CITY OF ANNA AGENDA NOTICE - CITY COUNCIL WORKSHOP/CLOSED
SESSION
November 25, 2008 6:30 p.m. - Anna City Hall Administration Building
The City Council of the City of Anna met in Workshop Session and Closed Session at
6:30 p.m., Tuesday, November 25, 2008, at the Anna City Hall Administration Building,
located at 111 North Powell Parkway (Hwy 5), regarding the following items.
1. Call to Order.
Mayor Kenneth Pelham called the meeting to order at 6:30 pm.
2. Roll Call and Establishment of Quorum.
Present were Mayor Kenneth Pelham and Council Members Mike Crist, Keith
Green, Darren Driskell and Becky Glover. Council Member Kevin Anderson
arrived 6:31 pm.
3. Discussion of proposed Smoking Regulations. (Philip Sanders)
City Manager, Philip Sanders led the discussion and asked council members
for their direction regarding proposed smoking regulations. Council Members
voiced their views on the choice of having smoking versus nonsmoking
restaurants, etc. Council Members agreed that public buildings such as City
Hall, libraries, etc. should be non-smoking. Council's direction was to draft an
ordinance for consideration.
4. Discussion regarding re -zoning certain properties. (Maurice Schwanke)
City Manager, Philip Sanders led the discussion on this item stating that Citizen
Master Plan Update Advisory Committee is discussing the rezoning of
properties already zoned and that Council Member Crist asked for this item to
be placed on the agenda for direction from council. Mr. Sanders suggested that
council waft to discuss the re -zoning of properties until the committee has
finished drafting all changes to the Master Plan and at that time it will be
presented to council for discussion. Council Member Crist stated that the
committee wanted direction from council on whether to !ring individual zoning
issues before council or to wad until the complete draft is done and have a
workshop to discuss revisions. Council Members suggested waiting until the
whole draft is completed before discussing the Master Plan changes.
Council Member Driskell made the motion to enter closed session at 6:45 pm.
Council Member Crist seconded the motion. Motion passed.

5. CLOSED SESSION: Under Tex. Gov't Code Chapter 551, the City Council
may enter into closed session to:
a. discuss or deliberate the purchase, exchange, lease, or value of
real property (Tex. Gov't Code §551.072);
b. consult with legal counsel on matters in which the duty of the
attorney to the governmental body under the Texas Disciplinary
Rules of Professional Conduct of the State Bar of Texas clearly
conflicts with Chapter 551 of the Government Code (Tex. Gov't
Code §651.071);
c. Discuss or deliberate Economic Development Negotiations:
(1) To discuss or deliberate regarding commercial or financial
information that the City Council has received from a business
prospect that the City Council seeks to have locate, stay, or
expand in or near the territory of the City of Anna and with which
the City Council is conducting economic development
negotiations; or
(2) To deliberate the offer of a financial or other Incentive to a
business prospect described by subdivision (1). (Tex. Gov't Code
§561.087)
d. Personnel: Consider position of City Manager Evaluation.
(Government Code, Section 551.074);
e. Personnel: Consider position of Planning and Zoning Commission
Member. (Government Code, Section 551.074);
f. Personnel: Consider position of Community Development
Corporation Board Member. (Government Code, Section 551.074).
The council further reserves the right to enter into executive session at
any time throughout any duly noticed meeting ander any applicable
exception to the Open Meetings Act.
Council Member Green made the motion to return to open session at 7:18 pm.
Council Member Cdst seconded the motion. Motion passed.

Member Crist seconded the motion. Motion passed.

CITY OF ANNA AGENDA NOTICE — CITY COUNCIL REGULAR MEETING
November 25, 2008 7:30 p.m. —Anna City Hall Administration Building
The City Council of the City of Anna met in Regular Session at 7:30 p.m., Tuesday,
November 25, 2008, at the Anna City Hall Administration Building, located at 111 North
Powell Parkway (Hwy 5), to consider the following items.
1. Call to Order.
Mayor Kenneth Pelham called the meeting to order at 7:30 pm.
2. Invocation and Pledge of Allegiance.
Billy Deragon led the invocation.
3. Citizen comments. Citizens are allowed 3 minutes to speak. The Council is
unable to respond to or discuss any issues that are brought up during this
section that are not on the agenda, other than to make statements of specific
Factual information in response to a citizen's inquiry or to recite existing policy in
response to the Inquiry.
None
4. Presentation by Stacy Driskeli, President of the Greater Anna Chamber of
Commerce and discussion of upcoming community events.
Stacy Driskeii briefed council on the Christmas Parade and Tree Lighting on
December 13, 2008; Spirit of Christmas Food Drive; First Annual GACC
Banquet in January 2009; Anna Glow Fest during Memorial Weekend in May
2009
5. Consent items. These items consist of non-coMrovershd or "housekeeping"
items required by law. Items may be considered individually by any Council
member making such request prior to a motion and vote on the Consent hems.
a. Approve Minutes of Regular City Council Meeting, November 10,
2008.
Council Member Crist made the motion to approve. Council Member Green
seconded the motion. Motion passes.

6. Consider/Discuss/Action to on Recommendation of selection of
Pingleton, Howard & Company, P.C. as the CPA firm to provide financial
and compliance audit services for the City of Anna for the 2007/2008
Budget Year and authorize the City Manager to execute an agreement
with the firm to provide the services. (Wayne Cummings)

Assistant City Manager, Wayne Cummings reviewed the process for the
selecting Pingleton, Howard & Company, P.C. and recommended to council
that they choose this firm. City Manager, Philip Sanders stated that the charter
calls for the auditor to be changed every five years and that the City of Anna
has had the current auditor for five years. Mr. Tom Pingleton briefly addressed

T. Consider/Discuss/Action to adopt an ordinance naming the Anna Code of
Ordinance. (Clark McCoy)
City Attorney, Clark McCoy stated that this ordinance amends the City's
codification of ordinances to provide a uniform citation to the codification and
that such uniformity is required by the City Charter and will assist in maintaining
an orderly system of citation to the codified ordinances when cited in legal
documents and public documents or record. Council Member Crist made the
motion to approve. Council Member Green seconded the motion. Motion
passes.

8. ConsidedDiscuss/Action regarding position of Planning and Zoning
Commission Member. (City Council)
Council Member Glover made the motion to take no action. Council Member
Crist seconded the motion. Motion passes.

9. Consider/Discuss/Action regarding position of Community Development
Corporation Board Member. (City Council)
Council Member Ddskell made the motion to remove Molly Young. Council
Member Green seconded the motion. Motion passes.

Council Member Driskeil nominated Andrew Werely to fill the vacancy. Council
Member Crist seconded the nomination. Nomination passes unanimously.
Andrew Werely will serve on the Anna Community Development Corporation.
10. Consider/Discuss/Action regarding appointments to the Citizen Master
Plan Update Advisory Committee. (Maurice Schwanke)
Maurice Schwanke, Planning and Development Director reviewed the new list
of appointments due to changes in members. Mayor Pelham made the motion
to approve the updated Citizen Master Plan Update Advisory Committee as
presented. Council Member Green seconded the motion. Motion passes.

Member Driskell seconded the motion. Motion passes.

Council Member Crist made the motion to approve the 2008 City Manager
Fiscal Evaluation. Council Member Anderson seconded the motion. Motion
passes.
