AN ORDINANCE OF THE CITY OF ANNA, TEXAS, AMENDING THE ANNA CITY CODE OF ORDINANCES BY AMENDING PART III — C (ZONING ORDINANCE), SECTION 40.03 (o)(7) BY CLARIFYING A GRAPHIC EXHIBIT, CHANGING REQUIRED POST SIZE AND ALLOWING THIN-WALL SCREEN FENCES IN CERTAIN APPLICATIONS; AND PROVIDING FOR A PENALTY FOR ANY VIOLATION OF THIS ORDINANCE NOT TO EXCEED $2,000; PROVIDING FOR SAVINGS, SEVERABILITY, AND REPEALING CLAUSES; PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING FOR THE PUBLICATION OF THE CAPTION HEREOF. WHEREAS, the City of Anna, Texas ("the City") has previously adopted ordinances, rules and regulations governing the construction of buildings and maintenance; and WHEREAS, the City Council of the City of Anna seeks to protect and provide for the public health, safety, and welfare, including but not limited to the aesthetic development of property within its corporate limits; and WHEREAS, the City Council finds it to be in the best interest of the public to create and maintain a positive community image and identity by allowing certain thin-wall fence applications that enhance the visual appearance and character of the residential neighborhoods of the City; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS, THAT: Section 1. Recitals Incorporated. The above -referenced recitals are incorporated herein as if set forth in full for all purposes. Section 2. Amendments. 2.01 In accordance with Part II, Article 1, Section 9 of the Anna City Code of Ordinances, this ordinance amends Part III - C (Zoning Ordinance) of the Anna City Code of Ordinances by amending Section 40.03 (Screening Elements and Fences) as follows: 40.03 Screening Elements and Fences (o) Residential Districts General (7) Residential fencing requirements: Minimum fence height of 6' from average Lot Grade with a maximum height of 8'. C FRONT SETBACK STREET R.O.W. z5' 50' ...... — �- PROPERTY -- 60 — LINE 120' FRONT SETBACK arnrrr n n �n� RETAINING WALL AVERAGE LOT GRADE Materials Treated lumber attached with galvanized screws to 3-112"2 3/8" diameter galvanized poles installed in 8" diameter holes no less than 2-1/2 feet deep in 2' of premixed concrete. All posts shall have caps. Brick, stone, masonry, vinyl materials or a combination with columns every 8'. Vinyl materials cannot be used in Multifamily areas. No thin-wall masonry walls are allowed unless constructed with brick. stone or other approved masonry units and supported by anale iron with masonry columns on piers. All thin -walls plans shall be sealed by a professional enaineer and approved by the City. "Thin wall" is defined as any wall 6" or less in width. Section 3. Penalty. Any violation of any of the terms of this ordinance, whether denominated in this ordinance as unlawful or not, shall be deemed a misdemeanor. Any person convicted of any such violation shall be fined in an amount not to exceed $2,000 for each incidence of violation. Each violation is considered a separate offense and will be punished separately. Section 4. Savings, Severability and Repealing Clauses. All ordinances of the City in conflict with the provisions of this ordinance are repealed to the extent of that conflict. If any provision of this ordinance shall be held to be invalid or unconstitutional, the remainder of such ordinance shall continue in full force and effect the same as if such invalid or unconstitutional provision had never been a part hereof. The City declares Ord. 628-2013 Amend Screening Part III -C of zoning ord. 07-30-13 that it would have passed this ordinance, and each section, subsection, clause, or phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, and phrases be declared unconstitutional or invalid. Section 5. Publication of the Caption Hereof and Effective Date. This ordinance shall be in full force and effective from and after its passage and upon the posting and/or publication, if required by law, of its caption and the City Secretary is hereby directed to implement such posting and/or publication.
