PLANNING AND ZONING COMMISSION
Regular MEETING
June 2,2009
The Planning and Zoning Commission of the City of Anna held its regular meeting on Tuesday,
June 2,2009,at 7:00 p.m.,at the Community Room of the Anna City Hall Administration Building
located at 111 North Powell Parkway (Hwy 5),to consider the following items.
1.Call to order and establishment of quorum.
The meeting was called to order at 7:01 p.m.by Chairman Nancy Pennington.Members
present were Nancy Pennington,David woods,Joe Osborn,Bently Powell,Mike Green and
Keith Green as the City Council Liaison.Staff members present were Maurice Schwanke
and Tana Ross.
2.Citizen comments and/or other presentations.
There were no citizen comments and lor other presentations.
3.Election of Officer:
Vice Chairman
Mr.Schwanke gave a brief presentation and noted that Mr.Hendricks (previous vice
chairman)is now a member of the City Council.He also noted to Commission that he was
asked if they should wait until new members were appointed to the commission or elect a
new vice chairman now.Mr.Schwanke informed that staff would prefer to elect a vice
chairman now,one that is already serving on the Commission.
Election of officer for Vice Chairman was as follow:
Nominees for Vice Chairman were Bently Powell nominated by Mr.Osborn and Mike Green
by Nancy Pennington.A motion was made by Mr.Woods to ceased nominations.Mr.
Osborn seconded the motion which passed by the following vote:4 aye 0 nay 0
abstained
Mr.Powell received two (2)votes and Mr.Green received three (3)votes.Mr.Green was
appointed as Vice Chairman.
4.(a)Public Hearing
To consider an amendment to the Zoning Ordinance changing Appendix 2 (use
tables)and section 22.02 regarding building size.
The Public Hearing opened at 7:03 p.m.
Mr.Schwanke gave a brief presentation regarding amendment to the zoning ordinance.
Over the course of time most applications for commercial zoning have come in the form of
"PO's"instead of straight zoning because many times the Planning and Zoning Commission
and the City Council have wanted to approve "C1"with additional uses being added or "C2"
with uses being deleted which required the zoning to put into a "PO".Additionally,in the
"C1"district there is a 5,000 square foot maximum on the building size.This in many cases
causes a hardship especially on larger tracts or strip centers,in the staff opinion.

Additionally,the use charts are being recommended to change how churches are being
treated.Most of the time in most cities churches are allowed to go in any residential
district.This proposed ordinance makes that change.The trend has also been to allow
Rest home/nursing home into or adjacent to residential areas due to there low impact
on neighborhoods (extremely low traffic volumes)and that many people want to live
near their parents.As such this use is also being added to the residential classification.
Mr.Schwanke answered questions from the Commission.
The Public Hearing closed at 7:09 p.m.
(b)Action
Consider/Discuss/Act on recommendation regarding proposed Zoning Ordinance
change.
Following a brief discussion,a motion was made by Mr.Green to recommend to Council
approval of the amendment to the zoning ordinance,Appendix 2 (use tables)and section
22.02 regarding building size.Mr.Woods seconded the motion,which passed by the
following vote:5 aye 0 nay 0 abstained
5.Consider action to approve Minutes of the May 5,2009 meeting.
A motion was made by Mr.Woods to approve the Minutes of the May 5,2009 meeting as
submitted.Mr.Osborn seconded the motion,which passed by the following vote:
5 aye 0 nay 0 abstained
6.Adjourn
There being no further business,a motion was made by Mr.Osborn,seconded by Mr.
Powell to adjourn meeting.The meeting adjourned at 7:17 p.m.
