HomeMy WebLinkAboutOrd 733-2016 Zoning Change - Sister GroveCITY OF ANNA, TEXAS ORDINANCE NO. 1J'ti?J · QQl(p (Sister Grove Estates Zoning Change SF-E to C-1 located on State Highway 121 and northeast of the Collin County Outer Loop) AN ORDINANCE OF THE CITY OF ANNA, TEXAS AMENDING THE CITY'S COMPREHENSIVE PLAN, ZONING MAP, AND ZONING ORDINANCE, AND CHANGING THE ZONING OF CERTAIN PROPERTY AS DESCRIBED HEREIN; PROVIDING FOR SAVINGS, REPEALING AND SEVERABILITY CLAUSES; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR A PENALTY CLAUSE NOT TO EXCEED $2000 OR THE HIGHEST PENAL TY AMOUNT ALLOWED BY LAW, WHICHEVER IS LESS; AND, PROVIDING FOR THE PUBLICATION OF THE CAPTION HEREOF.
WHEREAS, the owner of the property described in Exhibit A attached hereto has requested
a certain zoning for said property; and
WHEREAS, the Planning and Zoning Commission of the City and the City Council of the City of
Anna have given the requisite notices by publication and otherwise and have held the public
hearings as required by law and afforded a full and fair hearing to all property owners and
generally to all persons interested in and situated in the affected area and in the vicinity thereof,
the City Council of the City of Anna has concluded that the Zoning Ordinance of the City of
Anna should be amended as follows:
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA,
TEXAS:
Section 1. The Comprehensive Zoning Ordinance of the City of Anna, Texas, is amended by
changing the zoning of the tract described in Exhibit A, attached hereto and made an integral
part of this ordinance, from Single Family Estates (SF-E) to (C-1) Restricted Commercial District
Zoning.
Section 2. All regulations pertaining to the Restricted Commercial District (C-1) or amended
shall be applicable to this Tract.
Section 3. The official Zoning Map of the City of Anna shall be corrected to reflect the change
in zoning described herein.
Section 4. All ordinances of the City of Anna in conflict with the provisions of this ordinance are
repealed to the extent of that conflict.
Section 5. This Ordinance shall take effect immediately from and after its passage and the
publication of the caption of said ordinance as the law in such case provides.

EXHIBIT A PROPERTY DESCRIPTION WHEREAS Hannibal Shelton Boone and Van Lawrence are the owners of a tract of land situated in the City of Anna , Collin County, Texas, being in the Hiram Brinlee survey, abstract no. 30, being a survey of part of Lots 1, 2 , & 3 of Sister Grove Estates, recorded in volume N, page 37 of the plat records of Collin County, Texas ; being described by metes and bounds as follows: BEGINNING at a Yz inch iron pin set at the northwest corner of said Lot 3; THENCE easterly with the north line of said Lot 3 as follows: North 80 °09'17" East, 21, 90 feet ; South 75 °48'38" East, 33 , 14 feet;
North 80 °24'37" East, 33.45 feet to the northeast corner of said Lot 3; a Yz -inch iron pin set
bears South 26°17'35" East, 50 ,000 feet;
THENCE South 26°17'35" East, with the east line of said Lot 3, 626 .26 feet to an iron pin found with an
aluminum cap at the northeast corner of the 1.079 acre tract recorded as clerk's file no. 20131028001467990 ;
same being in the northwest right-of-way line of State Highway 121 ;
THENCE South 51 °28'42" West, with the northwest right-of-way line of said State Highway 121 and the
southeast line of said 1.079 acre tract. 456.98 feet to a Yz -inch iron pin set as the northwest corner of said 1.079
acre tract; same being in the west line of said Lot 1 ;
THENCE North 00 °27'55" West, with the west line of said Lot 1, passing the north corner of said Lot 1
and the southwest corner of said Lot 2 at 380.06 , continuing with the west line of said Lot 2 , passing the north
corner of said Lot 2 and the southwest corner of said Lot 3 at 703 .67 feet and continuing with the west line of said
Lot 3 , in all , 848.34 feet to the PLACE OF BEGINNING and containing 4.053 acres .
