CITY OF ANNA AGENDA NOTICE -CITY COUNCIL WORKSHOP/CLOSED
SESSION
February 10, 2009 6:30 p.m. -Anna City Hall Administration Building
The City Council of the City of Anna met in Workshop Session and Closed Session at
6:30 p.m., Tuesday, February 10, 2009, at the Anna City Hall Administration Building,
located at 111 North Powell Parkway (Hwy 5), regarding the following items.
1. Call to Order
Mayor Pro Tem Kevin Anderson called the meeting to order at 6:30 pm.
2. Roll Call and Establishment of Quorum.
Present were Mayor Pro Tem Kevin Anderson and Council Members Keith
Green, Darren Driskell and Becky Glover. Mayor Kenneth Pelham and Council
Member Mike Crist were absent.
3. Consider/Discuss/Action regarding the City of Anna Branding Project.
City Manager, Philip Sanders introduced Professors Keith Owens and Eric
Ligon from UNT who have been interviewing residents, council members,
developers, etc during the discovery phase of the branding project. The
professors gave a presentation on their findings for strategies to market Anna.
They believe using phrases describing people, growth and place should be
used to describe Anna. Council Members gave their opinions regarding the
professor's suggestions and asked questions.
Council Member Green made the motion to go into closed session at 7: 12 pm.
Council Member Driskell seconded the motion. Motion passes.

4. CLOSED SESSION: Under Tex. Gov't Code Chapter 551, the City Council
may enter into closed session to:
a. discuss or deliberate the purchase, exchange, lease, or value of
real property (Tex. Gov't Code §551.072);
b. consult with legal counsel on matters in which the duty of the
attorney to the governmental body under the Texas Disciplinary
Rules of Professional Conduct of the State Bar of Texas clearly
conflicts with Chapter 551 of the Government Code (Tex. Gov't
Code §551.071);
c. Discuss or deliberate Economic Development Negotiations:

(1) To discuss or deliberate regarding commercial or financial
information that the City Council has received from a business
prospect that the City Council seeks to have locate, stay, or
expand in or near the territory of the City of Anna and with which
the City Council is conducting economic development
negotiations; or
(2) To deliberate the offer of a financial or other incentive to a
business prospect described by subdivision (1). (Tex. Gov't Code
§551.087)
The council further reserves the right to enter into executive session at
any time throughout any duly noticed meeting under any applicable
exception to the Open Meetings Act.
Council Member Driskell made the motion to return to open session at 7:27 pm.
Council Member Green seconded the motion. Motion passes.

5. Discussion regarding any item on the City Council's February 10, 2009
Regular Meeting Agenda.
None
6. Adjourn.
Council Member Glover made the motion to adjourn at 7:28 pm. Council
Member Driskell seconded the motion. Motion passes.

CITY OF ANNA AGENDA NOTICE -CITY COUNCIL REGULAR MEETING
Febnlary 10, 2009 7:30 p.m. -Anna City Hall Administration Building
The City Council of the City of Anna met in Regular Session at 7:30 p.m., Tuesday,
February 10, 2009, at the Anna City Hall Administration Building. located at 111 North
Powell Parkway (Hwy 5), to consider the following items.
Welcome to the City Council Meeting. Please sign the Sign-In-Sheet as a record of attendance. If
you wish to speak on an open-session agenda item please fill out the OpinionlSpeaker
Registration Form and tum it in to the City Secretary before the meeting starts.
1. Can to Order.
Mayor Pro Tern, Kevin Anderson called the meeting to order at 7:32 pm.
2. Invocation and Pledge of Allegiance.
Council Member Driskell gave the invocation.
3. Citizen comments. CItizens are allowed 3 mlnrnes to apeak. The Council Is unable to
respond to or discuss any Issues that are brought up dunng this section that are not
on the agenda, other than to make statements of specific factuallnfotmlltlon in
response to a citizen's Inquiry or to recite existing policy In response to the Inquiry.
Grace Hill a former SGWS customer stated her concerns on a letter received
concerning an increase in water rates coming to them.
4. Discussion regarding Out of City Utility Rates.
Staff and council members discussed looking into reducing the 1.5 rate increase that
is assessed on all non-resident meters; the possibility of phasing in over time the rate
increase to non-resident customers and getting clarification on the various options
concerning water rates.
5. Public Hearing: (2nd)
For City Council to hear Public Comment regarding a Proposed Smoking
Ordinance for the City of Anna, Texas.
Mayor Pro Tern Anderson opened the public hearing at 7:54 pm. There were no
comments from residents. Staff and council members discussed having a smoking
ordinance and the possibility of grand-fathering the one restaurant in Anna that has
smoking at this time. There will be a 3"' public hearing at the next council meeting
and an ordinance will be placed on the 1 st meeting in March.
6. Presentation of the City of Anna Police Deparbnent Annual Report. (Kenny
Jenks)
Police Chief, Kenny Jenks presented the report and went over some of the highlights
of the report. Chief Jenks answered questions from council members.

7. Discussion of the Quarterly Financial Update. (Wayne Cummings)
Philip Sanders, City Manager went thru a power point presentation for a discussion
of the Quarterty Financials. Mr. Sanders reviewed revenues and expenditures for
each department and answered questions from council members.
8. Consent Items. These Items consist of non-controversial or "housekeepIng" Items
required by law. Items may be considered Individually by any CouncIl member making
such request prior to a motion and voN on the Consent Items.
a. Approve Minutes of Regular City Council Meeting January 27, 2009.
b. Review of Anna CDC Minutes dated January 7, 2009.
(:. Approve a development plat for Eric Patrizio
d. Approve a development plat for William Docekal.
e. Approve the "Westfield Addition" site and landscape plan.
f. Approve the site plan for "Love's Truck Stop".
g. Approve an ordinance Ordering a May 9, 2009 General Election and
associated dates and procedures.
Council Member Driskell wished to talk about item (f) separately. Council Member
Green made the motion to approve items a thru e and item g. Council Member
Driskell seconded the motion. Motion passes.

Council Member Driskell had concerns and questions about trucks exiting Hwy 75
and entering Love's Truck Stop. Council Member Driskell made the motion to
approve item f. Council Member Green seconded the motion. Motion passes.

9. Consider/Discuss/Action regarding approving Natural Springs Park Contract
(Maurice Schwanke)
Maurice Schwanke, Director of Planning and Development summarized the contract
and answered questions from council members. Council Member Glover made the
motion to approve subject to approval by legal counsel. Council Member Driskell
seconded the motion. Motion passes.

10. (a) Public Hearing: For City Council to hear public opinion regarding
Maintenance Bond requirement in subdivision ordinance.
Mayor Pro Tem Anderson opened the public hearing at 8:35 pm. Maurice Schwanke,
Director of Planning and Development explained that the current Code of Ordinances
states one year for the term of a maintenance bond. The attached ordinance
changes the Code to reflect the Councils previous action which is having a two year
maintenance bond. Mayor Pro Tem Anderson closed the public hearing at 8:36 pm.
(b) Consider/Discuss/Action approving an ordinance regarding a Maintenance
Bond requirement in subdivision ordinance. (Maurice Schwanke)
Council Member Green made the motion to approve. Council Member Glover
seconded the motion. Motion passes.

11. (a) Public Hearing: For City Council to hear public opinion regarding a Zoning
Classification for Short-Tenn Loan Businesses.
Mayor Pro Tem Anderson opened the public hearing at 8:36 pm. Maurice Schwanke,
Planning and Development Director gave council the back ground behind this
ordinance and answered questions from council members. Mayor Pro Tem Anderson
closed the public hearing at 8:39 pm.
(b) Consider/Discuss/Action regarding approving an ordinance for a Zoning
Classification for Short-Tenn Loan Businesses. (Maurice Schwanke)
Council Member Driskell made the motion to approve adding that a SUP be needed
for 12 zoning also. Council Member Green seconded the motion. Motion passes.

12. ConsiderlDiscusslAction approving amendments to Anna CDC Bylaws
regarding check signing, purchases and reimbursement of funds. (Jessica
Perkins)
Jessica Perkins summarized the changes to the CDC Bylaws regarding check
signing, purchases and reimbursement of funds. Council Member Green made the
motion to approve. Council Member Glover seconded the motion. Motion passes.

13. Consider/DiscuSS/Action approving an Agreement with the Anna CDC and the
City of Anna for employee services -Jessica Perkins. (Jessica Perkins)
Jessica Perkins summarized the agreement and her role and responsibilities in
relation to the CDC. Council Member Driskell made the motion to approve. Council
Member Green seconded the motion. Motion passes.

14. Consider/Discuss/Action approving amendments to Anna EDC Bylaws
regarding check signing, purchases and reimbursement of funds. (Jessica
Perkins)
15. Consider/DiscusS/Action approving an Agreement with the Anna EDC and the
City of Anna for employee services -Jessica Perkins. (Jessica Perkins)
Items 14 and 15 were not visited because the EDC failed to have a quorum at their
posted meeting. Therefor no action was taken on these two items.
16. Consider/DiscuSS/Action on any items listed on posted agenda for February
10, 2009 City of Anna Workshop Session and Closed Session, or any closed
session occurring during this Regular Meeting, as necessary.
Council Member Driskell made the motion to take no action. Council Member Green
seconded the motion. Motion passes.
