HomeMy WebLinkAboutPZmin2007-10-02MINUTES PLANNING AND ZONING COMMISSION REGULAR MEETING October 2, 2007 The Planning and Zoning Commission of the City of Anna held a meeting on Tuesday, October 2, 2007, at 7:00 p.m., at the Community Room of Anna City Hall Administration Building, located at 111 North Powell Parkway (Hwy 5), to consider the following items. 1. Call to order and establishment of quorum. Chairman Jon Hendricks called the meeting to order at 7:05 p.m. Members present were Jon Hendricks, Jeff Caponera, Nancy Pennington, J. W. Finley, Mike Green, Darren Driskell and Councilman Keith Green as the City Council Liaison. Commission member William Ballantyne was absent. 2. Public Hearing To consider public comment on a request by 40 PGE LTD to revise the existing Planned Development (PD) Ordinance No. 58-2003 for rezoning of a 39.99 acre tract. Petitioner request charges in zoning from Single Family Residential (SF -1) and Restricted Commercial (C-1) to include Single Family Residential (SF -1) Multiple Family Residential (MF -2) and General Commercial (C-2). Property is located at the northeast comer of the intersection of S. Powell Parkway (Hwy 5) and County Road 421. Public Hearing opened at 7:05 p.m. Jed Dolson of Skorborg Company, Dallas, Texas, representative for 40 PGE LTD, presented a power point presentation and gave an overview of the development plan regarding the zoning request. Mr. Dolson asked that the planned development (PD) zoning request be changed to include only C-2 uses with the following uses specifically restricted: Boarding or Rooming House Travel Trailer Park College or University Exhibition Area Fairgrounds Outside Pens and/or Kennels Stadium or Playfield, Public Solid Waste Transfer Station Auto Leasing and Rental Bus Terminal Truck and Bus Leasing Truck or Motor Freight Terminal Truck Sales PZC Agenda 1002-07AW Page 1 of 5 10-02-07 Truck Stop Boat Sales and Storage Air Conditioning and Refrigeration Contractor Farm Equipment Sales and Service Feed and Farm Supply Flea Market Heavy Machinery Sales Massage Parlor Nude Modeling Studio Pawn Shop Trailer, Manufactured Housing, or Mobile Home Display and Sates Trailer Rentals Farm Seed and Fertilizer Sales and Storage Pump Sales, Repair and Maintenance Engine and Motor Repair After a discussion, Chairman Hendricks suggested that the following uses be added to the restrictive list: Automobile Repairs(Operations (minor repair would be allowed) Automobile sales Electrician Exterminating Shops Farmer's Market Fixture Repair Shops Fraternal Organizations, Lodges, Civic Clubs, Philanthropic, and Eleemosynaries Frozen food Lockers Interior Decorating Stores that include any of the following: upholstering and making of draperies, slipcovers and other similar articles when conduced as a part of the retail operat5rions and secondary to the principal use. Massage Therapy Facility Play Equipment with outside display Rehabitation Care Institution Repair and Storage Garages Service Stations — Including the incidental storage of rental trucks and trailers, except that trucks and trailers for storage or rental may not be parked within the public right-of-way Tanning Salon Taxidermist Vehicle Service Centers Uses similar to the above permitted uses provided the Anna City Council approves said uses prior to the issuance of a building permit. Additionally, a SUP is required for warehousing facilities — Incidental to the primary business use and located within the same building Mr. Dolson agreed that the new list and changes are acceptable. Action PZC Agamda 10-02-07.60c Page 2 of 5 10-02-07 Consider/Discuss/Act on recommendation regarding request by 40 PGE LTD to revise the existing Planned Development (PD) Ord No. 56-2003 for rezoning of a 39.99 acres tract to Single Family Residential, Multiple Family Residential and General Commercial. After a lengthy discussion between staff, the representative for the property owner, and Commission, a motion was made by Mr. Caponera to recommend to Council approval of the request to amend the current PD zoning to a PD with zoning throughout defined as C-2 zoning with the following uses restricted including the additional restricted uses added tonight and contingent upon compliance with the adopted Thoroughfare Plan and not with the sketch submitted by the representative. The additional restricted uses included as follow: Boarding or Rooming House Travel Trailer Park College or University Exhibition Area Fairgrounds Outside Pens and/or Kennels Stadium or Mayfield, Public Solid Waste Transfer Station Auto Leasing and Rental Bus Terminal Truck and Bus Leasing Truck or Motor Freight Terminal Truck Sales Truck Stop Boat Sales and Storage Air Conditioning and Refrigeration Contractor Farts Equipment Sales and Service Feed and Farm Supply Flea Market Heavy Machinery Sales Massage Parlor Nude Modeling Studio Pawn Shop Trailer, Manufactured Housing, or Mobile Home Display and Sales Trailer Rentals Farm Seed and Fertilizer Sates and Storage Pump Sates, Repair and Maintenance Engine and Motor Repair Automobile Repairs/Operations (minor repair would be allowed) Automobile sales Electrician Exterminating Shops Farmer's Market Fixture Repair Shops Fraternal Organizations, Lodges, Civic Clubs, Philanthropic, and Eleemosynaries Frozen food Lockers PZC Agenda 10-02-07Am Page 3 of 5 10-02-07 Interior Decorating Stores that include any of the following: upholstering and making of draperies, slipcovers and other similar articles when conducted as a part of the retail operations and secondary to the principal use. Consider/Discuss/Act on scheduling date for a Workshop regarding revisions to City of Anna zoning ordinance concerning fencing requirements. After a brief discussion, the Commission all agreed to schedule a workshop on Thursday, October 25, 2007 at 6:00 p.m. in the Community Room of City Hall Administration Building. 5. Consider/Discuss/Act on changing the date of the regular P&Z meeting, Tuesday, November 6, 2007, due to date tieing on election day. Following a brief discussion, a motion was made by Ms. Pennington to change the date of the regular P&Z meeting to Wednesday, November 7, 2007. Mr. Finley seconded the motion which passed by the following vote: 6 aye 0 nay 0 abstained 6. Citizen comments and other presentations. Councilman Mike Crist briefed regarding the Economic Summit Meeting to be held on Saturday, October 13, 2007, and encouraged members of the Commission to attend. There were no other presentations or citizen comments. 7. Consider action to approve Minutes of the following meetings: • August 7, 2107 • September4,2007 A motion was made by Mr. Caponera to table the August r and September 4, 2007 minutes until the next meeting. Adjourn There being no further business, a motion was made by Mr. Caponera, seconded by Mr. Driskell, to adjourn meeting.
