AN ORDINANCE OF THE CITY OF ANNA, TEXAS, AMENDING THE ANNA CITY
CODE OF ORDINANCES BY AMENDING PART 111-A (SUBDIVISION
REGULATIONS), ARTICLE 3 (SUBDIVISION DESIGN STANDARDS), SECTION 1.03
(d)(4) (ADEQUACY OF STREETS AND THOROUGHFARES) AND SECTION 7.02
(MINIMUM FRONTAGE ON A PUBLIC STREET; PROVIDING FOR SAVINGS,
SEVERABILITY, AND REPEALING CLAUSES; PROVIDING FOR AN EFFECTIVE
DATE; AND PROVIDING FOR THE PUBLICATION OF THE CAPTION HEREOF.
WHEREAS, the City of Anna, Texas City Council ("City Council") has previously adopted
standards, requirements, and procedures for and otherwise governing the subdivision of
land that are codified in Part Ill-A of The Anna City Code of Ordinances (Subdivision
Regulations); and
WHEREAS, the City Council has investigated and determined that it would be beneficial
and advantageous to provide revised standards for where minimum lot frontages are
measured;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ANNA, TEXAS, THAT:
Section 1. Recitals Incorporated.
The above-referenced recitals are incorporated herein as if set forth in full for all
purposes.
Section 2. Amendment.
In accordance with Part II, Article 1, Section 9 of the Anna City Code of Ordinances; Part
Ill-A, Article 3, Section 1.03 (d)(4) and Section 7.02 of the Anna City Code of Ordinances
is hereby amended as follows:
1.03 Adequacy of Streets and Thoroughfares
(d)
(4) Adequate Emergency Access. The Subdivision shall be designed to
provide adequate emergency access for public safety vehicles. Each
residential Lot in the Subdivision shall have a minimum frontage (measured
at the edge of the pavement property line) of at least 40 feet' on a dedicated
public Street or approved private access, unless other provisions have been
authorized through a Planned Development district. Each non-residential
Lot shall have a minimum frontage on a dedicated public Street or approved
private access of at least 50 feet, unless other provisions have been
authorized through a Planned Development district.

7.02 Minimum Frontage on a Public Street
Each Lot on a Subdivision Plat shall front onto a dedicated, improved public Street,
or approved commercial private access unless Platted as an approved Private
Street Subdivision in accordance with these Subdivision Regulations. All Lots shall
have a minimum of 40 feet of frontage along the pavement edge property line of a
dedicated, improved Street or access.
Section 4. Savings, Severability and Repealing Clauses.
All ordinances of the City in conflict with the provisions of this ordinance are repealed to
the extent of that conflict. If any provision of this ordinance shall be held to be invalid or
unconstitutional, the remainder of such ordinance shall continue in full force and effect
the same as if such invalid or unconstitutional provision had never been a part hereof.
The City declares that it would have passed this ordinance, and each section,
subsection, clause, or phrase thereof irrespective of the fact that anyone or more
sections, subsections, sentences, clauses, and phrases be declared unconstitutional or
invalid.
Section 5. Publication of the Caption Hereof and Effective Date.
This ordinance shall be in full force and effective from and after its passage and upon
the posting and/or publication, if required by law, of its caption and the City Secretary is
hereby directed to implement such posting and/or publication.
