Call to Order Mayor Darren R. Driskell called the meeting to order at 6:32 pm. 2. Roll Call and Establishment of Quorum. Mayor Darren R. Driskell and Council Members Mike Crist, Kevin Anderson, Keith Green, Marc Hendricks and Becky Glover were present. Council Member Crist made the motion to enter executive session at 6:34 pm. Council Member Green seconded the motion. Motion passes. AYE 6 NAY 0 ABSTAIN o 3. CLOSED SESSION (EXCEPTIONS): Under Tex. Gov't Code Chapter 551, the City Council may enter into closed session to: a. discuss or deliberate the purchase, exchange, lease, or value of real property (Tex. Gov't Code 1551.072); b. consult with legal counsel on matters in which the duty of the attorney to the govemmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Chapter 551 of the Govemment Code (Tex. Gov't Code §551.071 ); c. Discuss or deliberate Economic Development Negotiations: (1) To discuss or deliberate regarding commercial or financial information that the City Council has received from a business prospect that the City Council seeks to have locate, stay, or expand in or near the territory of the City of Anna and with which the City Council is conducting economic development negotiations; or (2) To deliberate the offer of a financial or other incentive to a business prospect described by subdivision (1). Discussion regarding Slayter Creek wastewater treatment facility and land. None 5. Discussion of City participation in AlSO construction projects. None 6. Welcome to the City Council Meeting. Please sign the Sign-In-Sheet as a record of attendance. If you wish to speak on an open-session agenda item please fill out the Opinion/Speaker Registration Form and tum it in to the City Secretary before the meeting starts. 1. Call to Order. Mayor Darren R. Driskell called the meeting to order at 7:34 pm. 2. Invocation and Pledge of Allegiance. Pastor Shawn Kemp gave the invocation. 3. Citizen comments. Citizens are allowed 3 minutes to speak. The Council is unable to respond to or discuss any Issues that are brought up during this section that are not on the agenda, other than to make statements of specific factual information in response to a citizen's inquiry or to recite existing policy in response to the inqUiry. Gary Crist spoke regarding modifying the fireworks ordinance. 4. Consent Items. These items consist of non-controversial or llhousekeeping" items required by law. Items may be considered individually by any Council member making such request prior to a motion and vote on the Consent Items. a. Approve City Council Regular minutes for May 26, 2009. b. Review of Planning and Zoning Minutes for May 5, 2009. Council Member Crist made the motion to approve the consent items. Council Member Glover seconded the motion. Motion passes. AYE 6 NAY 0 ABSTAIN o 5. Consider/Discuss/Action regarding an ordinance ordering and calling for a Special Election to fill City Council Place 4 vacancy. (Clark McCoy) City Attorney, Clark McCoy reviewed the ordinance and answered council members questions. Council Member Anderson made the motion to approve. Council Member Green seconded the motion. Consider/DiscuSS/Action regarding an ordinance amending the Anna City Code of Ordinances for Temporary Promotional Signs and provide for a fee schedule. (Philip Sanders) Philip Sanders. City Manager reviewed the previous actions of council on this item. Council Member Glover made the motion to approve. Council Member Hendricks seconded the motion. Motion passes. AYE 5 NAY 1 (CM Crist) ABSTAIN o 7. ConsiderlDiscussiAction regarding adopting an ordinance amending the Anna City Code of ordinances by establishing Rental Dwelling Regulations. (Philip Sanders) City Manager. Philip Sanders reviewed previous discussion and answered questions from Council Members. Clarence Richardson who has rental property in Anna spoke against the proposed ordinance. Tommy Cunningham who has rental property in Anna spoke against the proposed ordinance. Diane Donley with Government Affairs Committee for Collin County Association of Realtors spoke against the proposed rental registration ordinance. Sally Terrell the Chair of the Government Affairs Committee for Collin County Association of Realtors spoke against the proposed ordinance. Council Member Crist made the motion to table this item. Council Members discussed and asked questions of the various speakers. Council Member Green seconded the motion. Motion passes. AYE 6 NAY 0 ABSTAIN o 8. Consider/DiscussiAction regarding the review of applications for Boards and Commissions (Philip Sanders) Philip Sanders. City Manager reviewed last years process using the sub advisory committee to review applicants and make recommendations to council. Council Member Glover was opposed to this idea citing that council members would just review and discuss appointments and make recommendations during the meeting. Council Member Crist made the motion to have a Sub Advisory Committee consisting of Himself. Council Member Green and Council Member Hendricks. Council Member Hendricks seconded the motion. Motion passes. AYE 5 NAY 1 (CM Glover) ABSTAIN o Q6-09.09 CC Minutes.doc 4 9. Discussion regarding an ordinance amending the Anna City Code of Ordinances, Part II, Article IV Animals. (Philip Sanders) City Manager, Philip Sanders reviewed previous discussion regarding changes to the keeping of Livestock and Domestic Fowl in the City. This item will be an action item on the next agenda. 10. Consider/DiscuSS/Action regarding an Anna Economic Development Corporation Lease Agreement with Derek Petit. (Philip Sanders) City Manager, Philip Sanders reviewed the Lease Agreement and answered questions from council members. Council Member Crist made the motion to approve. Council Member Green seconded the motion. Motion passes. AYE 6 NAY 0 ABSTAIN o 11. Consider/Discuss/Action regarding a cell phone for Mayor. (Philip Sanders) Council Member Anderson made the motion to table. Council Member Crist seconded the motion. Motion passes. AYE 6 NAY 0 ABSTAIN o 12. Future Agenda Consideration: Consider/Discuss/Action regarding placing the following Items on a future City Council agenda. a. Ordinance authorizing the sale of alcohol for on-premises consumption until 2:00 a.m. (Council Member Anderson) Council Member Anderson explained that he believed having a business open till 2:00 am in Anna lets people have less distance to drive home. Council Member Anderson and Council Member Green and Mayor Driskell were in favor of this being a future agenda item. Council Member Hendricks and Council Member Glover were not in favor. 13. Consider/Discuss/Action on any Items listed on posted agenda for June 9, 2009 City of Anna Workshop Session and occurring during this Regular Meeting, as necessary. Council Member Crist would like to see a discussion on fireworks on a future agenda. Council Member Anderson made the motion to take no action. Council Member Glove seconded the motion.
