HomeMy WebLinkAboutRes 2004-03-02 Request the North Texas Municipal Water District Approve Anna's RequestCITY OF ANNA, TEXAS RESOLUTION NO. 2004-03-02 A RESOLUTION OF THE CITY OF ANNA CITY COUNCIL REQUESTING THAT THE NORTH TEXAS MUNICIPAL WATER DISTRICT APPROVE THE CITY OF ANNA'S REQUEST. TO BECOME A CUSTOMER OF THE UPPER EAST FORK WASTEWATER TRANSMISSION SYSTEM /AND WASTEWATER TREATMENT SYSTEM AND EXPRESSING THE INTENT OF THE CITY OF ANNA TO ENTER INTO A CUSTOMER CONTRACT WITH THE NORTH TEXAS MUNICIPAL WATER DISTRICT FOR SAID WASTEWATER TRANSMISSION AND TREATMENT SERVICES IN THE CLEMMONS CREEK WASTEWATER OUTFALL MAIN WHEREAS, the City of Anna has received proposals to develop property in the southeastern portion of the City which is in the Clemmons Creek basin, and WHEREAS, the City of Melissa is proposing to construct an outfall wastewater outfall main serving the Clemmons Creek basin in the City of Melissa, and WHEREAS, the City of Melissa and the City of Anna have developed and executed an agreement under which the Clemmons Creek basin outfall main through Melissa will be oversized to provide for the City of Anna flow from the portion of drainage basin which will naturally flows into said outfall main, and WHEREAS, the City Anna, in conjunction with the membership of the Collin Grayson Municipal Alliance, has previously studied and proposed the consideration of a multi - jurisdiction wastewater collection and treatment system to be operated as part of or under the auspices of the North Texas Municipal Water District, and WHEREAS, the Clemmons Creek basin outfall main represents the first opportunity to begin implementation of a regional or multi jurisdiction wastewater collection and treatment system for the Cities of Anna, Melissa, Van Alstyne, and other participating entities, and WHEREAS, the North Texas Municipal Water District has indicated that sizing the Clemmons Creek outfall main to serve the entire basin would represent good regional planning and has further indicated a willingness to enter into an agreement with the City of Anna for wastewater transmission from the termination of the Clemmons Creek outfall main to the regional wastewater treatment facility and to treat the City of Anna wastewater flow into the Clemmons Creek outfall main, and WHEREAS, the City of Anna acknowledges that regional cooperation provides the most cost effective means of providing many municipal services, particularly in the environmentally sensitive areas of water treatment, wastewater treatment, and solid Waste disposal; Page 1 of 2 NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANNA, THAT: SECTION 1. The North Texas Municipal Water District (hereinafter referred to as NTMWD) accept the City of Anna as a wastewater customer for the Clemmons Creek basin through the City of Melissa Clemmons Creek outfall main previously approved by NTMWD in the City of Melissa Wastewater Transmission and Treatment Contract. SECTION 2. It is the intent of the City of Anna City Council to execute a contract with the NTMWD providing for: a. Wastewater transmission service from a point -of delivery as defined by NTMWD, but generally being at the metering station approved by NTMWD at a point along the Clemmons Creek outfall main prior its intersection with the Upper East Fork Transmission System. b. Wastewater treatment of all flow from the City of Anna through the Clemmons Creek outfall main with the metering station for City of Anna flow being reviewed and approved by NTMWD. SECTION 3. The NTMWD is further requested to pursue long-term planning for regional wastewater transmission and treatment to include the entire City of Anna planning area. SECTION 4. That copies of this Resolution may be sent to any entity needing evidence of the intent of the City Council of Anna and that the City Administrator and/or Mayor are authorized to send documents, planning data, and/or studies supporting the request and intent expressed in this Resolution.
