Call to Order, Roll Call and Establishment of Quorum 2. CLOSED SESSION (EXCEPTIONS) Under Tex. Gov't Code Chapter 551, the City Council may enter into closed session to discuss any items listed or referenced on this agenda under the following exceptions: a. Consult with legal counsel regarding pending or contemplated litigation and/or on matters in which the duty of the attorney to the governmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Chapter 551 of the Government Code (Tex. Gov't Code §551.071). Development Fees; Law Enforcement Services. b. Discuss or deliberate the purchase, exchange, lease, or value of real property (Tex. WHEREAS, Nazi Germany made extensive military advances during 1939 and 1940, and its objectives included overtaking France and Britain. In response, the U.S. Congress took steps in January 1941 to enact a law allowing U.S. military arms and defense material be sent to Britain, and other countries deemed important to the U.S. defense, without payment. The Lend -Lease Act was signed into law by President Franklin D. Roosevelt in March 1941. WHEREAS, Glen Hubbard Stevens, a resident of Anna, was one of fourteen Collin County men inducted into the U.S. military on Friday, February 7, 1941 at the District Courthouse in McKinney. WHEREAS, Tech4 Glen Hubbard Stevens was a member of 82ndAirbome Division, 507 PIR, Company G. WHEREAS, Allied forces launched Operation Overlord on June 6, 1944 with the military objective of pushing Nazi Germany out of northern France. WHEREAS, paratroopers and glider borne infantry were dropped on the western and eastern flanks of a 50- mile stretch of beaches near Normandy France in the early hours of June 6, 1944. WHEREAS, over 1,100 U.S. paratroopers were killed on June 6, 1944, representing almost half of U.S. fatalities on this day. WHEREAS, Tech 4 Glen Hubbard Stevens was a paratrooper on June 6, 1944 and received a mortal combat wound to his thorax. WHEREAS, Tech4 Glen Hubbard Stevens was temporarily laid to rest in Blosville, France, located in the western flank of Omaha and Utah Beaches. In 1948 Tech4 Stevens was brought back to North Texas, and reburied near his maternal grandparents. WHEREAS, U.S. citizens owe their freedoms to the men and women willing to put their lives on the line in defense of our great country, a sacrifice we should always remember. Lea Humphreys thank former Congressman Johnson, and the audience Key Biographies The Honorable Rick Grady served as a non-commissioned officer for the U.S. Army Military Assistance Command Vietnam and then 1st Aviation Brigade, managing a company of forward air controllers and pathfinders in Vietnam. Rick was twice decorated with the Army Commendation Metal and the Vietnamese Cross of Gallantry. Rick's extensive volunteer activities include Plano City Council member, chair of the Emergency Preparedness Planning Council of North Central Texas, founder of the Collin County Veterans Coalition, and member of the Military Communities Committee with the National League of Cities. In 2017 Congressman Sam Johnson honored Rick's service with the Congressional Veterans Commendation. Donald K. Mitchener, PhD, is a University of North Texas Military History Center Fellow, and a lecturer and undergraduate advisor in UNT's History Department. He received his PhD in American History from the University of North Texas in 2006. He is an expert in World War II history. His book, entitled U.S. Naval Gunfire SuRport in the Pacific is War: A Study of the Development and Application of Doctrine, has been accepted for publication by Brecourt Academic in association with The University Press of Kentucky. The Honorable Sam Johnson is a decorated war hero and native Texan. During his 29-year career in the U.S. Air Force, former Congressman Johnson flew combat missions in both the Korean and Vietnam Wars, enduring nearly seven years as a Prisoner of War. Sam was awarded two Silver Stars, two Legions of Merit, the Distinguished Flying Cross, one Bronze Star with Valor, two Purple Hearts, four Air Medals, and three Outstanding Unit Awards. Sam established a home-building business in North Dallas, and served in the Texas legislature. Sam went on to serve in the United States Congress from 1991 to 2019. As we approach the 75t" Anniversary of D-Day, I want to make sure there is a community ceremonial remembrance for who fought and those who died during D-Day. I have spent considerable amount of time identifying roughly 100 Texans who died during D-Day, including one from Anna, Texas. Pictured to the left, Sargent Glen Hubbard Stevens died at D-Day. Glen's father was an Anna farmer when Glen went into the U.S. Army. I am enclosing Sargent Stevens' military registration card and death certificate. Also, I am enclosing a working draft program for June 6, 2019. 1 am reaching I am working to track down Glen's relatives in the hopes some could attend the event. So far, 1 havP only located more distant relatives (e.g, fifth cousin). But, I am working on this idea. I would be happy to discuss this in person or answer any questions. (Maurice Schwanke) The development plat for review is located within Anna's extra territorial jurisdiction and is generally known as 1961 County Road 376. The tract is in the Richard Whitaker Survey, Abstract No. 1011 and contains 4.35 acres of land. The owner is proposing to place a mobile home on the property and then in the future build a home, shop, barn and pond. The submittal meets the City of Anna development plat requirements. A RESOLUTION OF THE CITY OF ANNA, TEXAS APPROVING THE AMBER SMITH HOMEPLACE DEVELOPMENT PLAT d. Approve a Resolution approving the Jackson Estates Development Plat. (Maurice Schwanke) The development plat for review is located within Anna's extra territorial jurisdiction and is located on the North side of White Oak Circle. The tract is in the John Rowland Survey, Abstract No. 784 and contains 4.716 acres of land. The owner is proposing to put a new home and shed on the property. The submittal meets the City of Anna development plat requirements. A RESOLUTION OF THE CITY OF ANNA, TEXAS APPROVING THE JACKSON ESTATES DEVELOPMENT PLAT e. Approve a Resolution approving the Farrell Development Plat. (Maurice Schwanke) The development plat for review is located within Anna's extra territorial jurisdiction and is located off of the East side of County Road 479, North of FM 2862. Starlight Homes Texas LLC is trying to rectify the situation and are desirous to develop the property. To accomplish increasing the pad site, the front setback needs to be decreased from 25 feet to 20 feet. A significant portion of Anna already has the 20 foot front setback standard. (Ashley Stathatos) At the September 23, 2014 City Council meeting, the City Council approved the assessment of roadway impact fees at a rate of $333.34 per service unit for both service areas. The Ordinance that was signed states that the assessment of roadway impact fees shall be at a rate of $702.00 per service unit for service area 1 and $616.50 per service unit for service area 2. When this happens, it is known as a scrivener error. This ordinance makes record of the above -referenced scrivener error to avoid confusion over the dollar amount of the intended assessment. The term "active' in this subsection means currently serving as a City employee or volunteer and not on leave. The term "active" does not include members of an auxiliary police or fire association, unless the member of such auxiliary organization is also an active City employee or active volunteer members of the police department or fire department. (d) Within 30 days after the effective date of this ordinance and within 30 days of the date that any Emergency Management Coordinator Permanently ceases to serve in such role, or as soon as practicable thereafter, the Emergency Management Director in consultation with the Chief Executive may recommend for the City Council's consideration one or more eligible persons to serve as Emergency Management Coordinator. (e) Within 30 days of receiving any such recommendations: (1) the City Council shall nominate one or more eligible persons —who may be but are not required to be the person(s) recommended under subsection (d)—to serve as Emergency Management Coordinator; (2) the Emergency Management Director shall designate the person (or one of the persons, as applicable) nominated by the City Council to serve as Emergency Management Coordinator; and (3) the Emergency Management Director shall provide written notice to the Chief Executive of the name, address, and telephone number of the person designated to be the Emergency Management Ordinance. (f) If for any reason the Emergency Management Director does not designate an Emergency Management Coordinator within the time period set forth in subsection (e), then the City Council must as soon as practicable thereafter designate an eligible person to serve as Emergency Management Coordinator, and that person shall serve until ceasing to serve in accordance with this section. (q) At the time that an Emergency Management Coordinator for any reason ceases to serve as Emergency Management Coordinator, then a new Emergency Management Coordinator shall be designated using the procedures set forth in subsections (d) and (e). Savings, Severability and Repealing Clauses All ordinances of the City in conflict with the provisions of this ordinance are repealed to the extent of that conflict, except that unless and until an Emergency Management Coordinator is designated in accordance with this Ordinance, the provisions of Ordinance 514-2010 that designate the Chief Executive as the Emergency Management Coordinator shall remain in effect. If any provision of this ordinance shall be held to be invalid or unconstitutional, the remainder of such ordinance shall continue in full force and effect the same as if such invalid or unconstitutional provision had never been a part hereof. Section 1. Summary A Fireworks Display to be held inside the City's corporate limits at the Anna Middle School on July 4th, 2019, in accordance with the provisions of this Agreement. Section 2. Definitions Meanings. For purposes of this Agreement, the following meanings shall apply: City shall mean the City of Anna, Texas. GACC shall mean the Greater Anna Chamber of Commerce, Incorporated. Fireworks Display shall mean a pyrotechnics display —properly and timely permitted by the Fire Marshal under The Anna City Code Part II, Article 21, Section 4.04 (or other applicable provisions) —to be held inside the City's corporate limits on July 4, 2019 for the purpose of public entertainment and for the purposes stated in the resolution adopted by the City approving of this Agreement. Section 3. General Requirements The Fireworks Display must be held within the City's corporate limits at a location approved by the Fire Marshal. The Fireworks Display must be open to the public without any charge. In written advertisements publicizing the Fireworks Display, the GACC will include the following language: "This Fireworks Display is specially permitted under the Anna City Code Part II, Article 21, Section 4.04. Possession of or use of fireworks within City limits and within 5,000 feet of City limits without a written permit granted by the Fire Marshal is a violation of law carrying fines for violations of up to $2,000." Section 4. Licenses and Permits The GACC shall obtain and pay for any and all permits, licenses, disposal fees, or any other costs required for the Fireworks Display and to fulfill this Agreement. The GACC must comply with all federal and state laws, and local ordinances while organizing and participating in the Fireworks Display. Section 5. Independent Contractor Status/ Liability/ Indemnity It is expressly understood and agreed that the City has no right of control, supervision, or direction over any work performed by the GACC relating in any way to the GACC's undertaking, promoting, operating, and performance of any other activity related to the Fireworks Display including but not limited to its employees or its subcontractors, nor does the City have any control, supervision or direction of the means, methods, sequences, procedures, and techniques utilized to conduct the Fireworks Display. There shall be no joint control over the Fireworks Display. The GACC agrees to fully defend, indemnify and hold harmless the City from any claim, proceeding, cause of action, judgment, penalty, or any other cost or expense arising or growing out of, associated or in connection with the Fireworks Display. The indemnification includes, but is not limited to, attorney fees incurred by the City in defending itself or in enforcing this Agreement. By entering into this Agreement, GACC waives all rights and remedies in law or in equity except to seek enforcement of specific performance of the obligations under this Agreement. This provision is not intended to and does not waive any of the City's governmental immunities, including immunity from suit and liability. It is expressly understood and agreed that any participation in the presentation of or conducting of the Fireworks Display by any City Official or City employee is not authorized by the City and shall not be authorized by the City, unless such authorization is by written agreement, duly adopted by the City. THE GACC's DUTIES TO DEFEND, INDEMNIFY, AND HOLD HARMLESS THE CITY EXPRESSLY APPLY EVEN IF A CLAIM, PROCEEDING, CAUSE OF ACTION, JUDGMENT, PENALTY, OR ANY OTHER COST OR EXPENSE ARISING OR GROWING OUT OF, OR ASSOCIATED IN ANY WAY WITH THE FIREWORKS DISPLAY IS CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF ANY CITY OFFICIAL OR EMPLOYEE. THE OBLIGATIONS UNDER THIS SECTION 5 OF THIS AGREEMENT SHALL SURVIVE ANY TERMINATION OF THIS AGREEMENT. Section 6. Insurance GACC shall procure and maintain for the duration of the contract insurance to cover claims for injuries to persons or damages to property, which may arise from or in conjunction with the presentation of or conducting of the Fireworks Display or in any way related to the GACC's undertakings performed in connection with the Fireworks Display, including but not limited to coverage for GACC, its agents, representatives, employees, subcontractors, volunteers, and other participants. The form, coverage and limits of such insurance, together with the underwriter thereof in each case, must be acceptable to the City and the Fire Marshal but regardless of such acceptance it shall be the responsibility of the GACC to maintain adequate insurance coverage at all times, and to require that each contractor, vendor, or other participant in the Fireworks Display does likewise. Failure of the GACC to maintain adequate coverage shall not relieve the GACC of any contractual responsibility or obligation. Each policy shall name the City as an additional insured and provide that there will be no alteration or modification which reduces coverage in any way prior to 30 days written notice being given to the City. A copy of each policy, or at the City's discretion, a certificate of insurance, shall be filed by GACC with the City Secretary. Proof of adequate coverage must be provided to the City as soon as practicable after this Agreement becomes effective, and GACC is encouraged to discuss the limits and types of coverage that will be acceptable to the City and Fire Marshal before submitting such proof to the City to reduce the potential that the City or Fire Marshal rejects same as insufficient. Section 7. Amendment This Agreement may not be amended except pursuant to a written instrument signed by both parties. Section 8. Section 9. No Waiver of Immunity; No Third -Party Beneficiaries Nothing in this Agreement waives any governmental immunity available to the City under Texas law. The provisions of this Agreement are solely for the benefit of the parties hereto and are not intended to create or grant any rights, contractual or otherwise, to any other person or entity. Section 10. Entire Agreement This Agreement represents the entire and integrated Agreement between the City and GACC and supersedes all prior negotiations, representations and/or agreements, either written or oral with respect to the Fireworks Display. Section 11. Governing Law and Venue This Agreement shall be governed by the laws of the State of Texas as to interpretation and performance. Any and all legal action necessary to enforce this Agreement shall be brought in a court of competent jurisdiction in Collin County, Texas. Section 12. Severability The provisions of this Agreement are severable. In the event that any paragraph, section, subdivision, sentence, clause, or phrase of this Agreement shall be found to be contrary to the law, or contrary to any rule or regulation having the force and effect of the law, such decisions shall not affect the remaining portions of this Agreement. Section 13. Contract Interpretation This Agreement is the result of negotiation between the parties, and shall, in the event of any dispute over the meaning or application of any portion thereof, be interpreted fairly and reasonably, and not to be more strictly construed against one party than another, regardless of which party originally drafted the section in dispute. Section 14. Force Majeure If a party is prevented or delayed from performing any of its obligation hereunder due to a natural or manmade event or condition not caused by such party and beyond such party's reasonable control, then such party's performance of those obligations shall be suspended until such time as the event or condition no longer prevents or delays performance. If any event or condition results in the creation of amounts of refuse in excess of ordinary amounts, then the parties shall discuss, but shall not be bound to conclude, terms and conditions for collection of those excess amounts. Section 15. Assignment It is understood and agreed that GACC shall not assign, sublet, or transfer any of the rights and duties under the terms of this Agreement without the prior written approval of the City. Section 16. Effective Date This Agreement shall be effective upon the date first stated herein, and performance of such Agreement shall begin as soon thereafter as practicable, or as specified herein. City Council Agenda Staff Report Meeting Date: 5/28/2019 Consider/Discuss/Action on a Resolution Approving the Governance Guide (Ryan Henderson) SUMMARY: During the process of the development of the City of Anna Strategic Plan: 2019-2024-2034, Lyle Sumek of Sumek Associates led a discussion with the City of Anna, City Council on the formation of a City of Anna Governance Guide; a plan of protocols on how Council can best conduct business with the City Manager and staff. The protocols were devised by City Council and then discussed in an open forum led by Lyle Sumek of Sumek Associates. Protocols listed within the City of Anna Governance Guide include: • Simple Information Requests • Research on a Topic • Neighbor Service Request • Agenda • Urgent Information • Employee Contact • Email • Representative/Liaison Though the City of Anna Governance Guide was developed during the process of the City of Anna Strategic Plan: 2019-2024-2034, staff recommends approving this document as a separate resolution from the resolution approving the strategic plan as the document will serve as a form of policy for how business is conducted between the City Council and City Staff.
