HomeMy WebLinkAbout2009-01-27 Workshop/Closed Session & Regular Meeting MinutesMINUTES OF CITY OF ANNA AGENDA NOTICE -CITY COUNCIL WORKSHOP/CLOSED SESSION January 27. 2009 6:30 p.m. -Anna City Hall Administration Building The City Council of the City of Anna met in Workshop Session and Closed Session at 6:30 p.m., Tuesday, January 27,2009, at the Anna City Hall Administration Building, located at 111 North Powell Parkway (Hwy 5), regarding the following items. 1. Can to Order Mayor Kenneth Pelham called the meeting to order at 6:30 pm. 2. Roll Call and Establishment of Quorum. Present were Mayor Kenneth Pelham and Council Members Mike Crist, Keith Green, Darren Driskell and Becky Glover. Council Member Kevin Anderson arrived 6:31 pm. 3. Discussion regarding the City of Anna Branding Project This item was postponed until the February 10, 2009 City Council Meeting. Council Member Crist made the motion to go into closed session at 6:32 pm. Council Member Green seconded the motion. Motion passes. AYE 6 NAY 0 ABSTAIN o 4. CLOSED SESSION: Under Tex. Gov't Code Chapter 551, the City Council may enter into closed session to: a. discuss or deliberate the purchase, exchange, lease, or value of real property (Tex. Gov't Code§551.072); b. consult with legal counsel on matters in which the duty of the attomey to the govemmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Chapter 551 of the Govemment Code (Tex. Gov't Code §551.071); c. Discuss or deliberate Economic Development Negotiations: (1) To discuss or deliberate regarding commercial or financial information that the City Council has received from a business prospect that the City Council seeks to have locate, stay, or expand in or near the territory of the City of Anna and with which the City Council is conducting economic development negotiations; or 1-27-09 Regular CC Minutes.doc 1-27-09 (2) To deliberate the offer of a financial or other incentive to a business prospect described by subdivision (1). (Tex. Gov't Code 1551.087) The council further reserves the right to enter into executive session at any time throughout any duly noticed meeting under any applicable exception to the Open Meetings Act. Council Member Crist made the motion to return to open session at 7:06 pm. Council Member Driskell seconded the motion. Motion passes. AYE 6 NAY 0 ABSTAIN o 5. Discussion regarding any item on the City Council's January 27, 2009 Regular Meeting Agenda. Council Members discussed having two public hearings in February for the smoking ordinance since the weather was bad and no one attended the meeting. 6. Adjourn. Council Member Crist made the motion to adjourn at 7:08 pm. Council Member Anderson seconded the motion. Motion passes. AYE 6 NAY 0 ABSTAIN o ATTEST: APPROVED: 1-27-09 Regular CC Minutes.doc 2 1-27-09 MINUTES OF CITY OF ANNA AGENDA NOTICE -CITY COUNCIL REGULAR MEE1·ING January 27, 2009 7:30 p.m. -Anna City Han Administration Building The City Council of the City of Anna met in Regular Session at 7:30 p.m., Tuesday, January 27, 2009, at the Anna City Hall Administration Building, located at 111 North Powell Parkway (Hwy 5), to consider the following items. 1. Can to Order. Mayor Kenneth Pelham called the meeting to order at 7:30 pm. 2. Invocation and Pledge of Allegiance. Council Member Darren Driskell gave the invocation. 3. Citizen comments. Citizens are allowed 3 minutes to speak. The Council is unable to respond to or discuss any issues that are brought up during this section that are not on the agenda, other than to make statements of specific factual Information In response to a citizen's inquiry or to recite existing policy In response to the Inquiry. None 4. Public Hearing: For City Council to hear Public Comment regarding a Proposed Smoking Ordinance for the City of Anna, Texas. Mayor Pelham opened the public hearing at 7:31 pm. Stacy Driskell, President of the Greater Anna Chamber of Commerce stated that she had spoken to most of the restaurant owners and most were in favor of the smoking ordinance. Mayor Pelham closed the public hearing at 7:32 pm. 5. Consent Items. These Items consist of non-controversial or "housekeeping" items required by law. items may be considered Individually by any Council member making such request prior to a motion and vote on the Consent items. a. Approve Minutes of Special City Council Meeting, January 3, 2009. b. Approve Minutes of Regular City Council Meeting January 13, 2009. c. Approve Minutes of P & Z Commission Meeting, January 6, 2009. d. Approve an ordinance authorizing the execution and delivery of a finance contract for the acquisition of a backhoe, levying a tax and providing for the payment and security thereof, and enacting other provisions related thereto. Approve an ordinance authorizing the execution and delivery of a finance contract for the acquisition of a police car, levying a tax in 1-27-09 Regular CC Minutes.doc 3 1-27-09 payment thereof, and enacting other provisions related thereto. Approve an ordinance authorizing the execution and delivery of a finance contract for the acquisition of a fire truck, levying a tax in payment thereof, and enacting other provisions related thereto. (Kenny Jenks) Council Member Glover noted a change to the January 3, 2009 minutes. Council Member Driskell made the motion to approve the consent items with the change to January 3, 2009 minutes. Council Member Crist seconded the motion. Motion passes. AYE 6 NAY 0 ABSTAIN o 6. Consider/Discuss/Action regarding approving an Ordinance for Public Information Act Cost Recovery Fees. (Clark McCoy) City Attorney, Clark McCoy explained that this ordinance was drafted for council to consider as a result of a state law that now allows governmental entities to adopt rules governing cost recovery for the value of personnel time expended in futfilling public information requests. The ordinance further sets out the costs of supplies and materials required to fulfill requests. The ordinance creates a new Article 48 in Part II of the Anna City Code of Ordinances, and a new section 10 in Part IV (Schedule of Fees) that includes the amounts of the charges associated with requests. Council Member Crist made the motion to approve. Council Member Green seconded the motion. Motion passes. AYE 6 NAY 0 ABSTAIN o 7. Consider/DiscuSS/Action regarding approving an Ordinance of the City Council of the City of Anna, Texas, amending Ord. No. 108-2003 regarding annual alcohol permit and license fees. (Clark McCoy) City Attorney, Clark McCoy stated that this ordinance has been drafted for council consideration as a result of a clarification by the Texas Alcohol Beverage Commission relating to the procedures for charging permit fees for Mixed Beverage permits. Council Member Crist made the motion to approve and to change all references to beer and wine to say alcoholic beverages. Council Member Green seconded the motion. Motion passes. AYE 6 NAY 0 ABSTAIN 8. Consider/Discuss/Action regarding a Resolution delaying the implementation of new utility rates on the former South Grayson Customers until March 2009. (Wayne Cummings) Wayne Cummings, Assistant City Manager stated this is the third extension request delaying new utility rates for the former South Grayson Customers. Mr. Cummings 1-27"()9 Regular CC Minutes.doc 4 1-27..()9 further stated that to give customers proper notice an additional 28 day extension was needed. Mr. Cummings answered questions from council members. Council Member Driskell made the motion to approve. Council Member Crist seconded the motion. Motion passes. AYE 6 NAY 0 ABSTAIN o 9. Future Agenda Item: (a) Consideration regarding placing a Citizen Comments Item at the end of the City Council Regular Agenda. (CM Darren Driskell) Council Member Driskell led the discussion for having a citizen comments item at the end of the agenda also. Council Member Driskell stated that citizens are confused on when to comment on items. Council Members and staff discussed the pros and cons of having citizen comments items at the beginning and the end of the agenda. Council Members decided that the Mayor should make a statement at the beginning of each agenda that citizens who wish to speak on any item fill out the Speaker Registration Form and tum it in to the City Secretary. 10. Consider/Discuss/Action on any items listed on posted agenda for January 27, 2009 City of Anna Workshop Session and Closed Session, or any closed session occuning during this Regular Meeting, as necessary. Council Member Crist made the motion to take no action. Council Member Green seconded the motion. Motion passes. AYE 6 NAY 0 ABSTAIN o 11. Adjourn.
