HomeMy WebLinkAbout2008-07-22 Workshop/Closed Session & Regular Meeting MinutesMINUTES OF CITY OF ANNA AGENDA NOTICE - CITY COUNCIL WORKSHOP/CLOSED SESSION July 22, 2006 6:30 p.m. -Anna City Hall Administration Building The City Council of the City of Anna met in Workshop Session and Closed Session at 6:30 p.m., Tuesday, July 22, 2008, at the Anna City Hall Administration Building, located at 111 North Powell Parkway (Hwy 5), regarding the following items. 1. Call to Order Mayor Pro Tem Kevin Anderson called the meeting to order at 6:33 pm. 2. Roll Call and Establishment of Quorum. Mayor Pro Tem Kevin Anderson and Council Members Keith Green, Darren Driskeil and David Crim were present. Mayor Kenneth Pelham and Council Member Chat were absent. 3. Discussion regarding Presentation of a Draft 2008-2009 Budget (Philip Sanders) City Manager, Philip Sanders presented the proposed 2008-2009 Budget to council members and reviewed some of the highlights of the budget and answered questions from council members. Mr. Sanders reviewed salary classification for all departments; general fund revenue; general fund expenditures; capitol items in the general fund; items left out of the budget that were requested; listed some grants that the City is applying for, facilities; 5 year capital improvements plan; Utility Fund; capitol improvements listed for the utility fund; water rate study; and water and sewer rates being increased. Council Member Driskell made the motion to enter closed session at 6:57 pm. Council Member Green seconded the motion. Motion passes. AYE 4 NAY 0 ABSTAIN 4. CLOSED SESSION: Under Tex. Gov't Code Chapter 651, the City Council may enter into closed session to: a. discuss or deliberate the purchase, exchange, lease, or value of real property (Tex. Gov't Code §551.072); b. consult with legal counsel on matters in which the duty of the attorney to the governmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Chapter 551 of the Government Code (Tex. Gov't Code §651.071); c. Personnel: Consider position of City Secretary. Council Member Ddskell made the motion to return to open session at 7:28 pm. Council Member Green seconded the motion. Motion passes. AYE 4 NAY 0 ABSTAIN 0 6. Discussion regarding any item on the City Council's July 22, 2006 Regular Meeting Agenda. No discussion. 6. Adjourn. Council Member Green made the motion to adjourn at 7:31 pm. Council Member Driskell seconded the motion. Motion passes. Call to Order. Mayor Pro Tem Kevin Anderson called the meeting to order at 7:32 pm. 2. Invocation and Pledge of Allegiance. Pastor Rob Simmons gave the invocation. 3. Citizen comments. Citizens are allowed 3 minutes to speak The Council is unable to respond to or discuss any issues that are brought up during this section that are not on the agenda, other than to make statements of specific factual information in response to a citizen's inquiry or to recite exuding policy In response to the inquiry. Johnny Garza of 1801 Pecan Grove Dr, Anna, Texas spoke on Collin County closing the subdivision pool for improper maintenance. 4. Consent Items. These items consist of noncontroversial or "housekeeping" Items required by law. items may be considered individuaW by any Council member making such request prior to a motion and vote on the Consent hems. a. Minutes of Joint City CouncillAnna EDC Workshop June 17, 2008. b. Minutes of Regular City Council Meeting, June 24, 2008. C. Resolution accepting the Anna EDC's petition for annexation.(Maurice Schwanke) d. Resolution approving a Resolution by the Anna CDC authorizing and approving a loan agreement between the Anna CDC and the Office of the Governor Economic Development and Tourism Division and Related Documents, Authorizing the Execution and delivery of the Loan Agreement, and other matters in connection therewith. (Philip Sanders) e. Resolution regarding "Going Green." (Philip Sanders) Council Member David Crim made the motion to approve the consent items. Council Member Driskell seconded the motion. Public Hearing: The City of Anna will hold a public hearing regarding the submission of an application to the Office of Rural Community Affairs for a Texas Community Development Block Grant Program (TxCDBG) grant (Maurice Schwanke) Mayor Pro Tem Anderson opened the public hearing at 7:36 pm. Maurice Schwanke, Director of Planning and Development spoke to council members about the TxCDBG. There was no other public comment. Mayor Pro Tem Anderson closed the public hearing at 7:39 pm. 6. Consider/DiscussfAction regarding a Resolution approving a change order to the contract with Landscapes Unlimited for the construction of a restroomiconcession building at Slayter Creek Park. (Maurice Schwanke) Maurice Schwanke, Director of Planning and Zoning spoke to council members regarding the proposed change order. City Manager, Philip Sanders spoke to council members regarding the funding of the restroom/concession facility. Council Member Crim made the motion to approve. Council Member Green seconded the motion. Motion passes. AYE 4 NAY 0 ABSTAIN 7. Consider/Discuss/Action regarding a Resolution approving the Anna EDC Bylaws. (Philip Sanders) City Manager, Philip Sanders briefed council members on the changes and the approval by the EDC Members of their by laws. Mr. Sanders further stated that the by laws have been reviewed by the City Attorney. Council Member Driskell made the motion to approve. Council Member Green seconded the motion. Motion passes. AYE 4 NAY 0 ABSTAIN 8. Consider/Discuss/Actionregarding an Ordinance approving Anna EDC expenditures. (Clark McCoy) City Attorney, Clark McCoy explained to council members that the ordinance would allow EDC to make expenditures without Council approval for budgeted items which cost $10,000.00 or less and non -budgeted items which cost $5,000.00 or less. Council Members and staff discussed the proposed ordinance. Council Member Driskell made the motion to approve. Council Member Green seconded the motion. Motion fails. Tie. AYE 2 (CM Green and Driskell) NAY 2 (CM Crim and Anderson) ABSTAIN 0 Council Member Crim would like to see a line Rem listed on the budget for miscellaneous items and was not concerned about the dollar amount. Mayor Pro Tem Anderson thought that $5,000.00 is too high and would like to see the non budgeted items reduced to $2,500.00. Council Member Driskell made the 07-22-08 CC Minut"Am 4 07-22-08 motion to have $10,000.00 for the budgeted items and to reduce the non budgeted items to $2,500.00. The motion dies for lack of a second. Council Member Crim made the motion to eliminate the non budgeted item. Council Member Green seconded the motion. Motion passes. AYE 3 NAY 1 (CM Driskell) ABSTAIN 0 9. Consider/Discuss/Action on any items listed on posted agenda for July 22, 2008 City of Anna Workshop Session and Closed Session, or any closed session occurring during this Regular Meeting, as necessary. Council Member Crim made the motion to go into executive session at 7:55 pm. Council Member Green seconded the motion. Motion passes. AYE 4 NAY 0 ABSTAIN 0 Council Member Crim made the motion to return to open session at 8:19 pm. Council Member Driskell seconded the motion. Motion passes. AYE 4 NAY 0 ABSTAIN 0 Council Member Driskell made the motion to take no action. Council Member Green seconded the motion. Motion passes. AYE 4 MAY 0 ABSTAIN 0 10. Adjourn. Council Member Green made the motion to adjourn at 8:20 pm. Council Member Driskell seconded the motion. Motion passes.
