HomeMy WebLinkAboutPZmin2004-08-09MINUTES PLANNING AND ZONING COMMISSION SPECIAL MEETING August 9, 2004 The Planning and Zoning Commission of the City of Anna held a special meeting on Monday, August 9, 2004, at 6:30 p.m., at the Community Room of the Texas Star Bank, located at 402 W. White Street (FM 455), Anna, Texas, to consider the following items. Call to order. Chairman John Rattan called the meeting to order at 6:45 p.m. 2. Roll Call and Establishment of Quorum. All present. Staff briefing. Mr. Lee Lawrence, City Administrator, was recognized to review items 4, 5, 6, 7, and 8 on the agenda. 4a. Public Hearing: To consider public comment on a zoning request by Quan H. Vu on behalf of Anna 55 LLP for Planned Development Single Family Residential zoning for a 55.008 acre tract in the Robert A. Johnson Survey, Abstract No. 479, and the Ezra Shelby Survey, Abstract No. 839, tract located on the south side of CR 367, approximately 0.5 miles east of intersection of CR 367 and S. Central Expressway (U.S. 75). Chairman John Rattan opened the public hearing at 7:00 p.m. Mr. Quan Vu, consulting engineer for the developer, reviewed the provisions of the zoning request. He noted that the petitioners had incorporated all the questions and concerns expressed by the members of the Commission and by the City's planning consultant, Mr. Maurice Schwanke, into the revised zoning request. Commissioners suggested that there be a berm and live screening along the CR 367 frontage of the property. There was also suggestion that the trail be extended along the entire course of the Slayter Creek tributary that traverses the property along a northwest to southeast course. Motion to approve zoning request including provision for live screening and extension of trail through the property from northwest to southeast made by Mr. John Curiel; seconded by Mr. Duane Hayes; 5-0 in favor. 5a. Public Hearing: To consider public comment on a zoning request by Lee R. Purser for Planned Development Single Family Residential zoning for a 19.944 acre tract in the Thomas Rattan Survey, Abstract No. 782, tract located on the west side of Oak Hollow Estates, Phase 4, approximately 0.5 miles east of intersection of W. White Street (FM 455) and S. Central Expressway (U.S. 75). Public Hearing began at 7:19 p.m. No comments were made. Hearing was closed at 7:20 p.m. 5b. Consider recommendation on a zoning request by Lee R. Purser for Planned Development Single Family Residential zoning for a 19.944 acre tract in the Thomas Rattan Survey, Abstract No. 782, tract located on the west side of Oak Hollow Estates, Phase 4, approximately 0.5 miles east of intersection of W. White Street (FM 455) and S. Central Expressway (U.S. 75). Motion to table this item was made by Bethany Jablonski; seconded by Curie[; 5-0 in favor. 6. Consider recommendation regarding petition for Specific Use Permit to locate amateur radio towers/antennas on lot located at 111 Wilkes Court, legal description being Tara Farms Phase 2, Block D, Lot 34. Robert Bossmin, 7998 Hickory, Frisco, TX, the petitioner, briefly described the request being made. Robert Turk, 2904 Ashley Lane, expressed concern regarding interference with radio, television, and other electronic equipment Bethany Jablonski stated there is no HOA (Home Owners Association) for the Tara Farms area in which the towers are being proposed. There is only an Architectural Control Committee and the Committee did not actually meet. The approval letter sent to. the petitioner was probably from one person and had not been submitted to a board vote. Lauren Snipes, 108 Wilkes Ct., stated that the towers were not consistent of feel and appearance of the "country" neighborhood in the large lot, north part of the Tara Farms subdivision. Minutes 08-09-04.doc Page 2 of 4 Minutes 08-09-04.doc 91 Molly Young, Tara Farms resident, that that the towers would be an aesthetic problem and would create electronic interference. Mr. Bossmin stated there would be no interference with the high frequency service on this equipment. He also noted that PRB1 is a Federal and state law that allows for the towers. Motion to table by Curiel; no second; motion fails. Motion to deny petition by Duane Hayes; seconded by Crim; 4-0-1 in favor; Jablonski abstained. Consider recommendation on preliminary plat for Villages of Hurricane Creek. Nathan Thompson spoke briefly regarding the preliminary plat for Villages of Hurricane Creek. They worked out issues with the City of Anna. Lee Lawrence, City Administrator, spoke regarding the traffic issues brought to the city's attention by Maurice Schwanke. He confirmed that these issues are being taken care of. Phasing noted in the traffic study, must be completed and therefore be a part of the approval of the preliminary plat. Motion to approve recommendation on preliminary plat for Villages of Hurricane Creek by Crim; seconded by Hayes; 5-0 in favor. Consider recommendation on final plat for Hurricane Creek Blvd. Explanation given by Don Collins regarding the street and how it moves east to west due to not having ownership of a particular section of property. Traffic study discussed. Crossover discussed. Eastern two lanes with first phase, second phase required to do another road, third or fourth phase the northern connection and the last phase would be the western. Overview by Nathan Thompson we will build the eastern two lanes first, then medium break and build the pieces necessary to make the intersection work. Motion to approve final plat for Hurricane Creek Boulevard by Curiel; seconded by Hayes; 5-0 in favor. Consider recommendation on combination plat for Joe Bryant Elementary School Addition. Dr. Wardell spoke regarding the school addition. Lee Lawrence spoke regarding concern for the entrance to the property, with only one entrance and the possibility of emergency services having to respond, the roadway could be blocked. There would be 36 ft. roadway, allowing ample room for vehicles; possibility of future expansion. Staff report/update on current projects. No comments. 11. Video presentation — Community of Choices. Postponed until next month. 12. Citizen comments and other presentations. Molly Young presented a letter to the board; stated she had previously given this letter to the Mayor. Mr. Lawrence advised that a Planning Technician will be on board soon. This person will help greatly with regards to planning and zoning issues. Mr. Rattan told Ms. Young, we are very interested in making the City of Anna a better place and appreciate her concern, time and effort. Mr. Lawrence also advised the board on the North Texas Alliance issue with regards to TCEQ and possible de -certification of North Collin. 13. Discussion of other issues as desired by members of PZC.
