HomeMy WebLinkAboutOrd 613-2013 Canceling the May 11, 2013 General ElectionCITY OF ANNA, TEXAS ORDINANCE NO. 613-2013 AN ORDINANCE OF THE CITY OF ANNA, TEXAS, DECLARING UNOPPOSED CANDIDATES IN THE MAY 11, 2013 GENERAL CITY ELECTION, ELECTED TO OFFICE; CANCELING THE ELECTION; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the general city election was called for February 12, 2013, for the purpose of electing members to the city council; and WHEREAS. The city secretary has certified in writing that no person has made a declaration of write-in candidacy, and that each candidate on the ballot is unopposed for election to office; and WHEREAS, under these circumstances, Subchapter C, Chapter 2, Election Code, authorizes the city council to declare the candidates elected to office and cancel the election; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS: Section 1. The following candidates, who are unopposed in the May 11, 2013 general city election, are declared elected to office, and shall be issued certificates of election following the time the election would have been canvassed: Lauren Lovato City Council, Place 2 Chad Barnes City Council, Place 4 Becky Glover City Council, Place 6 Section 2. The May 11, 2013 general city election is canceled, and the city secretary is directed to cause a copy of the ordinance to be posted on Election Day at each polling place used or that would have been used in the election. Section 3. If any section, subsection, sentence, clause, or phrase of this ordinance, or its application to a particular set of persons or circumstances, is declared invalid or adjudged unconstitutional by a court of competent jurisdiction, it does not affect the Ord. 613-2013 Canceling May 11, 2013 General Election 1 03-12-13 remaining portions of this ordinance, as the various portions and provisions of this ordinance are severable. The City Council of the City of Anna, Texas, declares that it would have passed each and every part of this ordinance notwithstanding the omission of any part that is declared invalid or unconstitutional. Section 4. This ordinance shall take effect upon its final passage, and it is so ordained. PASSED, APPROVED, AND ADOPTED on first and final reading on March 12, 2013.
