SPECIAL CITY COUNCIL MEETING AGENDA

FINANCIAL STATUS / BUDGET SESSION
February 21, 2007 7:00 PM

The City Council of the City of Anna met in a Special Meeting Session at 7:00 um..
Wednesday, February 21, 2007, at the Community Room, Texas Star Bank, located at
402 W. White Street (FM 455), to consider the following items.
1. Call to Order.
Mayor Kenneth Called the meeting to order at 7:06 p.m.
2. Roll Call and Establishment of Quorum.
Mayor Kenneth Pelham and Council Members Lynn Mosier, John Garen, David
Crim and Bill Deragon were present. Council Members Kevin Anderson and
Keith Green were absent.
3. ConsiderfDiscuss/Action regarding Development Agreement between Anna
Center, Ltd., and the City of Anna (Underwood tract).
Charles Hodges and Steve Herbert were present and started the discussion
regarding the development agreement between the Anna Center, Ltd., and the
City of Anna. The agreement between Brookshire's, Charles Hodges and Nancy
Underwood for the land and the development of the tract and the start of the
store has changed since the beginning of the project Mr. Herbert would like 90
days from the effective date (January 23, 2007) of the agreement amendment
which would be around April 23, 2007 to finish agreements between Brookshire's
and Nancy Underwood. Mr. Herbert would then be able to give the city a date in
which the store would be started. City Manager, Lee Lawrence went over costs
associated with the project and answered questions from council members.
Authorize the Mayor to sign the amendment subject to additional language that
makes Nancy Underwood liable for that portion of the costs of the 367 sewer line
in the event that the construction does not begin within the time period discussed
tonight and subject Nancy Underwood signing the original agreement and the
first amendment and new amendment. Council Member Crim made the motion
and Council Member Garen seconded the motion. Motion passes.

4. Consider/Discuss/Action regarding Reviewing the Financial Status / Budget
for the City of Anna, Texas.
City Manger, Lee Lawrence reminded council that they had requested this item
be back on this agenda and answered questions from council members. Council
Member Crim made the motion to table this item. Council Member Garen
seconded the motion. Motion passes.

S. CLOSED SESSION: Under Tex. Gov't Code Chapter 551, the City Council
may enter into closed session to:
a. discuss or deliberate the purchase, exchange, lease, or value of real
property (Tex. Gov't Code §551.072);
b. consult with legal counsel on matters in which the duty of the
attorney to the governmental body under the Texas Disciplinary
Rules of Professional Conduct of the State Bar of Texas clearly
conflicts with Chapter 551 of the Government Code. (Tex. Gov't
Code §551.071).
c. Personnel: Consider position of City Manager. (Government Code,
Section 551.074).
The council reserves the right to enter into executive session at any time
throughout this meeting under any applicable exception to the Open
Meetings Act
Council Member Crim made the motion to return to open session at 8:28 p.m.
Council Member Oren seconded the motion. Motion passes.

6. Consider and act upon items listed under Item 5 Executive Session, as
necessary.
Council Member Crim made the motion to take no action. Council Member Garen
seconded the motion. Motion passes.

7. Consider/Discuss/Action regarding position of City Manager.
Council Member Crim made the motion to accept the resignation letter from City
Manager, Lee Lawrence and to pay severance according to section 11 of his
contract as well as add additional 3 months pay ($3,600.00) and pass
compensation that has not been paid; the effective date being tomorrow,
February 22, 2007. Council Member Garen seconded the motion. Motion passes.

Council Member Deragon made the motion to appoint Police Chief Kenny Jenks
as acting City Manager. Council Member Garen seconded the motion. Motion
passes.

8. Adjourn.
Council Member Garen made the motion to adjourn at 8:36 p.m. Council Member
Crim seconded the motion. Motion passes.
