Gov't Code Chapter 551, the City Council may enter into closed session to discuss any items listed or referenced on this agenda under the following exceptions: a. consult with legal counsel regarding pending or contemplated litigation and/or on matters in which the duty of the attorney to the governmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas dearly conflicts with Chapter 551 of the Government Code (Tex. Gov't Code §551.071). b. Discuss or deliberate Economic Development Negotiations: (1) To discuss or deliberate regarding commercial or financial information that the City Council has received from a business prospect that the City Council seeks to have locate, stay, or expand in or near the territory of the City of Anna and with which the City Council is conducting economic development negotiations; or (2) To deliberate the offer of a financial or other incentive to a business prospect described by subdivision (1). SUMMARY: The City Council has previously expressed an interest in meeting two times per year with the various Council appointed Boards and Commissions. The last joint meeting was held on January 30. Normal terms expire at the end of June, and new appointees will not take office until July. Between regular and budget related meetings, the Council will meet on July 27, August 3, August 10, August 20, and August 24, and September 7, September 14, and September 28. Given the number of additional meetings required for adoption of the budget, The Council may want to wait until October to hold the mid-year joint meeting. If you don't want to wait until October, I would recommend meeting on Saturday July 17 from 9:00 a.m. to noon. SUMMARY: The North Central Texas Council of Governments is hosting a Mayors and Councilmembers Workshop prior to the General Assembly Meeting on Friday June 18 in Arlington. The cost is $50 per person for lunch only and $75 per person for the workshop and lunch. The attached Resolution authorizes the payment and reimbursement of expenses incurred by members of the City Council who choose to attend this event. RECOMMENDATION: Staff recommends approval of this Resolution. SUMMARY: During the May 25 City Council meeting, the City Council instructed Staff to place on the next Council agenda an action item for a City sponsored public fIreworks display on July 4th. The Greater Anna Chamber of Commerce (GACC) has experience producing fIreworks displays and has agreed to produce a public display for the City on the evening of July 4. The cost of the show will be $3,000 for the fIreworks and $524.55 for the insurance. The Anna Community Development Corporation (CDC) has indicated that it would be open to participating in the funding of this event; however, they will not meet to take action until June 10. In lieu of fInancial participation by the CDC, the City will provide the full fInancial contribution to the Chamber and will accept reimbursement from the CDC in the event they agree to support the event. Funds to support this event will be taken from one of more of the accounts in the City Council's Services budget. The attached Resolution authorizes the City Manager to execute an Agreement with the GACC and provide funding for the event. RECOMMENDATION: Staff recommends approval ofthis Resolution. ItemNo.-.L City SecretaIy's use only City of Anna City Council Agenda Staff Report Council Meeting: June 8, 2010 Staff Contact: Philip Sanders Account Code #: _________ Budgeted Amount: _________ Exhibits: DYes DNo AGENDA SUBJECT: ConsiderlDiscussl Action regarding an Ordinance to temporarily suspend certain, declarations, prohibitions, restrictions, and requirements in Part II, Article XXI, Section 4 of the Anna City Code of Ordinances. SUMMARY: During the May 25 City Council meeting, the City Council instructed Staff to place on the next Council agenda an Ordinance that would temporarily remove the prohibitions and restrictions on the possession and use of fireworks within the city limits on July 4, 2010. The attached Ordinance essentially allows any person to possess and use fireworks on private property within the City limits and within 5,000 feet outside city limits on July 4,2010 between the hours of 10:00 a.m. and 11 :00 p.m. without violating Part II, Article XXI, Section 4 of the Anna City Code of Ordinances. If the ordinance is approved, persons who choose to use fireworks must still observe the Noise Regulations in Article XXIX of the Anna Code and are subject to any other State law that prohibits disturbing the peace. The use of public property including street rights-of-way for private fireworks displays is prohibited. RECOMMENDATION: Staff does not recommend approval of this Ordinance. We believe that the current prohibitions in the City's Code serve to protect the health, safety, and general welfare of the public, and that a temporary suspension of these regulations could endanger not only the participants but also non-involved persons and their property. Our police and fire departments already respond to numerous calls for service during this holiday. We are concerned that the Ordinance will result in even more calls for service that could involve more serious situations (fires, injuries) that will overburden our already busy public safety employees and volunteers.
