A RESOLUTION OF THE CITY OF ANNA, TEXAS APPROVING THE ALTICE/SUDDENLINK ADDITION SITE PLAN. WHEREAS, In order to provide for the orderly development of land within the Anna city limits and extraterritorial jurisdiction, the City Council of the City of Anna, Texas (the "City Council") has adopted Part III -C of the Anna City Code of Ordinances ("Zoning Ordinance"); and WHEREAS, Gonzales & Schneeberg, has submitted an application for approval of a site plan for the Altice/Suddenlink Addition; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS, THAT: Section 1. Recitals Incorporated. The recitals above are incorporated herein as if set forth in full for all purposes. Section 2. Approval of Site Plan The City Council hereby approves the site plan for the Altice/Suddenlink Addition attached hereto as Exhibit 1. Anna, TX 75409 Dear Ms. Smythe, After review of your construction documents dated July 29, 2019; this project is exempt from registering with TDLR for compliance with the Texas Accessibility Standards. This project consists of only machinery spaces in a new data center building and would meet the requirement for Machinery Spaces Exemption. Below is an excerpt from the code that shows compliance is not required. Chapter 2: Scoping Requirements 203 General Exceptions 203.1 General. Sites, buildings, facilities, and elements are exempt from these requirements to the extent specified by 203. 203.5 Machinery Spaces. Spaces frequented only by service personnel for maintenance, repair, or occasional monitoring or equipment shall not be required to comply with these requirements or to be on an accessible route. Machinery spaces include, but are not limited to, elevator pits or elevator penthouses; mechanical, electrical or communications equipment rooms; piping or equipment catwalks; water or sewage treatment pump rooms and stations; electric substations and transformer vaults; and highway and tunnel utility facilities If the scope of work changes then we would need to rereview these requirements for compliance.
