The Board of Adjustment of the City of Anna will hold a meeting on Tuesday, April 1, 2002, at
6:45 p.m. at the Anna City Hall, located at 120 W. 4th Street, Anna, Texas, to consider the
following items.
1. Call to order.
2. Roll call and establishment of quorum.
3. Consider action on Minutes of meetings of August 6, 2002.
4. Consider request by Mr. Fernando Aragon for variance from provisions of City of Anna
Zoning Ordinance, Section 22 (Schedule of District Regulations), for property located at
1506 Wildwood Trail. (See attached application/request form.)
5. Discussion of other issues as desired by members of Board of Adjustment.
6. Adjourn.

MINUTES OF MEETING OF AUGUST 6, 2002
A special meeting of the Board of Adjustment (BOA) of the City of Anna was held on Tuesday,
August 6, 2002, at 7:00 p.m. at the Anna City Hall, 120 W. 4th Street, Anna, Texas.
1. Call to Order
The meeting was called to order by Chairman John Rattan at 7:04 p.m.
2. Roll call
Members present included: Mr. John Rattan, Chairman and Dr. John White. Mr. John
Curiel was present as an alternate. A quorum was established. Mr. Lee Lawrence was
present as staff support to the Board of Adjustment.
3. Minutes of Meeting of April 2, 2002
Mr. John Curiel moved that the Minutes of the meeting of July 2, 2002, be approved as
presented. Dr. White seconded the motion, which passed by a vote of 3-0.
Mr. John Hendricks and Mr. David Crim arrived at 7:08 p.m
Items 4 through 10 were considered together.
4. Consider request by Choice Homes for variance from provisions of City of Anna Zoning
Ordinance, Section 22 (Schedule of District Regulations), for property located at 408
Magnolia Street.
5. Consider request by Choice Homes for variance from provisions of City of Anna Zoning
Ordinance, Section 22 (Schedule of District Regulations), for property located at 318
Magnolia Street.
6. Consider request by Choice Homes for variance from provisions of City of Anna Zoning
Ordinance, Section 22 (Schedule of District Regulations), for property located at 212
Magnolia Street.
7. Consider request by Choice Homes for variance from provisions of City of Anna Zoning
Ordinance, Section 22 (Schedule of District Regulations), for property located at 409
Magnolia Street.

10. Consider request by Choice Homes for variance from provisions of City of Anna Zoning
Ordinance, Section 22 (Schedule of District Regulations), for property located at 408
O’Hara Street.
Mr. Lawrence was recognized to discuss these items. He said that Choice Homes was
requesting variances from the setback provisions of the City of Anna zoning ordinance.
Six of the seven requests are variance requests from the rear yard requirement. One
request is for a variance from a side yard requirement. A copy of the plat had been
provided to the Board. The lots are cul-de-sac and corner lots on which the builder is
constructing larger homes that will not fit on the existing lot configurations. Mr.
Lawrence noted that a representative of Choice Homes was present to answer
questions.
After brief discussion in which members noted that they wanted to encourage the
construction of larger homes in the subdivision and that these lots appeared to be
special cases and constituted a small percentage of the total number of lots in the
subdivision, Mr. Curiel moved that the variances be approved. Mr. Crim seconded the
motion which passed by a vote of 5-0.
11. Other issues
There were no other issues brought forward by those present.
12. Adjourn
There being no further business, Mr. Crim moved that the meeting be adjourned. The
motion was seconded by Mr. Curiel and on vote of 5-0 the meeting was adjourned at
7:17 p.m.

4. Request by Mr. Fernando Aragon for variance from provisions of City of Anna Zoning
Ordinance, Section 22 (Schedule of District Regulations), for property located at 1506 Wildwood
Trail
Mr. Fernando Aragon has submitted a proposal for a masonry garage at the referenced
property. Because the proposed building is closer to the property line than allowed in this
zoning district, a variance regarding front yard setbacks is required.
Because the proposed garage is set back from the front property line by 32 feet and because
there are at least four other garages and/or other structures in the Wildwood Addition that are
approximately this same distance from the front property line or even closer, I recommend that
the variance be granted under the following conditions:
1. The garage have a masonry exterior of the same brick type and color as the residential
structure on the same lot.
2. The garage construction be completed within sixty (60) days of granting the variance.
