A RESOLUTION OF THE CITY OF ANNA, TEXAS AUTHORIZING AND DISSOLVING THE SHERLEY TRACT PUBLIC IMPROVEMENT DISTRICT IN ACCORDANCE WITH CHAPTER 372 OF THE TEXAS LOCAL GOVERNMENT CODE; PROVIDING FOR RELATED MATTERS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Anna, Texas (the "C�"), is authorized under Chapter 372 of the Texas Local Government Code (the "Act"), to create a public improvement district within its corporate limits or its extraterritorial jurisdiction; and WHEREAS, on September 22, 2020 by Resolution No. 2020-09-798, the City Council of the City of Anna, Texas (the "City Council"), after public hearing, authorized the creation of the Sherley Tract Public Improvement District (the "District"), which District is depicted in Exhibit A and described by a metes and bounds in Exhibit B; and WHEREAS, on October 20, 2020, the owners of real property delivered to the City of Anna, Texas a petition (the "Petition") meeting the requirements of the Act and indicating: (i) the owner of more than fifty percent (50%) of the appraised value of the taxable real property liable for assessment, and (ii) the owner of more than fifty percent (50%) of the area of all taxable real property liable for assessment within the District have executed the Petition requesting that the City Council dissolve the District, as shown in the exhibits attached to the Petition; and WHEREAS, the City Council investigated and determined that the facts contained in the Petition are true and correct; and WHEREAS, after publishing notice in a newspaper of general circulation in the City in which the district is located, and mailing notice of the hearing, all as required by and in conformity with the Act, the City Council, conducted a public hearing on the advisability of dissolving the District on December 8, 2020; and WHEREAS, the City Council closed the public hearing on the advisability of dissolving the District on December 8, 2020; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS: Section 1. The findings set forth in the recitals of this Resolution are found to be true and correct. Section 2. The Peon submitted to Anna by the Peoner was filed with the City Secretary and complies with Section 372.005 of the Act. Section 3. Pursuant to the requirements of the Act, including, without limitation, Sections 372.009, and 372.011, the City Council of Anna, after considering the Petition and evidence and testimony presented at the public hearing on December 8, 2020, hereby finds and declares that the Sherley Tract Public Improvement District, which was created by Resolution No. 2020-09-798 on September 22, 2020, is dissolved for all purposes. Section 4. This Resolution shall take effect immediately from and after its passage and publication as required by law.
