CITY OF ANNA AGENDA NOTICE -CITY COUNCIL REGULAR MEETING
May 25, 2010 7:30 p.m. -Anna City Hall Administration Building
The City Council of the City of Anna met in Regular Session at 7:30 p.m., May 25,2010,
at the Anna City Hall Administration Building, located at 111 North Powell Parkway (Hwy
5), to consider the following items.
Welcome to the City Council Meeting. Please sign the Sign-In-Sheet as a record of
attendance. If you wish to speak on an open-session agenda item please fill out the
Opinion/Speaker Registration Form and tum it in to the City Secretary before the
meeting starts.
1. Call to Order.
Mayor Pro Tern Keith Green called the meeting to order at 7:30 pm. Mayor Pro
Tern Keith Green and Council Members Mike Crist, John Geren, Marc Hendricks
and Becky Glover was present. Council Member Anderson arrived at 7:33 pm.
Mayor Darren R. Driskell was absent.
2. Invocation and Pledge of Allegiance.
Mayor Pro Tern Green gave the invocation.
3. Citizen comments. Citizens are allowed 3 minutes to speak. The Council is
unable to respond to or discuss any issues that are brought up during this
section that are not on the agenda, other than to make statements of
specific factual information in response to a citizen's inquiry or to recite
existing polley in response to the inquiry.
None
4. Receive reports from Staff or the City Council about items of community
interest Items of community Interest Include: expressions of thanks,
congratulations, or condolence; information regarding holiday schedules; an
honorary or salutary recognition of a public official, public employee, or other
citizen (but not Including a change In status of a person's public office or public
employment); a reminder about an upcoming event organized or sponsored by the
goveming body; information regarding a social, ceremonial, or community event
organized or sponsored by an entity other than the governing body that was
attended or is scheduled to be attended by a member of the governing body or an
official or employee of the municipality; and announcements Involving an
imminent threat to the public health and safety of people In the municipality that
has arisen after the posting of the agenda.
City Manager, Philip Sanders introduced Kelly Clements, new Code Enforcement
Officer for the City.

5. Consent Items. These items consist of non-controversial or
"housekeeping" items required by law. Items may be considered
individually by any Council member making such request prior to a motion
and vote on the Consent Items.
a. Approve City Council Regular minutes for May 11, 2010.
Council Member Crist made the motion to approve the consent items. Council
Member Hendricks seconded the motion. Motion passes.

6. (a) Public Hearing:
For City Council to hear public comment regarding an amendment to the
Anna Code of Ordinances, amending Part III-C Zoning Ordinance, Section
4, Definitions; and Section 32, F-B Food -Beverage Overlay District,
providing for savings, repealing and severability clauses; providing for an
effective date; providing for a penaity clause not to exceed $2000 or the
highest penalty amount allowed by law, whichever is less; and providing
for publication. (Maurice Schwanke)
Mayor Pro Tem Green opened the public hearing at 7:34 pm. Maurice
Schwanke, Director of Planning and Development, presented the item to council
for discussion. No public comments. Mayor Pro Tem Green closed the public
hearing at 7:43 pm.
(b) Consider/DiscuSS/Action on adopting an Ordinance amending the Anna
Code of Ordinances, amending Part III-C Zoning Ordinance, Section 4,
Definitions; and Section 32, F-B Food -Beverage Overlay District,
providing for savings, repealing and severability clauses; providing for an

Council Members discussed the item and had questions for staff. Council
Member Crist made the motion to approve. Council Member Glover seconded
the motion. Motion passes.

7. (a) Public Hearing:
For City Council to hear public comment regarding Assessments for Urban
Crossing Public Improvements District. The improvements are to enhance
security and public safety, and provide paved access via County Road 368
to County Road 370 for the properties within the proposed Public
Improvement District (Clark McCoy)
Mayor Pro Tem Green opened the public hearing at 7:40 pm. City Attomey, Clark
McCoy presented this item to council and answered questions from council
members. No public comments. Mayor Pro Tem Green closed the public hearing
at 7:43 pm.

(b) Consider/Discuss/Action on adopting an Ordinance regarding the
Assessments for Urban Crossing Public Improvement District. (Clark
McCoy)
Council Member Crist made the motion to approve. Council Member Glover
seconded the motion. Motion passes.

8. Consider/DiscuSS/Action approving a Resolution authorizing the City
Manager to execute a Commercial and Industrial Solid Waste Collection
and Disposal Contract with Bradshaw and Son Trash Service. (Philip
Sanders)
City Manager, Philip Sanders presented the item to council for discussion and
answered questions. Council Member Geren made the motion to approve.
Council Member Crist seconded the motion. Motion passes.

Council Member Crist made the motion to enter closed session at 7:52 pm.
Council Member Anderson seconded the motion. Motion passes.
Council Member Anderson made the motion to return to open session at 8:15
pm. Council Member Crist seconded the motion. Motion passes.

9. Consider/Discuss/Action adopting an Ordinance amending the Property
Maintenance Code. (Maurice Schwanke)
City Manager, Philip Sanders presented the item to Council Members. Mr.
Sanders reviewed the changes to the Property Maintenance Code and answered
questions from Council Members. Council Member Crist made the motion to
approve. Council Member Glover seconded the motion. Motion passes.

10. Consider/Discuss/Action approving an Ordinance amending the Anna Code
of Ordinances by amending Part IV, Article 7, Section 1, Garbage Collection
Charges. (Philip Sanders)
City Manager, Philip Sanders presented the item to council for discussion.
Council Member Crist made the motion to approve. Council Member Glover
seconded the motion. Motion passes.

11. Discussion regarding the naming of City of Anna building facilities. (Philip
Sanders)
City Manager, Philip Sanders presented the item to council members for
discussion regarding naming the new police/customer service building. Since the
building has a duel purpose council discussion leaned toward calling the building
Police Department / Municipal Annex.
12. Future Agenda Consideration:
a. Discussion of an Ordinance to suspend the prohibition on the
possession of Fireworks on July 4 and suspend the requirement to
obtain a permit to conduct private displays of Fireworks on July 4.

City Manager, Philip Sanders led the discussion for this item. Police Chief
Jenks voiced his concerns about suspending this ordinance. Acting Fire
Chief Danny Newton also spoke of his concerns on suspending the
ordinance. Council Member Glover stated that because we were not
having a Fourth-of-July Display this year she felt that citizens should be
able to celebrate the Fourth-of-July by shooting their own fireworks. Four
council members stated they would like to see this item on a future City
Council Agenda.
b. Discussion of action necessary to produce a City sponsored July 4th
Fireworks Display. (Council Member Glover)
Council and Staff discussed having the City help fund a Fourth-of-July
Fireworks event and avoid having to suspend the fireworks ordinance.
Five council members stated they would like to see this item on a future
City Council Agenda.
13. CLOSED SESSION (EXCEPTIONS): Under Tex. Gov't Code Chapter
551, the City Council may enter into closed session to discuss any
items listed or referenced on this agenda under the following
exceptions:
a. consult with legal counsel regarding pending or contemplated litigation
and/or on matters in which the duty of the attorney to the governmental
body under the Texas Disciplinary Rules of Professional Conduct of the
State Bar of Texas clearly conflicts with Chapter 551 of the Government
Code (Tex. Gov't Code §551.071).
The council further reserves the right to enter into executive session at any
time throughout any duly noticed meeting under any applicable exception
to the Open Meetings Act
Council entered closed session earlier in the meeting before discussion on item
9. Council did not go into closed session at this time.

14. Consider/DiscuSS/Action on any items listed on posted agenda for May 25,
2010 City of Anna Workshop Session or any closed session occurring
during this Regular Meeting, as necessary.
Council Member Crist made the motion to take no action. Council Member
Anderson seconded the motion. Motion passes.

15. Adjourn.
Council Member Anderson made the motion to adjourn at 9:00 pm. Council
Member Hendricks seconded the motion. Motion passes.
