HomeMy WebLinkAboutRes 12-2001ESOLUTION NO. / A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS, CONFIRMING THE HIRING OF SOUTHWEST CONSULTANTS; ACCEPTING RESPONSIBILITY FOR PAYMENT OF FEES INCURRED BY SOUTHWEST CONSULTANTS FOR WORK RELATING TO ZONING, SUBDIVISIONS, CCN BOUNDARY AGREEMENTS, FACILITY USE AGREEMENTS, ATTENDANCE OF CITY COUNCIL MEETINGS, PLANNING AND ZONING COMMISSION MEETINGS, AND CONDUCTING WORKSHOPS; CONFIRMING THAT ALL WORK WAS PERFORMED AT THE DIRECTION OF THE MAYOR, CITY COUNCIL, CITY COMMISSIONS, AND/OR THE CITY STAFF; ESTABLISHING PAYMENT ARRANGEMENTS; AND, CONFIRMING THAT THIS CONTRACT IS IN ADDITION TO ANY ONGOING INDIVIDUAL GRANT ADMINISTRATION CONTRACTS BETWEEN THE CITY OF ANNA AND SOUTHWEST CONSULTANTS. WHEREAS, the City Council of the City of Anna desires to develop a viable urban community, including decent housing and a suitable living environment and expanding economic opportunities, and WHEREAS, the City has commissioned Southwest Consultants to assist the City in the development of Zoning and Subdivision Regulations, review Zoning and Subdivision requests received by the City, develop Facility Use Agreements, CCN Boundary Agreements, attend City Council and Planning & Zoning Commission meetings, conduct periodic workshops, and provide general administrative advise to the City; and WHEREAS, it was necessary and in the best interests of the City of Anna for Southwest Consultants to delay billing and payment for an unspecified period; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS: 1. That Southwest Consultants was hired to assist the City in the development of Zoning and Subdivision Regulations, review Zoning and Subdivision requests received by the City, develop Facility Use Agreements, CCN Boundary Agreements, attend City Council and Planning & Zoning Commission meetings, conduct periodic workshops, and provide general administrative advise to the City; 2. That all work was performed at the direction of the mayor, city council, city commissions, and/or the city staff and was IN ADDITION TO work performed under various Grant Administration Contracts between Southwest Consultants and the City; 3. That the City accepts responsibility for payment of services performed by Southwest Consultants in accordance with this resolution, and that the cumulative total from May 1, 2000, to August 31, 2001, is $33,727.50 (i.e., 749.50 hours @ $45.00/hour); 4. That Southwest Consultants has been paid a total of $8,768.75 out of the $33,727.50, leaving an unpaid balance of $24,958.75; 5. That Southwest Consultants shall be paid $ C/cs8 ,4tr month h�gi gaI oavments of ram. �3 � year II; and 6. That as of this date and passage of this resolution that Southwest Consultants shall provide no further work, advise, or assistance unrelated to the Grant Administration Contracts without prior written authorization of the City Council, and that Resolution 04-2001 is declared null and void.
