AN ORDINANCE OF THE CITY OF ANNA, TEXAS, AMENDING ORDINANCE NO. 514-
2010, AS AMENDED BY ORDINANCE NO. 577-2012 AND BY ORDINANCE NO. 581-
2012, ADOPTING THE AMENDED AND UPDATED VERSION OF THE COLLIN
COUNTY EMERGENCY OPERATIONS PLAN; PROVIDING FOR PENALTIES IN
AMOUNTS NOT TO EXCEED $2,000 FOR VIOLATIONS; PROVIDING FOR
CONSTRUCTION AND SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, under Texas Administrative Code, 37 TAC § 7.13, a municipality—in order
to qualify for certain federal assistance programs authorized under the Robert T. Stafford
Disaster Relief and Emergency Assistance Act as amended, and other federal statutes—
must establish by ordinance a local emergency management agency and must establish
an emergency management plan; and
WHEREAS, on October 12, 2010, the City Council of the City of Anna, Texas ("City
Council") adopted City of Anna, Texas Ordinance No. 514-2010 establishing such an
agency and adopting such a plan; and
WHEREAS, on March 29, 2012, the City Council adopted City of Anna, Texas Ordinance
No. 577-2012, amending certain provisions of City of Anna, Texas Ordinance No. 514-
2010; and
WHEREAS, on April 24, 2012 the City Council adopted City of Anna, Texas Ordinance
No. 581-2012, amending certain provisions of City of Anna, Texas Ordinance No. 514-
2010; and
WHEREAS, City of Anna, Texas Ordinance No. 514-2010, as amended by Ordinance
No. 577-2012 and by Ordinance No. 581-2012, is hereinafter referenced as "Ordinance
No. 514-2010"; and
WHEREAS, the Collin County Emergency Operations Plan adopted by reference as
Exhibit "A" in Ordinance No. 541-2010 as amended has been updated by Collin County;
and
WHEREAS, the City Council in accordance with State laws governing emergency
management plans desires to adopt the updated Collin County Emergency Operations
Plan; and
WHEREAS, the emergency management plans adopted by the City of Anna include
information relating to the prevention, detection, response, and investigation of acts of
terrorism or related criminal activity, including without limitation tactical plans for
emergency response providers, methods to be implemented, and assessments of risk or
vulnerability of persons or property including critical infrastructure (collectively, "terror
related information:"); and

WHEREAS, the City Council has determined that the cause of emergencies or potential
emergencies are often uncertain before, during or after the occurrence of an emergency
and that terror related information, including any aspect of the emergency management
plan, may be applied to any emergency or potential emergency until terrorism or related
criminal activity can be eliminated as the cause of an emergency or potential emergency;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ANNA, TEXAS
Section 1. Recitals Incorporated
All matters stated in the preamble of this ordinance are found to be true and correct and
are incorporated into the body of this ordinance as if copied in their entirety.
Section 2. Amendment to Ordinance No. 514-2010.
The Collin County Emergency Operations Plan adopted under Ordinance No. 541-2010
as amended is hereby repealed and replaced with the updated version of the Collin
County Emergency Operations Plan dated March 1, 2016, which shall be kept on file at
the appropriate City offices in accordance with applicable law.
Section 3. Savings, Severability and Repealing Clauses
All ordinances of the City in conflict with the provisions of this ordinance are repealed to
the extent of that conflict. If any provision of this ordinance shall be held to be invalid or
unconstitutional, the remainder of such ordinance shall continue in full force and effect
the same as if such invalid or unconstitutional provision had never been a part hereof.
The City declares that it would have passed this ordinance, and each section, subsection,
sentence, clause, or phrase thereof irrespective of the fact that any one or more sections,
subsections, sentences, clauses, and phrases be declared unconstitutional or invalid.
Section 4. Publication of the Caption Hereof and Effective Date
This ordinance shall be in full force and effective from and after its passage and upon
the posting and/or publication, if required by law, of its caption and the City Secretary is
hereby directed to implement such posting and/or publication.

The Collin County inter jurisdictional Emergency Management Plan has been updated and
adopted by the Collin County Commissioners Court. This plan is required for each municipality
under Title 37 Texas Administrative Code Chapter §7.12: Each county and incorporated city in
Texas shall maintain an emergency management agency or participate in a local or inter -
jurisdictional emergency management agency and Texas Government Code Chapter 418
Subchapter E Section 106: Each local and inter jurisdictional agency shall prepare and keep
current an emergency management plan for its area providing for disaster mitigation,
preparedness, response, and recovery.
A copy of the updated emergency management plan is included on the enclosed CD. In addition,
the State of Texas has requested that each jurisdiction complete a form with their appointed
emergency management coordinator's contact information. Please sign the enclosed Emergency
Management Plan signature page, as well as, complete the Texas Division of Emergency
Management form, and return them to the Collin County Office of Emergency Management.

Section 418.101 of the Texas Government Code states: "The presiding officer of the governing body of each political
subdivision iN/l notify the Division of Emergency Management of the manner in which the political subdivision is providing or

The information on this form may be released to those inquiring about local emergency management programs
