AGENDA SUBJECT: Consider/Discuss/Action approving a Resolution authorizing the
Chief Administrative Officer to accept an offer from TxDOT for the purchase of right-of-
way.
SUMMARY: The Texas Department of Transportation ("TxDOT") plans to widen and
reconstruct FM 455 from U.S. 75 to S.H. 5. In order to construct the project, TxDOT
needs to acquire a strip of land in front of Natural Springs Park jointly owned by the City
and the Anna Community Development Corporation (see EXHIBIT 1 in the attached
Resolution). TxDOT has offered to purchase the property described in EXHIBIT 1 for
$1,000. The offer is based on an appraisal perform by Real Estates Solutions on behalf of
TxDOT. The attached Resolution would authorize the CDC president to execute deeds
transferring ownership of the two parcels to TxDOT for the FM 455 project.
STAFF RECOMMENDATION: Staff recommends you approve the resolution.

A RESOLUTION OF THE ANNA COMMUNITY DEVELOPMENT CORPORATION
APPROVING THE SALE OF LAND TO THE TEXAS DEPARTMENT OF TRANSPORTATION
AND AUTHORIZING THE CDC PRESIDENT TO EXECUTE A DEED FOR SAME
WHEREAS, The Texas Department of Transportation ("TxDOT") plans to widen and reconstruct
FM 455 from U.S. 75 to S.H. 5; and
WHEREAS, In order to complete the project, TxDOT needs to acquire certain property jointly
owned by the City of Anna, Texas and the Anna Community Development Corporation
Described in EXHIBIT 1; and
WHEREAS, TxDOT has offered to purchase the property described in EXHIBIT 1 $1,000; and
WHEREAS, TxDOT owns the property abutting the properties described in EXHIBIT 1 in fee
simple; and
WHEREAS, the Anna Community Development Corporation ("CDC") finds that the property
described in Exhibit 1 has been used prior to the FM 455 widening and reconstruction project
as a park; and
WHEREAS, the CDC finds that TxDOT has the authority of eminent domain and that the
paramount public use of the property in question is realized by TxDOT's acquisition of the
property for the FM 455 widening and reconstruction project;
NOW THEREFORE, BE IT RESOLVED BY THE ANNA COMMUNITY DEVELOPMENT
CORPORATION THAT:

The recitals set forth above are incorporated herein for all purposes as if set forth in full.
Section 2. Approval of Sale and Authority to Execute Deeds
The CDC hereby approves the sale of the property described in EXHIBIT 1 attached hereto and
incorporated herein for all purposes, and authorizes the CDC President to execute the deed
transferring ownership of same to TxDOT subject to review and approval by the City Attorney of
the deed.

AGENDA SUBJECT: Consider/Discuss/Action approving a Resolution supporting HB
3302 to allow a 4A/Type A corporation in a city under 10,000 who also has a 4B/Type B
corporation to pool their resources in meaningful projects such as tourism and retail.
SUMMARY: Support of the bill was requested by ARCIT (Association of Rural
Communities in Texas.) If passed our corporation would have the ability to pool their
resources meaningful projects such as tourism and retail would be of benefit in growing
and enhancing our community.

SUPPORTING HOUSE BILL 3302 THAT IF PASSED WOULD ALLOW A TYPE A

CORPORATION, TO POOL THEIR RESOURCES FOR PROJECTS AND
ENDORSING AN INCREASE IN THE MAXIMUM POPULATION COUNT TO
10,000
WHEREAS, the Anna Community Development Corporation ("CDC') intends to submit
a letter of support to request that the population limit in HB 3302 increase to 10,000;
and
WHEREAS, the CDC has determined that it is in the best interest of the citizens,
businesses, and future businesses of the City of Anna to publicly support HB 3302.
NOW THEREFORE, BE IT RESOLVED BY THE ANNA COMMUNITY
DEVLEOPMENT CORPORATION, THAT:

MINUTES OF REGULAR MEETING OF THE
ANNA COMMUNITY DEVELOPMENT CORPORATION
Thursday, March 3, 2011
The Community Development Corporation ("CDC') of the City of Anna met at 4:39 p.m.,
Thursday, March 3, 2011, at the Anna City Hall Administration Building, 111 North
Powell Parkway (Hwy. 5), Anna, Texas.
Call to Order
Sandra Delgado, President of CDC, called the meeting to order and the following
items were presented to the Board for its consideration.
2. Roll Call and Establishment of Quorum.
Directors in attendance were: Gene Bowles, Sandra Delgado, Sherilyn Godfrey,
Duane Hayes, Bill Olsen and Connie Stump. A quorum was declared present
and the floor was open for business.
Others in attendance were: Jessica Perkins, Chief Administrative Officer; and
Clark McCoy, Attorney for CDC.
3. Invocation and Pledge.
Bill Olsen gave the invocation and led the group in the Pledge of Allegiance.
4. Discussion regarding the submission of the restated certificate of corpora-
tion to the Secretary of State.
Recently, Jessica Perkins was notified that the form used to submit the restated
certification was incorrect and that the State does not have a standard form for
this purpose. Clark McCoy, attorney for CDC, is communicating with the State to
resolve this matter. Once it has been resolved, the restated certificate will be
submitted to the IRS.
5. Public Hearing:
To consider public comment regarding a project including an expenditure
in the amount of $99,900 in the form of a loan to Image Vision Labs
("Recipient") to assist with the Recipient's operating expenses necessary
for the purpose of expanding the operations of Recipient's software
business and the expansion of business development within the city (the
"Project'). The Project will be financed from a grant the CDC was awarded
by the USDA.
The public hearing opened at 4:46pm there were no comments. The public
hearing closed at 4:46pm.

6. Consider/Discuss/Action regarding approving a resolution authorizing the
execution of a loan agreement, promissory note, and security agreement
with Image Vision Labs ("IVL").
Determining that an official public meeting was held, was open to the public and
public notice of time, place and purpose of said meeting was given, in
accordance with chapter 551, Texas Government Code, Sandra Delgado
motioned to authorize the (1) expenditure of funds in the amount of $99,900 for
the Project, and direct the Publication of Notice of the Project and Notice of
Public Hearing, all subject to the approval of the City Council after, at least, two
separate readings before City Council; and (2) fully execute a Project agreement
between CDC and IVL and any necessary loan agreement(s) to be executed
after City Council's consideration and approval of the Project, that is subject to
the approval as to substance of said agreements by the CDC's Chief
Administrative Officer and approval as to the form of said agreements by the
CDC's legal council. Connie Stump seconded the motion. Motion carried.

(1) To discuss or deliberate regarding commercial or financial information
that the Board of Directors has received from a business prospect that the
Board of Directors seeks to have locate, stay, or expand in or near the
territory of the City of Anna and with which the Board is conducting

Not Necessary.
8. Review of bills and fiscal year 2010-11 budget.
There were no bills to review. A copy of an updated CDC Budget 2010-2011
was attached to the meeting packet for the Board's information. The sales tax
per month has increased $1,500 - $2,000 per month due, in part, to the
distribution sales of Bloomfield Homes.

Connie Stump moved to approve the aforementioned minutes. Sandra Delgado
seconded the motion. Motion carried.

Sherilyn Godfrey made a Motion to adjourn that was seconded by Bill Olsen.
Motion carried. The meeting was adjourned at 4:59 p.m.

Please advise rain date other than July 4, 2011
This will be an all aerial display where we furnish the state permit $50.00, insurance in
the amount of $5,000,000.00, labor, transportation and all necessary equipment for firing
display. We furnish everything except the firing site, security which you must provide.
All city fire department fees will be waived.
The display will be electrically fired with duration of approximately 13- 15 minutes.
The total price of the display is $8,000.00. If the event is cancelled the sponsor will pay
50% of contract cost. We require a 50% deposit on or before May 20, 2011 with the
balance due July 4, 2011. This proposal is good till May 20, 2011 if you agree with the
terms sign and return this contract by fax to confirm the booking of display.

Atlas Enterprises Inc. is proud to submit the enclosed proposal for the city of Anna July
3rd Fireworks Display. We appreciate tile opportuni ty and would I ook forward to working with

Yourdesi re to lookat each presentation not only torival the previous year's clisplay but
also to bring about new artistic look to that display is important. In light of this desire, we set
about purchasing and having in stock the new products that would create that new look.
We always approach new projects with special interest and effort not only because of
theprestige ofyourevent butalso because ofthe competitivenessof the process through which
this event is secured. By beingTexas-based, we know the importance of the production and
can appreciate it. Also, as one of the largest fireworks firms producing traditional and
pyromusical productions in the United States and the largest in the Southwest, weare and must
be more innovative and lead the industry in many facets of pyrotechnic productions.
The Product
Annually, Atlas Enterprises, Inc. negotiates with its factories throughout the Far Past
as well as the United States to discuss new ideas and purchase unique, high quality fireworks
products. This is important because a factory in China orTaiwan does not always have a clear
concept of our market and specialty needs. Further, we travel to the factory to test and design
new and innovative products. This keeps us always a year or two ahead ofour competition.
Also, to furtherenhance our product line, Atlas Enterprises hie. has its own factory on site to
produce the highest quality custom products. To cnsurethat the quality is superior, ourfactory
manuractures a limited quantity of this specialty product for only two customers ... Atlas
Enterprises, Inc. and the world famous Walt Disney World.

The Setas
The best fireworks in the world would not be complete withoutprecise implementation.
W econtinue to lead the industry ill state-of-the-art technology. The electronic equipment used in
ourproductionisdie best inthobusiless. Several competitors have tried to copy our system and
have failed leaving large portionsofthe fireworks program unfired becauseoftechnical failures.
The custom-built for Atlas Enterprises Inc. electronics were produced by engineers at Texas
Instruments and are continually upgraded for the increased demand and improvements in
technology. These systems are considered so reliable that Astroworld in Houston has purchased
oursystenstofire their fireworks displays. High density polyethylene mortars, only recentlybeing
discovered by most otherfirms, have been utilized forsafety. and reliability. The useof flatbed
trailers has also been successftdill safeguardingagainsttheweather. Each ofthesefactors enhance
the qualityoflhe production.
Firing Method and Plot Plan
The firing method used forthisdispley is electronic. Ourcontrol panels are capableof firing
900independantsctsperpanel. Where it is not practical to wire remote firing sites into the main
control panel, remote firing units will be used. Back -tip firingpmnclsare always onstandby inthe
unlikelycase ofelectronicfail ure. All systetnshave testingeapablility and continuous readoutof
igmitorcontinuity.
The ignitors used have the best responsetime and reliability rating ofany igni torin the
industry. Theywill be imerted into the I iftchargewhere very precise timing is required.
The plot plan should include anarea from which the main body of (lie program is ignited,
an extended area to graphicallypainta wall of low level pyrotechnics (when included), and remote
firing areas to set up for finale racks. All spectators must remainadistance away conespondingto
the largcstshell in theprogmm. This distance is specified in the contract and is the responsibility of
the sponsor to securely maintain this safety zone.

Main Program: Thisprogram is mountedon a flatbed trailer(s) with a specially made tarpaulin
which is form -fitted over the product to protect it From rain both from the top and the sides.
Low Level Effects: These are constructed to be erected on the ground. They will be protected
by heavy plastic in the event that heavy rains occur on the day ofyour display.
Othersites: Some specialty and high] ightedproduct will beplaced insandboxes onthe ground.
Thesewill be covered with heavyplastic in the case ofvciy heavy rains on thodayofyourdisplay.
Final checks will be made on the day ofyour display to insure that all materials remain perfectly dry.
In the unlikelyeventthata device has received some waterdamage, itwill be replaced with a new
device.
Everyatlenmpiwillbenmadetoinsurethatthepyromusicalisperfonned. Should, however, theevent
be canceled and not rescheduled, the cancellation fee will be 30%ofthe contract price plus out of

The Managernen(
Royce Trout has been involved with the family businessofAtlas Enterprises Inc. since his early
school years during the summer and throughout his college years. After graduating with a
degree in Business Administration fi-om the U n versity of Texas at Austin, lie began managing
the display fireworks division of Atlas Enterprises file. with specific duties including purchas-
ing, quality control, and design. He was the first to use computerize program design and
elecuvnic firingin the industry.
He is also an industry leader serving as Past President of the American Pyrotechnics
Association and currently as a director, Secretary of the Texas Pyrotechnic Association,
Member of the State of Texas Commission on Pyrotechnics Advisory Council, aoddirectorof

This will be an all aerial display where we furnish the state permit $50.00, insurance in
the amount of $5,000,000.00, labor, transportation and all necessary equipment for firing
display. We furnish everything except the firing site, security which you must provide.
All city fire department fees will be waived.
The display will be electrically fired with duration of approximately 13- 15 minutes.
The total price of the display is $8,000.00. If the event is cancelled the sponsor will pay
50% of contract cost. We require a 50% deposit on or before May 20, 2011 with the
balance due July 4, 2011. This proposal is good till May 20, 2011 if you agree with the
terms sign and return this contract by fax to confirm the booking of display.

Safety
Our number one priority is the safety of everyone in attendance at your event. We will never consider firing
a display that may be unsafe in any way. We diligently follow all Federal, State, and Local laws and
regulations. All of our pyrotechnicians are experienced and shoot fireworks on a regular basis, year-round.
Some other companies use part-time labor to set up and shoot displays, some of which only shoot once per
year.
Technology
Fireworks displays can be performed utilizing a variety of firing methods. Each display is unique and has
different needs. We invest in the latest digital firing equipment for even the most complicated fireworks
displays. Our latest firing systems are capable of synching fireworks to music within 1/100th of a second
accuracy.
Price
Budget is always an important factor for any organization. Consistently, we have been able to deliver more
"bang for the buck." There are two main reasons for this. First, we keep our storage and operations local.
This saves our clients transportation costs that many other companies face, and pass on to you. Second, we
are proudly a family-owned and operated business. This means we do not have high employee labor
expenses. In other words, with fewer expenses come more affordable displays.
Customer Service
Our current customers always enjoy the top-notch customer service they receive. As a family-owned and
operated company, we give individual attention to each show and strive to meet the needs of each and every
event. Many companies have different people sell, design, and shoot your show. Our operations take out the
possibility for miscommunication by limiting the number of different people handing your show. In fact,
how many other companies can you call and reach the owner 24 hours a day, 7 days a week? Our

Not all fireworks are created equally. Our dedication to quality is evident in our displays. Each year we work
