PLANNING AND ZONING COMMISSION
REGULAR MEETING
January 2, 2007
The Planning and Zoning Commission of the City of Anna held its regular meeting on Tuesday,
January 2, 2007, at 7:00 p.m., at the Community Room of the Texas Star Bank, located at 402
W. White Street (FM 455), Anna, Texas, to consider the following items.
C Call to order and establishment of quorum.
Chairman John Rattan called the meeting to order at 7:00 p.m. Members present were
John Rattan, William Ballantyne, J. W. Finley, Nancy Pennington and Councilman Keith
Green as the City liaison.
Commissioner Jon Hendricks arrived at 7:10 p.m. Commissioner members David Culler
and Joseph Bode were absent.
2. Consider/Discuss/Act on recommendation regarding request by R. G. Urban
representing Hurricane Manor, Inc. regarding annexation of the following tract:
A 45.001 acre tract in the Henry Smith Survey, A0822 and the Zechariah Roberts
Survey, A0760, located west of CR 368, adjacent to and south of Hurricane Creek
Estates, approximately one quarter mile west of North Central Expressway (Hwy
75), property being owned by Hurricane Manor, Inc.
Warren Corwin, of Corwin Engineering, Inc., Allen Texas, and Sandra Bryant of A. M.
Bryant Properties were representatives for Mr. R. G. Urban, owner of property. Mr.
Corwin was recognized and noted that he prepared documents for annexation and
would answer questions needed. Mr. R. G. Urban was also present.
Motion was made by Mr. Finley to recommend to Council approval of annexation. Mr.
Ballantyne seconded the motion, which passed by the following vote:

3. Public Hearing
To consider public comment on a request by R. G. Urban of Hurricane Manor, Inc.
representing Urban Acres for Single Family Residential Estate (SF -E) zoning.
Property is located west of CR 368, adjacent to and south of Hurricane Creek
Estates, approximately one quarter mile west of North Central Expressway (Hwy
75).
Public Hearing was opened at 7:03 p.m.
Jim Roundtree, 640 Hurricane Creek Circle, Anna, Texas, expressed concerns
regarding drainage on the layout and stated that water from heavy rains could overflow

the a tributary of Hurricane Creek which could be damaging to residents of Hurricane
Creek Estates.
Jim Preston, also a resident of Hurricane Creek, expressed his opposition to the zoning
request.
Public Hearing was closed at 7:07 p.m.
4. Action
Consider/Discuss Act on recommendation regarding request by R. G. Urban of
Hurricane Manor, Inc. representing Urban Acres for Single Family Residential
Estate (SF -E) zoning. Property is located west of CR 368, adjacent to and south of
Hurricane Creek Estates, approximately one quarter mile west of North Central
Expressway (Hwy 75).
Lee Lawrence, City Manager, was recognized and showed the location of area to be
annexed from the map that was displayed. He also showed the location of Hurricane
Creek Estates and noted that the area for the requested zoning is south of and adjacent
to Hurricane Creek Estates. He stated that our Land Use Plan shows the area as low
density residential, which does conform to the zoning request being made by the
property owner.
Chairman Rattan asked about the sewer. Mr. Lawrence stated that the plan is for lots of
one acre or more to have on site sewer systems for individual lots. The on-site systems
are currently in use at Hurricane Creek Estates.
Motion was made by Mr. Finley to recommend to Council approval of the zoning request.
Ms. Pennington seconded the motion, which passed by the following vote:

5. ConsiderfDiscuss/Act on recommendation regarding preliminary plat for Urban
Acres.
Warren Corwin, of Corwin Engineering, Inc., Allen, Texas, gave brief presentation
regarding preliminary plat.
Commissioner Hendricks asked about the water line. Mr. Lawrence stated that the
water supply currently is provided by South Grayson Water Supply Corporation through
a 6" line. He stated that the city is asking the property owner/developer to put a 12"
waterline along the frontage of the property and the City would pay the difference in the
oversizing based on the difference between the cost of an 8" line and a 12" line. He
noted that the City's Master Water Plan includes a 12" line in that area. He stated that
this provision would be included in a development agreement. He also noted that a
flood study would have to be done prior to approval of a final plat.
After brief discussion, motion was made by Mr. Finley to recommend approval of
preliminary plat to Council. Ms. Pennington seconded the motion, which passed by the
following vote:

To consider public comment on a request by Mrs. Lola M. Mosier to change
zoning on tract of land in the Henry Brantley Survey, A0071, from Single Family
Residential (SF -1) to General Commercial (C2) zoning. Property is located at 303
N. Powell Pkwy (Hwy 5).
Public Hearing was opened at 7:21 p.m.

Mosier to change zoning on tract of land In the Henry Brantley Survey, A0071,
from Single Family Residential (SF -1) to General Commercial (C2) zoning.
Property is located at 303 N. Powell Pkwy (Hwy 5).
Mr. Lawrence was recognized and stated that there were three opposition notices
received from letters sent to property owners within 200 ft. of the perimeter that is the
subject of the zoning request. He also stated that these notices were delivered at the
meeting tonight and that one of the notices was from Mr. Picazo, who spoke at the public
hearing.
He noted that the area that is the subject of this zoning is commercial on the Land Use
Plan.
Ms. Lola Mosier was recognized and stated that when they purchased the land as
residential, but since the growth of Anna, the area is louder and no longer peaceful and
quiet but instead has heavy traffic. She also said that they have someone interested in
buying their property for commercial use.
After in-depth discussion, several PZC members indicated that the requested zoning
would be acceptable if some uses were restricted or prohibited.

Motion was made by Mr. Ballantyne to recommend approval of the zoning request with
the following uses prohibited and with alcehotriquor sales not allowed:
Boats sales and storage; drive-through restaurants; radio/television towers; transit
station; auto repair; outside storage; massage therapy facility; motel/motor lodges and
exhibition area.
Motion failed for lack of second.
Motion was made by Mr. Finley to recommend to Council approval of the C2 zoning with
the following uses prohibited:
Boats sales and storage; drive-through restaurants; radiottelevision towers; transit
station; auto repair; outside storage; massage therapy facility; motel/motor lodges and
exhibition area..
Ms. Pennington seconded the motion, which passed by the following vote:

& Public Hearing
To consider public comment on a request by the City of Anna to change zoning on
tracts six and eighty-seven of the Henry Brantley Survey, A0071 located at 101
and 111 N. Powell Pkwy (Hwy 5). Tract six is currently zoned as Restricted
Commercial (C-1) and tract eighty-seven is currently zoned as Restricted
Commercial (C-1) on east half of tract and Single Family Residential (SF -1) on
west half of tract City requests a zoning of General Commercial (C-2) for both
tracts.
Public Hearing opened at 7:49 p.m.
Mr. Lawrence gave brief review regarding zoning request. The City owns three-quarters
of the block that is bordered by Powell Pkwy on the east, 3� Street on the north, James
Street on the west and 0 street on the south. The frontage alon�q Powell Street is
zoned C1 and the west hall of the tract at the comer of James and 3 street is currently
zoned as Single Family Residential. City is requesting that zoning of the entire area
both be zoned as C2.
Public Hearing closed at 7:52 p.m.
9. Action
Consider/Discuss/Act on recommendation regarding request by the City of Anna
to change zoning on tracts six and eighty-seven of the Henry Brantley Survey,
A0071 to General Commercial (C2) zoning.
Motion was made by Mr. Finley, seconded by Ms. Pennington to recommend to Council
approval of zoning request. Mr. Hendricks asked that the same restrictions be included
to this zoning request as the Mosier zoning. Mr. Finley and Ms. Pennington agreed that
same restrictions be added to City's zoning request.
The restrictions include the following:
Boats sales and storage; drive-through restaurants; radio ttelevision towers; transit
station; auto repair; outside storage; massage therapy facility; motel/motor lodges and
exhibition area.
Motion carried by the following vote:
5 aye 0 nay 0 abstained
10. DiscusslConsider/Act on revised site plan for the Anna City Hail Addition.
Mr. Lawrence stated that commission had approved a site plan for this property
previously and the reason for the amended site plan is because the City does not want
to remove an old, large pecan tree as part of the project. In the previous site plan lay-
out the tree is at the edge of the parking lot. On the revised site plan the parking lot and
entrance has been redesigned so that the tree will not have to be removed.
Motion was made by Mr. Ballantyne to recommend to Council approval of the revised
site plan for Anna City Hall Addition. Mr. Finley seconded the motion, which passed by
the following vote:

11. Citizen comments and other presentations.
Mr. Mosier requested a copy of the C-2 zoning list. No other comments were made.
12. Consider action to approve Minutes of the December 6, 2006 meeting.

There being no further business, a motion was made by Mr. Ballantyne, seconded by
Mr. Finley, to adjourn meeting.
The meeting adjourned at 8:01 p.m.
