HomeMy WebLinkAboutOrd 789-2018 Amending Code Part III-C Table 5 of Appendix 2, and Appendix 3 adding Dog GroomingCITY OF ANNA, TEXAS ORDINANCE NO. 419-- N AN ORDINANGE OF THE CITY OF ANNA, TEXAS, AMENDING THE ANNA CITY CODE OF ORDINANCES PART III -C, ZONING ORDINANCE, TABLE 5 OF APPENDIX 2, AND APPENDIX 3; PROVIDING FOR A DEFINITION AND FOR ZONING PROVISIONS FOR A NEW, SPECIFIC USE FOR DOG GROOMING; PROVIDING FOR SAVINGS, REPEALING AND SEVERABILITY CLAUSES; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR A PENALTY CLAUSE NOT TO EXCEED $2000 OR THE HIGHEST PENALTY AMOUNT ALLOWED BY LAW, WHICHEVER IS LESS; AND, PROVIDING FOR THE PUBLICATION OF THE CAPTION HEREOF. WHEREAS, Heather Cadaret has requested a new, specific zoning use of Dog Grooming be added to the zoning classifications for Commercial C-1 zoning; and WHEREAS, the Planning and Zoning Commission and the City Council of the City of Anna have given the requisite notices by publication and otherwise, have held the public hearings pertaining to zoning changes as required by law, and determined all other procedural and substantive requirements have been met; WHEREAS, the City Council of the City of Anna has concluded that Part III -C Table 5 of Appendix 2 and Appendix 3 shall be amended to provide for a definition and use requirements for Dog Grooming within the City of Anna Code of Ordinances. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS, THAT: Section 1. The Zoning Ordinance of the City of Anna, Texas, is amended by adding the new, specific use of Dog Grooming to the C-1 Commercial zoning with conditions. Section 2. In accordance with Part II, Article 1, Section 9 of the Anna Code, the following amendments are made to Part III -C, Appendix 2, Table 5; and Appendix 3 as follows: 2.01 Part III -C, Zoning Ordinance, Appendix 2, Table 5 is amended as shown on the following page (remainder of this page left blank intentionally): 2.02 Part III -C, Zoning Ordinance, Appendix 3 Descriptions/ Definitions of Uses is amended as follows: Ex 3.5.17.1 Dog Grooming — a retail establishment where dogs are housed within the buildinq while services specific to grooming take place. A retail section may be allowed for the sale of grooming products, leashes, collars, tags, toys, treats, etc. No outside storage or kenneling shall be allowed. If the business is within a single -use building (with no other tenants), they may have a screened/fenced in area for the dogs to relieve themselves while waiting to be groomed. All dogs must be supervised at all times and on a leash while outside of the building. If the business is within a building with any additional tenants, all pet grooming activities shall be conducted within the building and there will be no allowance for dog clean-up stations or designated relief areas surrounding the building or parking lots. Dogs shall be required to be on a leash while entering and exiting the building_ Section 3. Any violation of any of the terms of this ordinance, whether denominated in this ordinance as unlawful or not, shall be deemed a misdemeanor. Any person convicted of any such violation shall be fined in an amount not to exceed $2,000 for each incidence of violation. Each violation is considered a separate offense and will be punished separately. Section 4. All ordinances of the City in conflict with the provisions of this ordinance are repealed to the extent of that conflict. If any provision of this ordinance shall be held to be invalid or unconstitutional, the remainder of such ordinance shall continue in full force and effect the same as if such invalid or unconstitutional provision had never been a part hereof. The City declares that it would have passed this ordinance, and each section, subsection, clause, or phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, and phrases be declared unconstitutional or invalid. Section 5. This Ordinance shall take effect immediately from and after its passage as the law in such case provides. We are Heather and Craig Cadaret, Owner/Operators of Bow Wow Boutique N Spa and residents of Anna. We opened our dog grooming salon on January 5', 2009 in Van Alstyne and moved to our current location in Melissa in June of 2012. We have developed a great clientele over the years and we have built relationships with our customers that make them feel like family. We take pride in focusing on each dog as an individual and customizing their grooming process so that they have the most positive experience possible and they actually look forward to their grooming. It is due to this approach that we have built such a strong, devoted following and were recently voted Neighborhood Favorite for Anna and Melissa on Nextdoor (an award only given to 1 % of businesses). With the continued growth and new residents moving to the area, we receive an average of 15-20 new client calls per week and the #1 thing we hear is that they are looking for a local groomer and they don't want to have to drive to McKinney or Sherman with their dog. Anna does not currently have any other dog grooming services in town and we would love to fill that void by continuing to provide the quality, personalized service that our clients have come to expect for their pets. We are requesting that our Grooming business be allowed in Cl zoning with a specific use permit at 811 S Interurban. This is an ideal location for our business as it is easily accessible, but is not on an extremely busy main road (ie 455, Hwy 5, Hwy 75) which has been a safety concern for our clients at our current location on 121 in Melissa. Our use of this location for our business is also supported by the landlord and neighboring businesses. The general purpose and description for C 1 zoning as stated in Section 22.01 of the zoning ordinance states: The C -I District is established to accommodate the shopping needs of residents in adjacent residential areas. The District is meant to be used in limited areas, where retail or service establishments deal directly with customers. Businesses in the C-1 District should be oriented to satisfying the daily and frequent shopping needs of the neighborhood consumer. Our Grooming Salon fits this description to a T. We provide services to local residents for their pets and the majority of our clients are on a preset weekly, bi-weekly, or monthly recurring schedule. We also have a retail inventory of toys, treats, and grooming products available for purchase. &61 /Z 0 It is also our understanding that Beauty Salons are allowed in C1 zoning. We provide the same services that a Beauty Salon does with the following differences: • Our clients walk on 4 feet instead of 2 • We make sure that our clients are properly vaccinated We encourage and promote responsible pet ownership We are CPR and First Aid Certified We do not use harsh chemicals • We are required to charge sales tax which puts money back into our city Thank you for taking the time to read this letter and considering granting us a specific use permit to be able to operate our business at 811 S Interurban.
