AGENDA City Council Meeting Tuesday, June 20, 2023 at 5:30 PM Anna Municipal Complex - Council Chambers 120 W. 7th Street, Anna, Texas 75409 The City Council of the City of Anna will meet on June 20, 2023 at 5:30 PM in the Anna Municipal Complex-Council Chambers, located at 120 W. 7th Street, to consider the following items. Welcome to the City Council meeting. If you wish to speak on an Open Session agenda item, please fill out the Opinion/Speaker Registration Form and turn it in to the City Secretary before the meeting starts. 1. Call to Order, Roll Call, and Establishment of Quorum. 2. Invocation and Pledge of Allegiance. 3. Neighbor Comments. At this time, any person may address the City Council regarding an item on this meeting Agenda that is not scheduled for public hearing. Also, at this time, any person may address the City Council regarding an item that is not on this meeting Agenda. Each person will be allowed up to three (3) minutes to speak. No discussion or action may be taken at this meeting on items not listed on this Agenda, other than to make statements of specific information in response to a citizen’s inquiry or to recite existing policy in response to the inquiry. 4. City Council Agenda Staff Report Meeting Date: 6/20/2023 Staff Contact: Carrie Land AGENDA ITEM: Consider/Discuss/Action on a Ordinance Canvassing the June 10, 2023 Runoff Election. (City Secretary Carrie Land) SUMMARY: Section 67.004 provides that the presiding officer of the canvassing authority shall note the completion of the canvass in the minutes or in the recording required by Section 551.021 of the Government Code: City Council, Place 3 Stan Carver II received votes, being of total votes. Kelly Herndon received votes, being of total votes. FINANCIAL IMPACT: This item has no financial impact. BACKGROUND: Canvass is a mandatory, ministerial duty. Each local canvassing authority shall convene to conduct the local canvass at the time set by the canvassing authority’s presiding officer not later than the 11th day after the election. June 10, 2023 Joint Runoff Combined Election Day and Early Ballots-- Accumulated Totals Unofficial Final 1 CITY OF ANNA, TEXAS ORDINANCE NO. _____________ (June 10, 2023 Runoff Election Canvass) AN ORDINANCE OF THE CITY OF ANNA, TEXAS CANVASSING THE RETURNS OF A GENERAL RUNOFF ELECTION OF ONE CITY COUNCIL MEMBER, FOR A THREE-YEAR TERM EXPIRING MAY 2026. WHEREAS, a general runoff election was held in the City of Anna, Texas (the “City”) on June 10, 2023 for the purpose of electing one city council member, for a three-year term; and WHEREAS, the City Council of the City of Anna (the “Council”) has reviewed and investigated all matters pertaining to this election and returns thereof; and WHEREAS, the Council hereby canvasses the returns of this election, at which there was submitted to all resident, qualified electors of the City for their action thereupon, the election of one city council member, for a three-year term; and WHEREAS, the Council has diligently inquired into the poll lists and the official election returns which were duly and lawfully made to this Council by the judges, officials and clerks holding and conducting the election, the poll lists and the official elections returns showing separately the votes cast in the election; and WHEREAS, from the returns, this Council hereby finds that the following votes were cast in the election by voters who were resident, qualified electors of the City; and WHEREAS, each of the candidates in said election received the following votes: Candidate/or Proposition Number of Votes City Council, Place 3 (Concilio de Ciudad, Lugar 3) Stan Carver II 277 53.58% Kelly Herndon 240 46.42% THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS: SECTION 1. The Council officially finds, determines, and declares that the election was duly and properly ordered, that proper legal notice of such election was duly given in the English language and the Spanish language, that proper election officers were duly appointed prior to the election, that the election was duly and legally held, that all resident, qualified electors of the City were permitted to vote at the election, and due returns of the results of the election had been made and delivered, and that the City of Anna has duly canvassed such returns, all in accordance with the laws of the State of Texas and of the United States of America and the Ordinance calling the election. SECTION 2. Subject to being duly qualified and taking the oath of office as provided by the laws of the State of Texas and the City of Anna Home-Rule Charter, the following person is elected as Council Member, Place 3 of the City for a term of three (3) years: Stan Carver II. 2 ADOPTED AND APPROVED on this 20th day of June, 2023.
