A RESOLUTION OF THE CITY OF ANNA, TEXAS, AUTHORIZING THE CITY
MANAGER TO EXECUTE PURCHASE ORDERS IN THE AMOUNT NOT TO EXCEED
FIVE HUNDRED SIXTY-SEVEN THOUSAND DOLLARS ($567,000.00) TO GARNEY
COMPANIES, INCORPORATED FOR THE PRECONSTRUCTION AND
PROCUREMENT SERVICES REQUIRED FOR THE 4-MILLION GALLON PER DAY
PHASE AT THE HURRICANE CREEK REGIONAL WASTEWATER TREATMENT
PLANT; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Hurricane Creek Regional Wastewater Treatment project is identified
as a Community Investment Program construction project in the City of Anna; and,
WHEREAS, the City completed a publicly advertised request for proposal process for
Construction Manager At Risk Services for the Hurricane Creek Regional Wastewater
Treatment Plant project, and opened the proposals on June 29, 2023; and,
WHEREAS, Council awarded the contract to Garney Companies, Incorporated to
represent the City of Anna as the Construction Manager At Risk for the project in
Resolution 2023-07-1495 on July 25, 2023; and,
WHEREAS, funding for the project, including the above packages, is included in the
adopted Fiscal Year 2024-25 Budget, as shown in the City of Anna Capital
Improvement Plan; and,
WHEREAS, Garney Companies, Incorporated will perform pre -construction and
procurement services required to complete the full 4-million gallon per day phase, as
advertised in the original request for proposal advertisement.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ANNA, TEXAS THAT:
Section 1. Recitals Incorporated
The recitals above are incorporated herein as if set forth in full for all purposes.
Section 2. Authorization of Payment and Funding.
That the City Council of the City of Anna hereby authorizes the City Manager to execute
a purchase order in the amount not to exceed $567,000 to Garney Companies,
Incorporated for the pre -construction and procurement services identified in Exhibit A.

RE: HCRWRF 4 MGD Expansion — Pre -Construction and Procurement Services Proposal
Mr. Smith,
Garney Companies, Inc ('Garvey") is excited to begin the next phase of the HCRWRF project and is
pleased to provide the following proposal to add the Pre -Construction and Procurement Services for the
HCRWRF 4 MGD Expansion to Garney's existing CMAR Contract.
Pre -Construction Services Fee in the amount of $415,000.00. This includes all costs and expenses in
accordance with the Contract Documents as described in section 010101 -Construction Manager at
Risk Services" sub -section 2.0 Pre -Construction Services.
Procurements Services Fee in the amount of $152.000.00. This includes all costs and expenses in
accordance with the Contract Documents as described in section 010101 -Construction Manager at
Risk Services" sub -section 3.0 Procurement Services.
Pre -Construction services shall include coordination with Kirnley-Horn and The City of Anna, procurement
planningand initial rough order of magnitude estimate, consultation during design development.
Constructability reviews, schedule development. and full cost estimates will be done at 60!, and 90':,
design levels.
In the event the construction of the "HCRWRF 4 MGD Expansion" can be added to Gamey's contract via
an Amendment through the change order process in lieu of being solicited via a public advertisement.
the above Procurement Services Fee can be waived.
Garney is excited about the continued opportunity to work with The City of Anna for all your needs for the
development of the HCRWRF 4 MGD Expansion. The proposal price is valid for 30 calendar days.
