The City Council of the City of Anna met in Special Session at 7:30 p.m.! Tuesday, September 15, 2009, at the Anna City Hall Administration Bldg., located at 111 N. Powell (Hwy 5), to consider the following items. 1. Call to Order. Mayor Darren R. Driskell called the meeting to order at 7:32 pm. 2. Roll Call and Establishment of Quorum. Mayor Darren R. Driskell and Council Members Mike Crist, Keith Green, Marc Hendricks and Becky Glover were present. Council Member Kevin Anderson was absent. 3. Public Hearing: For Council to hear public comment on the proposed budget for Fiscal Year 2009-2010. Mayor Driskell opened the public hearing at 7:32 pm. There were no public comments. Mayor Driskell closed the public hearing at 7:32 pm. 4. Consider/Discuss/Action regarding adopting an Ordinance approving the proposed Fiscal year 2009-2010 Budget for the City of Anna, Texas. City Manager, Philip Sanders led the discussion reviewing three different budget options and answering council member's questions. Council Members discussed their preference of the different budgets. Council Member Green made the motion to adopt FY 2010 Budget Option C. Council Member Hendricks seconded the motion. Mayor Driskell stated that FY 2010 Option C would have a Total Tax Rate of $0.622733 with an M & 0 Rate of $0.529939 and an I & S Rate of $0.092794. Motion passes. Consider/Discuss/Action regarding a resolution to ratify the property tax revenue increase reflected in the City of Anna FY 2010 Budget and acknowledging that the FY 2010 ad valorem tax rate will raise more revenue from property taxes than the previous year. City Manager, Philip Sanders stated that this resolution officially puts the public on notice that the FY 2010 ad valorem tax rate will raise more revenue from property taxes than the previous year. City Attorney, Clark McCoy stated that this resolution is a statutory requirement. Council Member Green made the motion to approve. Council Member Crist seconded the motion. Motion passes. AYE 5 NAY 0 ABSTAINED 0 6. Consider/DiscusS/Action regarding adopting an Ordinance setting the ad valorem tax rate per $100 valuation for Fiscal Year 2009-2010 for the City of Anna, Texas. "a motion is made to set a tax rate that exceeds the effective tax rate, it must be made in the following fonn: .f, move that the property taxes be increased by the adoption of a tax rate of[specify rate]. n Council Member Crist made the motion "I move that the property taxes be increased by the adoption of a tax rate of 0.622733." Council Member Glover seconded the motion. Motion passes. AYE 5 NAY 0 ABSTAIN o Council Member Crist made the motion to go into executive session at 7:57 pm. Council Member Glover seconded the motion. Motion passes. AYE 5 NAY 0 ABSTAIN o 7. CLOSED SESSION (EXCEPTIONS): Under Tex. Gov't Code Chapter 551, the City Council may enter into closed session to: a. consult with legal counsel on matters in which the duty of the attorney to the governmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Chapter 551 of the Government Code (Tex. Gov't Code §551.071); The council further reserves the right to enter into executive session at any time throughout any duly noticed meeting under any applicable exception to the Open Meetings Act. Council Member Crist made the motion to return to open session at 8:30 pm. Council Member Glover seconded the motion. Motion passes. AYE 5 NAY 0 ABSTAINED 0 Council Member Crist requested going back to Item 4.
