This annexation involves a 737.3 acre tract located along south side of Anna planning
considered at the request of the property owner.
Andante Development, LLP, has a contract on the property and is representing the
property owner.
The property owner desires that the annexation and zoning be considered as a package
(i. e., that annexation not be completed in the absence of agreement on zoning of the
property).

AN ORDINANCE ANNEXING THE HEREINAFTER DESCRIBED TERRITORY TO
THE CITY OF ANNA, COLLIN COUNTY, TEXAS, AND EXTENDING THE
BOUNDARY LIMITS OF SAID CITY SO AS TO INCLUDE SAID HEREINAFTER
DESCRIBED PROPERTY WITHIN THE CITY LIMITS AND ADOPTING A SERVICE
PLAN FOR SAID TERRITORY AND ITS INHABITANTS
WHEREAS, certain property owners have petitioned the City of Anna to have their
property, described in Exhibit A, annexed to the City of Anna; and
WHEREAS, said properties are adjacent to and adjoin the present boundaries of the
City of Anna; and
WHEREAS, a service plan providing for the extension of municipal services into the
proposed annexed area and attached to this ordinance as Exhibit B and hereby made
part of this ordinance was prepared prior to publication of notice of hearings and
reviewed at said hearings; and
WHEREAS, after hearing the arguments for and against the annexation, the City
Council has voted to annex said territory to the City of Anna, Texas; now therefore
Section I. The land and territory described in Exhibit A, attached hereto and hereby
made an integral part of this Ordinance, lying adjacent to and adjoining the present
boundaries of the City of Anna, Texas, is hereby added and annexed to the City of
Anna, Texas, and said territory hereinafter described shall hereafter be included within
the boundary limits of the City of Anna, Texas, and the present boundary limits of such
city are altered and amended so as to include said area within the corporate limits of the
City of Anna, Texas.
Section 2. The above described territory and the area so annexed shall be a part of the
City of Anna, Texas, and the inhabitants thereof, if any, shall be entitled to all of the
rights and privileges of all citizens and shall be bounded by the acts, ordinances,
resolutions, and regulations of the City of Anna, Texas.
Section 3. The service plan providing for the extension of municipal services into the
annexed area and attached to this ordinance as Exhibit B is hereby adopted.
The City Secretary is hereby directed to file with the County Clerk of Collin County,
Texas, a certified copy of this ordinance.

CODE ENFORCEMENT
Code Enforcement includes activities of inspecting properties and buildings and securing compliance with
adopted ordinances and codes relative to the following:
(1) Tall grass and weeds (except for agricultural and ranch properties)
(2) Trash and debris
(3) Stagnant water and unsanitary conditions
(4) Junked vehicles and parts
(5) Junked appliances and materials
(6) Enforcement of the Minimum Housing Code pertaining to maintenance and habitability of
existing housing
City code enforcement activities will be conducted in newly annexed territories under the same terms and
on the same schedule and using the same procedures as for other areas inside the corporate limits.
Code enforcement services will be implemented immediately upon the effective date of the annexation of
the property.
SOLID WASTE, BRUSH, AND REFUSE COLLECTION SERVICES
Refuse Service
Citizens in newly annexed areas will receive solid waste (trash), brush, and refuse service in accordance
with existing city ordinances. Generally, the ordinances provide single family residential pick-up service
of plastic bags and metal cans of not larger than 20 gallons in size at curbside or streetside twice per
week for a fee that is established by the city council. Service to multifamily and non-residential customers
is provided by the City through a contractor and service schedule and facilities depends on the needs of
the customer. Most large objects can be picked up on an as -needed basis. The solid waste customer
must arrange for large object pick-up by calling the City of Anna (972-924-3325). Present solid waste
collection service routes will be extended to cover annexed areas.

The City currently contracts with private firms that provide solid waste collection services. The individual
customer will be provided information regarding solid waste collections services when the customer
makes his/her water and/or sanitary sewer service deposit.
These services will be implemented within sixty (60) days of the effective date of the ordinance of which
this service plan is a part. Residents of the newly annexed area that have existing contracts with solid
waste service providers have one year from the date of annexation or until termination date of the existing
contract, whichever is sooner, to begin solid waste collection service through the City. Solid waste
collection is mandatory for City of Anna residents and businesses operating within the city limits.
PLANNING, ZONING AND MAPPING
The function of planning, zoning, and mapping is to implement ordinances relating to zoning
classifications within the City and to provide mapping resources.
Zoning functions include the following:
(1) Provide proper zoning classification of properties within the City. Zoning is a tool to
designate the uses of property, such as residential, business, agricultural, industry, etc.
Proper zoning ensures the best use for the property and, at the same time, protects
adjacent properties from mixed uses that reduce property value and lower the quality of
life for adjacent property owners and residents. It also regulates parking, building
heights, lot coverage, noise pollution, setbacks, and regulations relating to the use of
property.
(2) Enforce zoning ordinances relating to uses permitted, parking, lot coverage, minimum
building area, storage, heights, and other items.
(3) Implement and enforce subdivision and plat requirements.
(4) Provide assistance to citizens building on their property and handle complaints relating to
land use and zoning.
Mapping and drafting functions include the following:
(1) Provide mapping resources of new territories, zoning, streets, water and sewer lines,
easements, right-of-ways, subdivisions, lots, and other related matters.
(2) Assist citizens in matters related to their properties and maps containing requested
information.
These services will be provided to residents and property owners in newly annexed territories on the
some basis as they are provided to residents and property owners in the existing incorporated area.

Planning, zoning, and mapping services will be implemented immediately upon the effective date of this
ordinance.
FIRE PROTECTION SERVICES
The City is served by the Anna Volunteer Fire Department, a private non-profit corporation. Fire
protection services provided by the Anna Volunteer Fire Department to the City include response to fire
calls and inspection of commercial and industrial structures for code violations. All fire protection services
provided by the Anna Volunteer Fire Department within the existing corporate limits will be provided within
the newly annexed area upon the effective date of the annexation. Volunteers are available for
consultation on fire prevention on request by citizens and/or property owners of the community.
Fire protection services will be implemented immediately upon the effective date of the annexation of the
property.
STREET MAINTENANCE
The street maintenance function is primarily supported from ad valorem (property) and sales taxes.
Maintenance activities are determined by the level of funding and the need for maintenance as
determined by the city council. Once the annexation of property included in this ordinance has been
completed, all streets, roads, and bridges included in the annexed area will be added to the City's street
maintenance program. Roadways in the newly annexed area will receive equal consideration with regard
to maintenance as those within the existing corporate limits.
Street maintenance services will be implemented immediately upon the effective date of this ordinance or
after the acceptance by the City of the streets in a new subdivision, whichever is appropriate.
WASTEWATER SERVICES
Citizens in newly annexed areas will be offered sanitary sewer service in accordance with existing City
ordinances. Generally these ordinances state that the customer must bear the cost of construction of
sewer system facilities to a point where service to the customer can be provided. All sanitary sewer
facilities must be constructed in accordance with Texas Commission on Environmental Quality, Texas
Department of Insurance, and City of Anna regulations and specifications.

It is anticipated that sanitary sewer service will be provided to this property through construction by the
property owner of off-site and on-site facilities.
The policy for private service lines will remain the same as exists in the current city limits. That is, the
City will maintain main transmission lines only. Only one connection per structure is permitted without
specific written approval from an authorized official of the City.
Sanitary sewer service rates will be assessed at the same rate as established for other city customers in
the same use classification.
WATER SERVICES
Residents and property owners in newly annexed areas will be offered water service in accordance with
existing City ordinances. Generally, these ordinances state that the customer must bear the cost of
construction of water system facilities to a point where suitable connection to the existing system can be
made and service to the customer can be provided. Water service facilities designed to connect an
unserved area to the City's existing system must be approved by the City Council and meet all City
zoning, subdivision, and other relevant requirements. All water mains must be constructed in accordance
with Texas Commission on Environmental Quality, Texas Department of Insurance, and City of Anna
regulations and specifications.
The property annexed through this ordinance is located within an area jointly certificated for water service
to the North Collin Water Supply Corporation (NCWSC) and the City of Anna. NCWSC and Anna have
an agreement under which the City of Anna can provide water service to all areas divided into tracts/lots
of one acre or less is size. The City of Anna will desire to provide service to the annexed tract. NCWSC
is to be paid a specified amount per acre for the area to be served by Anna. The property owner(s) in the
annexed area are expected to pay the required CCN purchase price at the time that Anna water service is
requested to serve the area.
The policy for private service lines will remain the same as exists in the current City limits. That is, the
City will maintain water lines from the water main to the water meter. All repairs/maintenance from the
meter to the point of usage is the property owner's responsibility.
Water service rates will be assessed at the same rate as established for other city customers in the same
use classification.

The PZC also recommended that screening devices adjacent to commercial uses be of
masonry construction with masonry columns. Also, along thoroughfares, no walls shall
exceed a length of 500 feet before a change in character such as the addition of wrought
iron with living screen.
PZC also recommended that mountable curbs not be permitted (Section 13.b.i)
Finally, the PZC recommended revisions in the Thoroughfare Plan included in the project
concept plan. A copy of the revised Thoroughfare Plan is attached. We will discuss this
issue in more detail at your meeting.
Copies of the property owner's requested zoning and a summary of the PZC
recommended changes are included in the attached materials.

AN ORDINANCE OF THE CITY OF ANNA, TEXAS, AMENDING THE ZONING
MAP OF THE CITY OF ANNA TO PROVIDE FOR REZONING OF CERTAIN
PROPERTY; PROVIDING A REPEALER CLAUSE; AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, the Owner of the property described in Exhibit "A" attached hereto has requested a
certain zoning for said property; and
WHEREAS, the City Council of the City of Anna has given the requisite notices and afforded a
full and fair hearing to all property owners generally and to all persons interested in and situated
in the affected area and in the vicinity thereof, the City Council of the City of Anna has
concluded that the Zoning Ordinance of the City of Anna should be amended as follows:
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA,
TEXAS:
Section 1: The Comprehensive Zoning Ordinance of the City of Anna, Texas, as
enacted on September 20, 2003 is hereby amended by enacting this Planned
Development for the property as described in Exhibit "A" and graphically shown on
Exhibit "D" — Concept Plan, attached hereto and made an integral part of this
Ordinance, as Planned Development (PD). The Planned Development shall include
the following elements:

a. The permitted uses in the Planned Development will be the same as those
permitted in the "SF -60 — Single Family Residence District", "C-2 General
Commercial District', "MF -2 Multiple Family Residential — High Density", and "SF-
TH Townhome District' Regulations as outlined in the City of Anna Zoning
Ordinance, except as herein provided.
3. Height and Coverage Regulations:
a. The height and coverage regulations in the Planned Development will be the
same as those permitted in the "SF -60 — Single Family Residence District:, "C-2

and "SF-TH Townhome District' Regulations as outlined in the City of Anna

i. Multiple Family Residential Element:
The Multiple Family Residential Element of the PD includes approximately ±15
acres, as graphically identified on Exhibit "B" and Exhibit "D". All provisions of
the Anna Zoning Ordinance as related to the MF -2 Multiple Family Residential —
High Density zoning district shall conform to the Multiple Family Residential
Element of this Planned Development. Multiple Family Residential density shall
be capped at 18 units per acre.
J. Townhome Element:
The Townhome Element of the PD includes approximately ±15 acres as
graphically identified on Exhibit "B" and Exhibit "D". Except as follows, all
provisions of the Anna Zoning Ordinance, as related to the SF-TH Townhome

6. Permitted Accessory Uses:
a. The permitted accessory uses in the Planned Development will be the same as
those permitted in the "SF -60 — Single Family Residence District", "C-2 General
Commercial District", "MF -2 Multiple Family Residential — High Density", and "SF-
TH Townhome District" Regulations as outlined in the City of Anna Zoning
Ordinance.
7. Accesses and Entrances:
a. The development shall provide connection points to planned street stubs for any
adjacent property if such property has an existing preliminary plat or final plat
approved by the City of Anna prior to the approval by the City of Anna of the
Planned Development Zoning. There shall be no other required connections to
adjacent properties, nor shall the number of lots or the density of the
development be limited based on the number of connections to existing roads or
adjacent properties.
8. Crosswalk Easements:,
a. Crosswalk Easements as defined in Section 8.6.3 of the City of Anna Subdivision
Ordinance shall, not be required for the development.
J. Garages:
a. Garages may be front or rear facing and there is no requirement for "swing"
driveways. -
10; Sidewalks:
a. Sidewalks 4 feet in width minimum will be installed one foot (1') outside the right-
of-way along street frontage of all residential lots prior to the issuance of a final
certificate of occupancy for each house constructed thereon.
b. A sidewalk 5 feet in width minimum will also be installed one foot (1') outside the
right-of-way along the Major Collector street prior to the acceptance of the
infrastructure improvements. The Developer shall not be required to but has the
option of increasing the width any sidewalks.
11. Screening:
a. Berming or fences shall be utilized as screening adjacent to Major Collector
streets.
b. Screening fences shall be masonry thin wall along the Major Collector streets.
c. Screening .fences will be located between the commercial uses and the
residential, multiple family and townhome uses and shall be installed by the
commercial user. '

d. Screening fences adjacent to the commercial uses shall be constructed of board -
on -board wood with masonry columns located on 50 foot centers installed by the
commercial user. The wood will be treated with a preservative to extend the life
of and enhance the appearance of the fence. The maintenance of such
screening fences shall be funded through the creation of a Political Subdivision
such as a Public Improvement District (PID) where funds would go to the City for
maintenance. If a PID or a similar funding mechanism is not created,
maintenance shall be the responsibility of a Home Owners Association (HOA).
12. Private Landscape Improvements (HOA Landscaping):
a. The Developer shall construct private landscape improvements for the project.
The improvements shall be located within open common space areas and
landscape easements maintained through the creation of a Political Subdivision
such as a Public Improvement District (PID) where funds would go to the City for
maintenance. If a PID or a similar funding mechanism is not created,
maintenance shall be the responsibility of a Home Owners Association (HOA).
13. Right -of -Way and Street Widths:
b. Typical pavement sections are shown in Exhibit "C" attached hereto.
i. Local residential streets shall be 31 feet of concrete pavement from the
back of curb to back of curb with a four inch (4") crown, contained within
50 feet of right-of-way, with mountable curbs.
ii. Neighborhood streets shall be 37 feet of concrete pavement from back of
curb to back of curb with a four inch (4") crown, contained within 60 feet
of right-of-way.
iii. Minor collector streets shall be 49 feet of concrete pavement from the
back of curb to back of curb with a five inch (5") crown, contained within
80 feet of right-of-way.
iv. Major collector streets shall be 120 feet of the right-of-way with two (2) -
25.0 foot back of curb to back of curb concrete roadways.
v. Alleys in the development shall be 15 feet of concrete pavement from
edge to edge with a six inch (6") invert, contained within 20 feet of right-
of-way.
14. Section 2: The official Zoning Map of the City of Anna shall be amended to reflect the
change in zoning described herein.
1.5. Section 3: All ordinances of the City of Anna in conflict with the provisions of this
ordinance are repealed to the extent of that conflict.
16. Section 4: This ordinance shall take effect immediately from and after its passage as the
law in such case provides.

Park Board
Special Meeting, February 13, 2006
The Park Board of the City of Anna held a special meeting at 7:00 pm, Monday, February 13
2006, at the Anna City Hall, 101 N. Powell Parkway, and considered the following items.
Call to Order.
The meeting was called to order by Chairman Jon Hendricks at 7:42 p.m.
2. Roll Call.
Members present included Mr. Hendricks, Ms. Elizabeth James, Ms. Angie Toles, and Ms.
Molly Young.
3. Update and take action as desired regarding Geer Field Park.
Ms. James moved that the board recommend that the City Council reconsider the name
given to the 25 acre park site located at the northeast corner of the intersection of Smith
Street and E. Sixth Street and that the park be named Geer Park in honor of Mr. Anthony
L. Geer and Ms. Elnora Geer. The motion was seconded by Ms. Young and was passed
unanimously.
4. Update and take action as desired regarding City Park (TPWD) project.
There was no action taken on this item.
Board member Bill Hemenway arrived and participated in further deliberations of the
board.
5. Consider/Discuss/Action on recommendation regarding potential park area in CR 367/W.
White Street area.
Ms. Young moved that the Park Board recommend that the Jim Mann 20 acre tract on W.
White Street be purchased for use as a passive use park and open space area,
conditional on agreement with the property owner regarding acceptable access to the
park area from W. White Street. Ms. Toles seconded the motion, which passed
unanimously.

Sandra Bryant from AM Bryant Properties, Anna, Texas was recognized to speak on
behalf of Mr. Dugan Curtis (Builder) regarding a proposal for zoning change on property
located at N. Sherley (FM 2662). Ms. Bryant informed property is 1.33 acres and is
currently zoned residential and the proposal for zoning would be "Multifamily" to build
a 32 unit apartment complex with one and two bedrooms and bath. Ms. Bryant stated
that Anna needs affordable housing for young, elderly and singles.
Ms. Bryant provided hand-outs with the proposed layout.

approval of the annexation of the 37.005 acre tract in the G. Stark Survey, located on
the south and west sides of CR 422, owner Anna Independent School.

Pauline Durica, 3350 LaPaloma, Anna, Texas expressed concerns with screening,
birms, and the planting of trees. Ms. Durica questioned if the screening could be done
before beginning of construction. Ms. Durica expressed concerns about the privacy of
neighbors.
Mr. Lee Lawrence, City Manager, noted that property is built out in phases and the
provisions of the screening are constructed at phases of development.
Don Hixon, 8152 CR 365, Melissa, Texas express concerns of the outer loop.

The Planning and Zoning Commission of the City of Anna held a meeting on Tuesday, February
21, 2006, at 8:00 p.m., at the Community Room of the Texas Star Bank, located at 402 W.
White Street (FM 455), Anna, Texas, to consider the following items.
1. Call to order and establishment of quorum.
Chairman John Rattan called the meeting to order at 8:19 p.m. Members present were
Jon Hendricks, Keith Green, Joseph Boda, Molly Young, William Ballantyne and Nancy
Pennington.
2. Consider/Discuss/Act on recommendation regarding request by JNC Partners for
Planned Development District zoning, including single family residential, town
homes, multifamily residential, and commercial uses, for a 737.3 acre tract in the
Granderson Stark Survey and the D.E.W. Babb Survey.
Jim Wiegert of Carter and Burgess and Steve Topletz (Developer) representing JNC
Partners gave presentation regarding the request for a Planned Development District
zoning consisting of 737.3 acres located east of Powell Pkwy (Hwy 5) and roughly
bounded by CR 417, CR 419, the mutual boundary between Anna and Melissa and CR
421.
After extended discussion, motion made by Molly Young, seconded by William
Ballantyne to recommend to Council approval with the recommended changes to the
Planned Development zoning request for JNC Partners.
The recommendations are as follow:
1.) Section 4 — That the SF -A category be deleted with the acreage being equally
divided between the SF -B, SF -C and SF -D categories.
2.) The SF -B category was recommended to have the minimum lot width changed
from 55 ft. to 60 and the front yard changed from 20 to 25 ft.

3.) The SF -C category was recommended to have the front yard changed from 20 to
25 feet.
4.) Section 4 g was recommended to be changed to the Thoroughfare alignments

5.) That Section 4 h —"Schedule of Uses" have the following uses deleted from the
requested C2 category as follow:

The Planning and Zoning Commission of the City of Anna held a workshop on Tuesday,
February 21, 2006, at 7:00 p. m., at the Community Room of the Texas Star Bank, located at
402 W. White Street (FM 455), Anna, Texas, to consider the following items. This meeting was
conducted jointly by the Planning and Zoning Commissions of the cities of Anna and Van
Alstyne.
1. Call to order
Chairman John Rattan called the meeting to order at 7:00 p.m. Members present included
Jon Hendricks, Joseph Soda, Keith Green, Molly Young, William Ballantyne and Nancy
Pennington.
Members present from Van Alstyne Planning and Zoning included Chairman Jim Atchison,
members Wilson Taylor and Jerry Moody.
2. Presentation regarding the Mantua project (project manager ®on Paschal, et al.).
®on Paschal, Project Manager, 904 Parkwood Court, McKinney, Texas and Bill Benton, 604
W. Stephens, Van Alstyne, Texas presented a power point presentation regarding the
Mantua project.
Mr. Paschal presented to the Planning and Zoning Committees of Anna and Van Alstyne,
meeting in joint session, an overview of the Mantua submission for zoning and annexation.
Mr. Paschal informed members that the document will be filed with the respective cities soon
and it is their desire to have an identical ordinance passed by both cities.
Mr. Paschal noted that the purpose of the meeting was to inform the committee members
how the document was constructed and its contents. The committees were given a
suggested timeline for review and an approval schematic of how the project would be
submitted and approved.
The presentation also showed the committee several examples of various home products
that require flexibility in zoning to allow for a full range of dwelling products to be
constructed. The project covers more than 2600 acres and will be built out over the next 20

to 30 years and this flexibility will allow Mantua to respond to the changing market and home
designs.
The Mantua project will be a strategic part of communities and quality, sustainable
neighborhoods will set a desirable standard for both communities.
Mr. Paschal recommended that the members take a bus tour of the locations showed in the
power point presentation.
Members of the Planning and Zoning Committee from both cities and others in attendance
asked questions during the presentation.
