Item 6. Annexation of 40 acre tract owned by A. W. Powell
Lee Lawrence of Southwest Consultants was recognized to discuss the item. He said that
property owner was requesting annexation of a 40 acre tract located on the north side of FM
Highway 455. The property is bordered on the west by the Anna ISD tract on the west and is
approximately one-half mile east of the intersection of U. S. 75 and FM 455. The owner desires
annexation so that the property can be developed for single family residential and commercial
uses. The Planning and Zoning Commission has unanimously recommended that the tract be
annexed. The area is within the City's extraterritorial jurisdiction and is adjacent to the existing
city limits, which run along FM 455,
Mr. Don Collins, representing the owner, was recognized and noted that the tract is adjacent to
the approximately 80 acre tract that the City Council annexed and zoned at its regular meeting
in May, 2001. He said that the two properties would be developed together. After brief
discussion, '241 0=-`i 8ved that the property be annexed. The motion was seconded by

Item 7. Public Hearing: Request for zoning of 40 acre tract owned by A. W. Powell from "Not
Zoned" (not inside City) to "Planned Development — Single Family Residential and Commercial".
Lee Lawrence of Southwest Consultants was recognized to discuss the item. He said that
property owner was requesting a PD zoning of the acre tract located on the north side %J FM
Highway 455 (W. White Street). This zoning would provide flexibility in the development of the
property that would not be available under terms of the existing zoning ordinance. The property
is bordered on the west by the Anna ISD tract and is approximately one-half mile east of the
intersection of U. S. 75 and FM 455. The owner anticipates selling the property t(fa developer
who intends to utilize the property for single family residential and light commercial
development. The request is for a Single Family Residential Planned Development because the
developer intends to plat the tract for lots which do not meet the City's current minimum
requirements for lot size, setbacks, and lot coverage. The commercial area within the tract will
be located along the FM 455 frontage. The owner had originally requested that C-2 uses be
allowed within the area but upon recommendation of the Planning and Zoning Commission has
agreed to accept a PD that includes only C-1 uses.

Don Collins, representing the owner, was recognized to further discuss the proposed zoning
and answer questions. He noted that the development will meet other City requirements for R-1
Single Family Residential zoning and that the developer intended to sell lots to one or possibly
two homebuilders. The tract would contain approximately 175 lots. He noted that there would
be a homeowner's association that would be responsible for maintaining the appearance of the
subdivision. He noted that the development will meet other City requirements for R-1, including

masonry requirements, and will include sidewalks, perimeter fencing, landscaping along FM
455, and other amenities. He noted that the tract would be combined with the recently annexed
and zoned 79.92 acre tract that is adjacent to and west of the Powell tract, with the two tracts
being developed as a single entity. The combined development would contain approximately
325 — 350 lots.
There being no further questions regarding the zoning request, the public hearing was closed fcv�

Item 8. Request for zoning of 40 acre tract owned by A. W. Powell from "Not Zoned" (not inside
City) to "Planned Development— Single Family Residential and C-1 Commercial".
Lee Lawrence of Southwest Consultants was recognized to discuss the item. He said that the
zoning request had been described in the public hearing (Item 7 above). He also noted that the
Planning and Zoning Commission had unanimously voted to recommend the approval of the
zoning request. An ordinance providing details on the development requirements for the PD
has been prepared for review and acceptance by the council. After brief discussion, L 15+
moved that the property be zoned as Planned Development for single family residential and C-1
commercial uses with provisions as detailed in the ordinance as presented. The motion was
seconded byThe motion passed unanimously.

Item 9. Facilities Agreement between City of Anna and Anna 67 Joint Venture
Lee Lawrence of Southwest Consultants was recognized to discuss the item. He noted that in
the absence of impact fees or other means of insuring that development costs were not passed
through to existing residents and property owners the City was using agreements between the
City and developers to specify the terms under which individual developments paid for off -site
improvements and other development costs. Because the Anna ISD and A. W. Powell tracts
had only recently been annexed and zoned and because some development details had not
been completely resolved, Mr. Lawrence asked the council to give the Mayor authority to
negotiate the Facilities Agreement with Anna 67 Joint Venture, which is developing these
properties. This is the arrangement that had been used in developing the Facilities Agreement
with the owners of the Oak Hollow Subdivision. After brief discussion,'? ed that
the Mayor be authorized to neg iate a Facilities Agreement with Anna 67 Joint Ventu e.
Item 10. Preliminary plat for Meadow Ridge Addition
Lee Lawrence of Southwest Consultants was recognized to discuss the item. He said that M &
M Joint Venture was requesting a preliminary plat for the Meadow Ridge Addition. Meadow
Ridge is located on the west side of State Highway 5 (N. Powell Parkway), north of the Anna
High School and between the Rudman Partnership tract on the south and the Cunningham tract
on the north. The project consists of 36.05 acres and 158 lots. Lots have a minimum size of
7,200 square feet, a variance from the zoning ordinance that was approved through the PD that
governs the development of the subdivision. The subdivision plat conforms to the requirements
of the City's Subdivision Ordinance. The Planning and Zoning Commission unanimously voted
to recommend the approval of the plat.

Item 1 �. Preliminary plat for Creekside Subdivision
Lee Lawrence of Southwest Consultants was recognized to discuss the item. He said that Anna
67 Joint Venture was requesting a preliminary plat for the Creekside Subdivision. Creekside
Subdivision is located on the north side of W. FM Highway 455 (W. White Street), along the east
side of Throckmorton Creek. The project consists of 79.92 acres and 195 lots. Lots have a
minimum size of 6,000 square feet, a variance from the zoning ordinance that was approved
through the PD that governs the development of the subdivision. The subdivision plat conforms
to the requirements of the City's Subdivision Ordinance, The Planning and Zoning Commission
unanimously voted to r, ommend the approval of the plat.

Item 13. Appointments to Planning and Zoning Commission
Lee Lawrence of Southwest Consultants was recognized to discuss the item. He said three
regular positions and one alternate position on the Planning and Zoning Commission need to be
filled. He also said that the Planning and Zoning Commission at its meeting of June 5, 2001,
had made the following recommendations to the City Council regarding appointments to the
PZC.

ORDINANCE NO. 2001-11
AN ORDINANCE OF THE CITY OF ANNA, TEXAS, AMENDING THE ZONING
MAP OF THE CITY OF ANNA TO PROVIDE FOR REZONING OF CERTAIN
PROPERTY; PROVIDING A REPEALER CLAUSE; AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, the owner of the property described in Exhibit A attached hereto has requested a
certain zoning for said property; and
WHEREAS, the City Council of the City of Anna has given the requisite notices and afforded a
full and fair hearing to all property owners generally and to all persons interested in and situated
in the affected area and in the vicinity thereof, the City Council of the City of Anna has
concluded that the Zoning Ordinance of the City of Anna should be amended as follows:
Section 1.
The Comprehensive Zoning Ordinance of the City of Anna, Texas, is amended by zoning the
tract described in Exhibit A, attached hereto and made an integral part of this Ordinance, as
Planned Development (PD). The Planned Development shall include the following elements:
Section 2.
The following shall pertain to the area{s) identified on Exhibit A as "PD-Residential":
Permitted Uses:
The permitted uses will be the same as those permitted in the "R-1 —Single Family
Residential" zoning district of the City of Anna Zoning Ordinance.
Setbacks:
Minimum front yard — 20 feet; however, covered porches and bay windows may
encroach up to five (5) feet into the required setback.
Minimum side yard —five (5) feet; however, ten (10) feet shall be required on a comer lot
adjacent to a side street and garages that face a side street must maintain a
minimum setback of twenty (20) feet.
Minimum rear yard —15 feet.
Lot Dimensions:
The minimum dimensions for residential lots will be as follows:
Minimum lot area — 6,000 square feet.
Minimum lot width — 50 feet.
Minimum lot depth — 90 feet.

The minimum single-family dwelling unit area shall be 1,200 square feet.
Maximum Height:
Except as provided below, the maximum building height for any residential structure shall be 2
%2 stones or 35 feet, whichever is greater (excluding chimneys and vent stacks, cupolas, entry
features, skylights, and other architectural features not intended for occupancy or storage).
Notwithstanding the foregoing, however, all residential structures located on a lot with a rear
yard that abuts a street identified on the City of Anna Thoroughfare Plan as a collector or
thoroughfare shall be limited to a maximum height of one story.
Maximum Lot Coverage:
The maximum residential lot coverage shall be fifty percent (50%). "Coverage" means the
percentage of lot area covered by a roof or other structure (including accessory structures);
however, roof eaves and other ordinary building projections are excluded.
Off -Street Parking
A minimum of two (2) enclosed off-street parking spaces will be provided for each dwelling unit
(which spaces must be located on the same lot as the dwelling unit).
Masonr r�Requirements:
Exterior building materials for residential structures shall be at least sixty percent (60%)
masonry. "Masonry" means brick, stone, pre -cast stone, stucco, cement fiber siding, and any
other similar veneer material attached to an outside wall.

Garages:
Garages may be front facing and there is no requirement for "swing" driveways.
Sidewalks:
Sidewalks will be installed along the street frontage of all residential lots prior to the issuance of
a final certificate of occupancy for each house constructed thereon.
Perimeter Fencing
Fences located along the outside perimeter of the subdivision, if constructed of wood, shall be
treated with a preservative to extend the life of and enhance the appearance of the fence. The
maintenance of such perimeter fences shall be the responsibility of a private homeowner
association.
Section 3.
The following shall pertain to the areas) identified on Exhibit A as "PD-Commercial":
All regulations in the City of Anna Zoning Ordinance applicable to the "C-1 Restricted
Commercial Distract" shall apply, except as follows:
Maximum Height.
The maximum building height will be the same as required by the referenced "C-2" zoning
district, excluding (a) chimneys and vent stacks, church spires, cupolas, entry features,
skylights, and other architectural features not intended for occupancy or storage, (b) flag poles
and similar devices, and (c) eating and air conditioning equipment, solar collectors, and similar
equipment, fixtures, and devices, provided such equipment, fixtures, and devices are screened
from view form any public street.

Maximum Lot Coverage:

This Ordinance shall take effect immediately from and after its passage and approval, as
provided by laws of the State of Texas.

AN ORDINANCE ANNEXING THE HEREINAFTER DESCRIBED TERRITORY TO
THE CITY OF ANNA, COLLIN COUNTY, TEXAS, AND EXTENDING THE
BOUNDARY LIMITS OF SAID CITY SO AS TO INCLUDE SAID HEREINAFTER
DESCRIBED PROPERTY WITHIN THE CITY LIMITS AND ADOPTING A SERVICE
PLAN FOR SAID TERRITORY AND ITS INHABITANTS
WHEREAS, certain property owners have

WHEREAS, after hearing the arguments for and against the annexation, the City
Council has voted to annex said territory to the City of Anna, Texas; now therefore
Section I. The land and territory described in Exhibit A, attached hereto and hereby
made an integral part of this Ordinance, lying adjacent to and adjoining the present
boundaries of the City of Anna, Texas, is hereby added and annexed to the City of
Anna, Texas, and said territory hereinafter described shall hereafter be included within
the boundary limits of the City of Anna, Texas, and the present boundary limits of such
city are altered and amended so as to include said area within the corporate limits of the
City of Anna, Texas.
Section 2. The above described territory and the area so annexed shall be a part of the
City of Anna, Texas, and the inhabitants thereof, if any, shall be entitled to all of the
rights and privileges of all citizens and shall be bounded by the acts, ordinances,
resolutions, and regulations of the City of Anna, Texas.
Section 3. The service plan providing for the extension of municipal services into the
annexed area and attached to this ordinance as Exhibit B is hereby adopted.
The City Secretary is hereby directed to file with the County Clerk of Collin County,
Texas, a certified copy of this ordinance.

Code Enforcement includes actives of inspecting properties and buildings and
securing compliance with adopted ordinances and codes relative to the following.
(1) Tall grass and weeds (except for agricultural and ranch properties)
(2) Trash and debris
(3) Stagnant water and unsanitary conditions
(4) Junked vehicles and parts
(5) Junked appliances and materials
(6) Enforcement of the Minimum Housing Code pertaining to maintenance
and habitability of existing housing
City code enforcement activities will be conducted in newly annexed territories under
the same terms and on the same schedule and using the same procedures as for other
areas inside the corporate limits.
Code enforcement services will be implemented immediately upon the effective date of
this ordinance.

Refuse Service
Citizens in newly annexed areas will receive solid waste (trash), brush, and refuse
service in accordance with existing city ordinances. Generally, the ordinances provide
residential pick-up service of plastic bags and metal cans of not larger than 20 gallons in
size at curbside or streetside once per week for a fee which is established by the city
council. Present solid waste collection service routes will be extended to cover annexed
areas.
These services will be implemented tivithin sixty (60) days of the effective date of the
ordinance of which this service plan is a part. w

The function of planning, zoning, and mapping is to implement ordinances relating to
zoning classifications within the City and to provide mapping resources.
Zoning functions include the following.
(1) Provide proper zoning classification of properties within the City. Zoning is
a tool to designate the uses of property, such as residential, business,
agricultural, industry, etc. Proper zoning ensures the best use for the
property and, at the same time, protects adjacent properties from mixed
uses that reduce property value and lower the quality of life for adjacent
property owners and residents. It also regulates parking, building heights,
lot coverage, noise pollution, set -backs, and regulations relating to the use
of property.
(2) Enforce zoning ordinances relating to uses permitted, parking, lot
coverage, minimum building area, storage, heights, and other items.
(3) Implement and enforce subdivision anti plat requirements.
(4) Provide assistance to citizens building on their property and handle
complaints relating to land use and zoning.
Mapping and drafting functions include the following:
(1) Provide mapping resources of new territories, zoning, streets, water and
sewer lines, easements, right-of-ways, subdivisions, lots, and other related
matters.
(2) Assist citizens in matters related to their properties and maps containing
requested information.
These services will be provided to residents and property owners in newly annexed
territories on the some basis as they are provided to residents and property owners in
the existing incorporated area.
Planning, zoning, and mapping services will be implemented immediately upon the
effective date of this ordinance.

The City is served by the Anna Volunteer Fire Department. Fire protection services
provided by the Anna Volunteer Fire Department to the City include response to fire
calls and inspection of commercial and industrial structures for code violations. All fire
protection services provided by the Anna Volunteer Fire Department within the existing
corporate limits will be provided within the newly annexed area upon the effective date
of the annexation. Volunteers are available for consultation on fire prevention on
request by citizens of the community.
Fire protection services will be implemented immediately upon the effective date of this
ordinance.

The street maintenance function is primarily supported from ad valorem (property)
taxes. Maintenance activities are determined by the level of funding and the need for
maintenance as determined by the city council. Once the annexation of property
included in this ordinance has been completed, all streets, roads, and bridges included
in the annexed area will be added to the City's street maintenance program. Roadways
in the newly annexed area will receive equal consideration with regard to maintenance
as those within the existing corporate limits.
Street maintenance services will be implemented immediately upon the effective date of
this ordinance.

Citizens in newly annexed areas will be offered sanitary sewer service in accordance
with existing City ordinances. Generally these ordinances state that the customer must
bear the cost of construction of sewer system facilities to a point where a suitable
connection to the City's existing sanitary sewer service can be made. Sanitary sewer
service to an unserved area must be approved by the City Council and meet all City
zoning, subdivision, and other relevant requirements. All sanitary sewer facilities must
be constructed in accordance with Texas Natural Resource Conservation Commission,
Texas Department of Insurance, and City of Anna regulations and specifications.
The policy for private service lines will remain the same as exists in the current city
limits. That is, the City will maintain main transmission lines only. Only one connection
per structure is permitted without specific written approval from an authorized official of
the City. '
Improvements to the wastewater system are made on a priority basis in accordance
with the Wastewater System element of the Comprehensive Development Plan of the
City of Anna. This Plan is evaluated and updated periodically. Upon completion of this
annexation, the Plan will be evaluated and updated to include wastewater system
improvement needs of the annexed area as part of the overall Anna Wastewater
System Plan.
Sewer service rates will be assessed at the same rate as established for other city
customers in the same use classification.

Residents and property owners in newly annexed areas will be offered water service in
accordance with existing City ordinances. Generally, these ordinances state that the
customer must bear the cost of construction of water system facilities to a point where
suitable connection to the existing system can be made and service to the customer can
be provided. Water service facilities designed to connect an unserved area to the City's
existing system must be approved by the City Council and meet all City zoning,
subdivision, and other relevant requirements. All water mains must be constructed in
accordance with Texas Natural Resource Conservation Commission, Texas
Department of Insurance, and City of Anna regulations and specifications.
The policy for private service lines will remain the same as exists in the current Gity
limits. That is, the City will maintain water lines from the water main to the water meter.
All repairs/maintenance from the meter to the paint of usage is the property owner's
responsibility.
Improvements to the water system are made on a priority basis in accordance with the
Water System element of the Comprehensive Development Plan of the City of Anna.
This Plan is evaluated and updated periodically.
The property involved in this annexation currently receives water service from the South
Grayson Water Supply Corporation and is in the South Grayson WSC certificated area.
Therefore, the City of Anna will not provide water service to the area. Subdivision
development in the area is subject to the subdivision ordinance regulations of the City of
Anna and water service facilities in the area will be required to meet City of Anna
requirements, wherever the City's subdivision regulations are relevant.

Consider and action on recommendation of Planning and Zoning Commission regarding
annexation of 40 acre tract owned by A. W. Powell (tract located north of FM 455
approximately 0.5 miles east of intersection of U. S. Highway 75 and FM 455).
Planning and Zoning Commission recommends that City annex the referenced tract.
Public Hearing: Request for zoning of 40 acre tract owned by A. W. Powell (tract located
north of FM 455 approximately 0.5 miles east of intersection of U. S. Highway 75 and FM
455) from "Not Zoned" (not previously inside City) to "Planned Development — Single
Family Residential" and "CA Light Commercial".
Tract is located in F. T. Daffau Survey, A-288. Owner requests "Planned Development" zoning
to allow development of tract for 175 single family residential lots and commercial uses along
FM 455 frontage. Original request by owner was for "C-2" commercial zoning on FM 455
frontage; PZC recommended "C-1" zoning and owner has agreed to this change.
A public hearing is required for all zoning requests/changes. The only property within 200 feet
of the referenced tract is owned by Anna ISD and a letter was sent to Anna ISD advising the
ISD of the zoning request. City has received no response. The hearing is for the purpose of
hearing citizen comments on the zoning request.
Consider recommendation of Planning and Zoning Commission regarding zoning of 40
acre tract owned by A. W. Powell (tract located north of FM 455 approximately 0.5 miles
east of intersection of U. S. Highway 75 and FM 455) from "Not Zoned" (not previously
inside City) to "Planned Development — Single Family Residential" and "C-2
Commercial".
As noted above, the tract is located in F. T. Daffau Survey, A-288. Owner requests "Planned
Development" zoning to allow development of tract for 175 single family residential lots and
commercial uses along FM 455 frontage. Original request by owner was for 49C-2" commercial
zoning on FM 455 frontage; PZC recommended "C-1" zoning and owner has agreed to this
change.
Proposed Planned Development zoning ordinance for this tract is attached. Please note that as
a Planned Development, the residential development requirements will be those described in
the ordinance rather than the requirements described in the City's zoning ordinance.
The "C-1" area will be developed in conformity with the City's existing ordinance requirements
for the "C-1" zoning district.
Consider Facilities Agreement between City of Anna and Anna 67 Joint venture
regarding 40 acre tract currently owned by A. W. Powell (tract located north of FM 455
approximately 0.5 miles east of intersection of U. S. Highway 75 and FM 455).
The Facilities Agreement is in final negotiation stage and will be available for discussion/action
at the City Council meeting.

Consider recommendation of Planning and Zoning Commission regarding preliminary
plat for Meadow Ridge Addition, 36.05 acre tract, owned by Bently and Paula Powell,
developer is M & M Joint Venture.
Planning and Zoning Commission recommends approval of preliminary plat for Meadow Ridge
Addition. With exception of total lot size, the subdivision meets City plat requirements. (Lot size
is minimum 7,200 square feet; City minimum requirement is 10,000 square feet). The plat has
been reviewed by City's consulting engineer.
Consider recommendation of Planning and Zoning Commission regarding preliminary
plat for Creekside Subdivision, 79.92 ace tract, owned by Anna ISD, developer is
Landmark Interest.
Planning and Zoning Commission recommends approval of preliminary plat for Creekside
Subdivision. The subdivision diverges from the City's subdivision and zoning ordinances
relative to lot sizes and setback requirements. The City Council approved the lot sizes and
setback requirements through passage of the zoning ordinance for the area at its meeting of
May 8, 2001.
The plat has been reviewed by City's consulting engineer. The engineers recommendations
will be available for your review and discussion at the City Council meeting.
Consider recommendation of Planning and Zoning Commission regarding final plat for
two lot subdivision submitted by John Rattan and Mike Copeland, located on north side
of FM 28620
This plat is a short form subdivision, meaning that the preliminary and final platting is done in
one step. There are no City street, drainage, water, or sewer facilities to be extended to serve
the lots. Existing facilities are available and suitable to adequately serve the development.
Consider recommendations of Planning and Zoning Commission regarding appointment
to Planning and Zoning Commission.
In odd -numbered years (e.g., 2001) three regular positions and one alternate position on the
Planning and Zoning Commission are to be filled. The following recommendations have been
