The subject property, Willow Creek Addition, Phase 1A, has been annexed into the City. The subject property has been zoned for retail and light commercial uses (Ord. No. 47-2003, adopted January 14, 2003). The subject property has been platted by action of council of January 28, 2003. On July 6, 2006, the Planning and Zoning Commission recommended approval of the site plan for the development of the property, subject to satisfaction of the comments submitted by Maurice Schwanke & Company (Maurice Schwanke) per letters dated June 28, 2006, and July 6, 2006. The project developer has made the changes as noted in the Morris Engineers and Maurice Schwanke & Company comment letters. We recommend that the site plan for Willow Creek Plaza be approved. The subject property has been zoned for retail and commercial uses (C-2 per Ord. No. 2000-13A, adopted August 8, 2000). On July 6, 2006, the Planning and Zoning Commission recommended approval of the preliminary plat of the property, subject to satisfaction of the comments submitted by Morris Engineers (Tim Morris) per letter dated June 23, 2006, and Maurice Schwanke & Company (Maurice Schwanke) per letter dated July 6, 2006. The plans have been revised per Morris Engineers' comments dated June 24, 2006. Our response to the comments is the following: Preliminary Plat 1. There are two different owners for Lots 1 and 2. Savoy Anna 16, L.P., owns the entire tract and will retain Lot 2 for their future development. Mark R. Smith Company, Inc. will purchase Lot 1, which is being presented for development at this time; therefore, no improvements will be made at this time for Lot 2. 2. The easement indicated has been shown as requested. 3. The adjoining property owner to the west of Lot 2 has been provided as requested. 4. First, Section 8.2.2.c applies to streets within a subdivision and the proposed development does not contain any public streets within it. Second, if the 30' access easement is considered public right-of-way, which it is, then the 30' wide access & utility easements do provide street access to Lot 2 according to Section 8.2.2.c. Third, there are two points of street access for Lot 2 being provided. Lastly, TxDoT will not allow an additional drive opening along the U.S. 75 Frontage. It is our intent to appeal this provision to the City Council. 5, The 40'x20' notch and 5' wide strip is intended to meet the street frontage requirement, as well as access to sign placement for Lot 2. Following are my comments: Preliminary Plat -• Lot 1 is a 6.7455 acre tract and is the site of the proposed Anna Corners Retail Center. Lot 2 � is a 9.7703 acre tract and no improvements are shown on the plat for Lot 2f:1 • Access to Lot 2 is by a 30 feet wide Access and Utility Easement across Lot 1 and by a 30 feet wide Access Easement across the AFFI parking lot. The 30 feet wide lane does not give Lot 2 street access according to Item 8.2.7. or the minimum of 40 feet of street frontage required by Item 8.5.10.1. • The name of the adjoining property owner to the west of Lot 2 should be shown on the plat. (Item 8.2.2.c.) • The plat shows an 8" diameter waterline will be constructed along the north side of the subdivision connecting the existing 12" diameter waterline on the east boundary of the project with the existing 8" diameter waterline on the west side of CR 286. • The existing 12" diameter waterline on the east boundary: of the project should be extended to the south line of the property. The subject property is located in the north part of the Anna planning area, along both sides of N. Central Expressway (US 75). The property is located within the Hurricane Creek drainage basin. The property is part of a larger tract, with approximately 40 percent of the entire tract located in Anna and the remainder located in the Van Alstyne extraterritorial jurisdiction. All or virtually all of this tract was annexed in 1971 and the annexation was filed with Collin County. However, the tax assessor(s) and tax collector(s) for the City of Anna have not collected ad valorem taxes on the property. (There have apparently been several different assessors and collectors over the years.) The City staff and the property owner are in agreement that another annexation of the property, with an appropriate metes and bounds description, would be in the best interest of both parties. The ordinance will include a "save and except" clause relative to any property that had been previously properly annexed.
