighth Street, and East Eighth Street from Easton Street to Smith Street. Councilman Mosier made a motion to post 20 mph speed limit signs for school zones. Mayor Pro Tem Montgomery seconded the motion. 5 Aye 0 Nay 0 Abstained Motion carried unanimously. 17. Consider action authorizing building inspector position in Development/Inspection Department. Councilman Mosier authorized new position and for Building Official to recommend the person for the position in Development/Inspection. Mayor Pro Tem Montgomery seconded the motion. 5 Aye 0 Nay 0 Abstained Motion carried unanimously. 18. Consider action authorizing Change Order to JRJ Paving, LP in amount not to exceed twenty-five percent of the original contract for additional street work on N. Riggins St. Mayor Pro Tem Montgomery made a motion authorizing change order to JRJ Paving increasing the contract in the amount of 25 percent. Councilman Caldwell seconded the motion. 5 Aye 0 Nay 0 Abstained Motion carried unanimously. 19. Consider action authorizing Mayor to secure bids/quotes from not less than three qualified contractors to complete street work on N. Riggin Street (from Hackberry Street north to connect with terminus of JRJ Paving project). Mayor Pro Tem Montgomery made a motion authorizing the Mayor to secure bids/quotes for street work on N Riggins. Councilman Mosier seconded the motion. 5 Aye 0 Nay 0 Abstained Motion carried unanimously. 20. Consider approval of Citizen Survey and distribution of same. Mayor Pro Tem Montgomery made a motion to deliver to every household within the city limits. Mr. Lawrence spoke to council about a public hearing needs to be held on December 16, 2003. 22. Consider approval of Minutes for the meeting of November 12, 2003. No action was taken 23. Financial report. Wayne Cummings gave a financial report. 24. Payment of bills. Councilman Mosier made a motion to pay the bills. Councilman Finley seconded the motion. 5 Aye 0 Nay 0 Abstained Motion carried unanimously. 25. Adjourn.
