Call to Order 2. Roll Call and Establishment of Quorum. 3. Discussion of update on parks improvement projects. 4. Discussion of North Texas Groundwater Conservation District. 5. CLOSED SESSION (EXCEPTIONS): Under Tex. Gov't Code Chapter 551, the City Council may enter into closed session to: a. discuss or deliberate the purchase, exchange, lease, or value of real property (Tex. Gov't Code §551.072); b. consult with legal counsel on matters in which the duty of the attorney to the governmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Chapter 551 of the Government Code (Tex. Gov't Code §551.071); c. Discuss or deliberate Economic Development Negotiations: (1) To discuss or deliberate regarding commercial or financial information that the City Council has received from a business prospect that the City Council seeks to have locate, stay, or expand in or near the territory of the City of Anna and with which the City Council is conducting economic development negotiations; or (2) To deliberate the offer of a financial or other incentive to a business prospect described by subdivision (1). SUMMARY: on May 27, 2009 Governor Perry signed SB 2497 into law which authorized the creation of the North Texas Groundwater Conservation District. The District will encompass Collin, Cooke, and Denton Counties. The statute contemplates that the District will be governed by an initial board of nine temporary Directors appointed by the Commissioners Court of each participating County. One director will be selected from a slate of not more than three nominees submitted by the largest municipal groundwater producer in the county. The Collin County Commissioners Court has asked us to submit a slate of three names in priority order by Friday, July 31, 2009. To be eligible to serve as a director, a person must be a registered voter in the appointing county. The City of Anna is the largest municipal groundwater producer in Collin County so one of our nominees will be selected to serve on the Board. RECOMMENDATION: The ground water district board will have the power to regulate ground water production within the three counties covered by the district. Operating costs for the district will be assessed to the ground water producers of which Anna is one of the largest. Those costs will result in an added charge to all City of Anna utility customers. Because of the potential operational and financial impact on the City, Staff recommends that the City Manager or a member of the City Council serve as the City's representative on the board of directors as they would be in the best position to evaluate the impact that actions ofthe board will have on our utility operations. SUMMARY The Collin I Grayson County Municipal Alliance (CGMA) is an organization of local governments whose primary purpose is to identify common concerns of its members and pursue solutions to those concerns. The City of Anna along with the cities of Melissa, Van Alstyne. and Howe are members of the Alliance. Each city is represented in the Alliance by the Mayor or another member of the City CounciL Former Mayor Pelham has previously represented the City. Since he is no longer on the City Council. another representative needs to be appointed.
