The Anna Planning and Zoning Commission will conduct a meeting at 7:00 PM on
September 11, 2017, at the Anna City Hall Administration Building, 111 N. Powell
Parkway, to consider the following items:
1. Call To Order And Establishment Of Quorum
2. Invocation and Pledge of Allegiance
3. Presentation by Clark McCoy concerning legal aspects of Planning and Zoning.
4. Election of Chairman and Vice Chairman.
5. A) Conduct a public hearing to consider public comments regarding a request by

A) Conduct a public hearing to consider public comments regarding a request by the
Anna Independent School District, owner(s) of the property, to change the existing
(AG) Agricultural zoning to a (PD) Planned Development. The property is generally
located at the southwest corner of Highway 5 and Rosamond Parkway.
B) Consider/Discuss/Act on recommendation regarding a request by the owner of the
property to change zoning from (AG) Agricultural zoning to a (PD) Planned
Development.
SUMMARY:
The Anna I SD is requesting that the property be rezoned from the (AG) Agricultural zoning district
to a (PD) Planned Development. The Planned Development district would have a base zoning of
(SF-E) Single -Family Estate and would allow for off-street parking in accordance to the submitted
phasing plan and designate a maximum building height of 65 feet, a side yard setback of 5 feet,
and building materials as outlined in Exhibit B. This zoning change request was submitted by the
School District in order to allow for the construction of a new press box for the School Districts
stadium that is used for all Home football games. Parking will be provided using the following
standards:
i. Off-street parking shall be provided in accordance with the specific uses as set forth in
Section 38 of the City of Anna Code of Ordinances.
ii. Parking will be provided at a ratio of 1 space per 4 seats.
iii. The required seating of the stadium will be developed in phases as seats are made
available for spectators.
iv. Phase 1 seating will include 3,600 seats with 900 permanent parking spaces being
provided on site and with the shared parking at Slayter Creek Park.
v. Phase 2 seating will include an additional 1,200 seats with 300 additional parking
spaces being provided.
vi. Phase 2 parking will commence with the construction of a new locker room or the
construction of High School Addition Phase I I whichever comes first.
vii. Total capacity of stadium will be 4,800 seats with 1,200 total parking spaces being
provided on site including the shared parking at Slayter Creek Park.
viii. All seating can be constructed concurrently, however, until Phase 2 parking is provided
1,200 seats shall be tarped and unused.
ix. In the case of a special event, if grass parking is usable on the Middle School site or
spectators bussed from other school facilities the seats can be un-tarped for the
event.
x. A special event would include Home coming or Playoff games.
Additionally, an approved fire lane with approved turn -around shall be provided to the press box.
STAFF RECOMMENDATION:
The staff is recommending approval of the zoning change request.

"Planned Development- ("PD")
Southwest corner of Highway 5 and Rosamond Parkway
AN ORDINANCE OF THE CITY OF ANNA, TEXAS AMENDING THE CITY'S
COMPREHENSIVE PLAN, ZONING MAP, AND ZONING ORDINANCE AND
CHANGING THE ZONING OF CERTAIN PROPERTY AS DESCRIBED HEREIN;
PROVIDING FOR SAVINGS, REPEALING AND SEVERABILITY CLAUSES;
PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR A PENALTY CLAUSE
NOT TO EXCEED $2,000 OR THE HIGHEST PENALTY AMOUNT ALLOWED BY
LAW, WHICHEVER IS LESS; AND, PROVIDING FOR THE PUBLICATION OF THE
CAPTION HEREOF.
WHEREAS, the City of Anna, Texas ("City") has previously adopted ordinances, rules
and regulations governing the zoning in the City; and
WHEREAS, the City has received a requested zoning change on Property described
in Exhibit A ("Property") attached hereto and incorporated herein for all purposes as if
set forth in full; and
WHEREAS, said Property is generally located at the Southwest corner of Highway 5
and Rosamond Parkway and is revising the existing "AG" to Planned Development
(PD); and
WHEREAS, the Planning and Zoning Commission of the City and the City Council of
the City of Anna ("City Council") have given the requisite notices by publication and
otherwise and have held the public hearings as required by law and afforded a full and
fair hearing to all property owners and generally to all persons interested in and
situated in the affected area and in the vicinity thereof, the City Council has concluded
that the Zoning Ordinance of the City should be amended as set forth below.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ANNA, TEXAS THAT:
Section 1. Recitals Incorporated
The above recitals are incorporated herein by reference for all purposes.
Section 2. Zoning Change
The Comprehensive Plan of the City and City of Anna Ordinance No. 116-2003 as
amended and codified as Part III-C of The Anna City Code of Ordinances are
hereby amended by changing the zoning of the Property described in Exhibit A to
PD with revisions as stated below.
Planned Development
A. The property shall be zoned Planned Development (PD). Development within the
planned development district shall be governed by the following regulations and in
accordance with Section 30 (PD-Planned Development) of the City of Anna Zoning
Ordinance.
B. Permitted Uses:
i. All uses within the SF-E (Single Family Estate)
C. Building Height and Area Regulations
i. Maximum Height — 65 feet to top of Mechanical equipment screening.
Minimum Side Yard — 5 foot adjacent to City Park
D. Building Facade and Design Requirements
All building facades shall conform to the following design and building material
requirements:
Materials shall be consistent with Exhibit B.
E. Off -Street Parking

Section 3. Official Zoning Map
The official Zoning Map of the City shall be corrected to reflect the change in zoning
described herein:
Section 4. Savings, Repealing and Severability Clauses
It is hereby declared to be the intention of the City Council that the words, sentences,
paragraphs, subdivisions, clauses, phrases, and provisions of this ordinance are
severable and, if any phrase, sentence, paragraph, subdivision, clause, or provision
of this ordinance shall be declared unconstitutional or otherwise invalid or inapplicable
by the valid judgment or decree of any court of competent jurisdiction, such
unconstitutionality, invalidity or inapplicability shall not affect any of the remaining
words, sentences, paragraphs, subdivisions, clauses, phrases, or provisions of this
ordinance, since the same would have been enacted by the City Council without the
incorporation in this ordinance of any such unconstitutional, invalid or inapplicable
words, sentences, paragraphs, subdivisions, clauses, phrases, or provisions. Further,
all ordinances or parts of ordinances in force when the provisions of this ordinance
become effective that are consistent and do not conflict with the terms and provisions
of this ordinance are hereby ratified to the extent of such consistency and lack of
conflict, and all ordinances or parts of ordinances in force when the provisions of this
ordinance become effective that are inconsistent or in conflict with the terms and
provisions contained in this ordinance are hereby repealed only to the extent of any
such conflict.
Section 5. Penalty
Any violation of any of the terms of this ordinance, whether denominated in this
ordinance as unlawful or not, shall be deemed a misdemeanor. Any person convicted
of any such violation shall be fined in an amount not to exceed $2,000 for each
incidence of violation. Each day a violation exists is considered a separate offense
and will be punished separately.
Section 6. Publication of the Caption and Effective Date
This ordinance shall be effective upon its passage by the City Council, approval by
the Mayor, and posting and/or publication, if required by law, of its caption. The City
Secretary is hereby authorized and directed to implement such posting and/or
publication.

REGULAR MEETING
August 7 , 2017
The Planning and Zoning Commission of the City of Anna held its regular meeting on
August 7, 2017 at 7:00 p.m., at the Community Room of the Anna City Hall
Administration Building located at 111 North Powell Parkway (Hwy 5), to consider the
following items.
1. Call to order and establishment of quorum.
The meeting was called to order at 7:04 p.m. Members present were Janine
Johnson, Sandy Setliff, Wayne Barton, Danny Ussery, Don Callaham, Donald
Henke and Christian Landers. Staff present was Maurice Schwanke and Daniel
Harper.
2. Invocation and Pledge of Allegiance
Mr. Schwanke gave the invocation and led the Pledge of Allegiance.
3. Consider/Discuss/Act on recommendation regarding "Stevens" development plat.
Mr. Harper gave a presentation. The development plat is located within Anna's
exterritorial jurisdiction and generally known as 10560 CR 289. The owner is
proposing to build a house on the property. Mr. Harper noted that the submittal
meets the City of Anna development plat requirements. The Staff recommends
approval of the plat.
A motion was made by Commissioner Henke, seconded by Commissioner
Ussury to recommend approval of the "Stevens" development plat.
The vote was unanimous.
4. Consider/Discuss/Act on recommendation regarding "Pepper 376 Development"
development plat.
Mr. Harper gave a presentation. The development plat is located within Anna's
exterritotiral jurisdiction and is located in the Robert Whitaker Survey, Abstract
No. 1011 and contains approximately 17.885 acres of land. The owner is
proposing to offer leased parking spaces for boats, RV and Trailers on the
property. They have also proposed that the property will likely have a balance of
50% parking, 25% light industrial offices and 25% storage buildings. Mr. Harper
noted that the submittal meets the City of Anna development plat requirements.
The Staff recommends approval of the plat.

A motion was made by Commissioner Henke, seconded by Commissioner
Callaham to recommend approval of the "Pepper 376 Development"
development plat. The vote was unanimous.

Consider/Discuss/Act on recommendation regarding "Avery Pointe Amentiry
Center" site plan and landscape plan.
Mr. Harper gave a presentation and answered questions from the commission.
The project's landscape archiectrect Mr. Cody Johnson also anwered questions
from the commission. The staff recommended approval of the site plan and
landscape plan.
A motion was made by Commissioner Landers, seconded by Commissioner
Callaham to recommend approval of the "Avery Pointe Amenity Center" site
pland and landscape plan. The vote was unanimous.
Consider to approve Minutes of the July 10, 2017 Planning and Zoning meeting.
A motion was made by Commissioner Callaham, seconded by Commissioner
Setliff to approve the Minutes of the July 10, 2017 meeting. The vote was
unanimous.
10. Adjourn
There being no further business, a motion was made by Chairperson Johnson to
adjourn the meeting. Commissioner Ussury seconded the motion. The meeting
adjourned at 7:18 p.m.
