AN ORDINANCE OF THE CITY OF ANNA, TEXAS APPROVING ANNA RETAIL ADDITION,
BLOCK A, LOT 4, SITE PLAN.
WHEREAS, in order to provide for the orderly development of land within the Anna city limits
and extraterritorial jurisdiction, the City Council of the City of Anna, Texas (the "City Council")
has adopted Article 9.02 ("Subdivision Regulations") of the Anna City Code of Ordinances
("Anna Code"); and
WHEREAS, Anna 31 Retail, LP (the "Applicant") requests a waiver from the regulations for the
minimum driveway separation requirement from adjacent intersections as relates to the
development of Anna Retail Addition, Block A, Lot 4 (the "Property"); and
WHEREAS, the Applicant further requests a reduced landscape buffer as applies to the
Property; and
WHEREAS, the Applicant has submitted an application for the approval of the Anna Retail
Addition, Block A, Lot 4, Site Plan;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA,
TEXAS, THAT:
Section 1. Recitals Incorporated.
The recitals above are incorporated herein as if set forth in full for all purposes.
Section 2. Conditional waiver of minimum driveway separation requirement
(a) The City Council hereby waives the minimum driveway separation requirement and
reduces the separation requirement from 150 to 86 from the intersection of W. White
Street (FM 455) and Throckmorton Blvd as depicted in Exhibit A; provided, however,
that said waiver is conditional and the City Manager or the City Manager's designee
shall at all times have authority to conduct or have conducted one or more traffic
engineering studies of Throckmorton Boulevard in the vicinity of the Property and if any
such study demonstrates that the traffic volumes on Throckmorton Blvd in said vicinity
have risen to a level whereby certain turn movements into the driveway presents a traffic
safety concern the City, at its sole discretion, shall have the right to reconfigure and
reconstruct the driveway in a manner that prohibits certain turn movements. The
owner(s) of the Property shall cooperate in all reasonable ways with the City's efforts
regarding its rights under this Section 2.
(b) In granting the waiver as described in subsection (a), above, the City Council has
examined the relevant evidence and finds that:
1. Granting the waiver will not be detrimental to the public safety, health or welfare, and
will not be injurious to other property or to the owners of other property, and the
waiver will not prevent the orderly subdivision of other property in the vicinity;
2. The conditions upon which the request fora waiver/suspension is based are unique
to the Property and are not applicable generally to other property;
3. Because of the particular physical surroundings, shape and/or topographical
conditions of the Property, a particular undue hardship to the property owner would
result, as distinguished from a mere inconvenience or increased expense, if the strict
letter of the driveway separation requirement is carried out;
4. The waiver will not in any manner vary the provisions of the zoning ordinance,
comprehensive plan (as amended), or any other adopted plan(s) or ordinance(s) of
the City; and
5. The alternate proposed design will generally achieve the same result or intent as the
standards and regulations prescribed herein.
Section 3. Grant a reduced landscape buffer.
The City Council hereby grants a reduced landscape buffer of 11 feet due to:
a. The existing development to the immediate east, narrowness of the lot, and
increased building setbacks are unique circumstances.
b. The reduction does not have an adverse impact on current or future development.
c. The variance is in keeping with the spirit of the zoning regulation and will not have
an impact on surrounding land uses.
d. The variance will not have an adverse impact on public health, safety and general
welfare.
Section 4. Approval cow Plan
The City Council hereby approves the Anna Retail Addition, Block A, Lot 4, Site Plan attached
hereto as Exhibit B subject to additions and/or alterations to the engineering plans as required
by the Public Works Department.
Section 5. Savings, Severability, and Repealing Clauses.
All ordinances of the City in conflict with the provisions of this ordinance are repealed to the
extent of that conflict. If any provision of this ordinance shall be held to be invalid or
unconstitutional, the remainder of such ordinance shall continue in full force and effect the
same as if such invalid or unconstitutional provision had never been a part hereof. The City
declares that it would have passed this ordinance, and each section, subsection, clause, or
phrase thereof irrespective of the fact that any one or more sections, subsections, sentences,
clauses, and phrases be declared unconstitutional or invalid.
Section 6. Penalty.
Any violation of any of the terms of this ordinance, whether denominated in this ordinance as
unlawful or not, shall be deemed a misdemeanor. Any person convicted of any such violation
shall be fined in accordance with Section 1.01.009 of the Anna Code. Each violation is
considered a separate offense and will be punished separately.
Section 7. Publication of the Caption Hereof and Effective Date.
This ordinance shall be in full force and effective from and after its passage and upon the
posting and/or publication, if required by law, of its caption and the City Secretary is hereby
directed to implement such posting and/or publication.

Re: Anna Retail Addition, Block A, Lot 4—Driveway Spacing Waiver Request
Bluestone Partners, LLC, has submitted a preliminary plat for Anna Retail Addition, Block A, Lot
4, a new commercial subdivision located east of Throckmorton Boulevard and south of FM 455
White Street in the City of Anna, Texas.
Section 2.6 and Figure 2.3 of the City of Anna Design Standards sets the minimum driveway
spacing for non-residential driveways. Per the Design Standards, the minimum distance from
an Arterial/Collector intersection with for placement of a driveway on a Collector Road is 150-
feet.
Per the Preliminary Plat and Site Plan for the proposed development, the length from the
proposed commercial driveway to the intersection of Throckmorton Boulevard and FM 455
White Street is 86 linear feet. The developer has requested a waiver of the 150-foot
requirement for the minimum distance between commercial driveways and the street
intersection.
The City of Anna Public Works Department has reviewed the waiver request, City of Anna
Design Standards, City Ordinances, and considered any potential impacts this waiver may have
on traffic movement on Throckmorton Boulevard and in the intersection of Throckmorton
Boulevard and FM 455 White Street. Staff has also reviewed the potential negative impacts to
the development if the waiver is not granted. The decreased distance requested in the waiver
is oo feet, which is a 42./ decrease in the minimum allowable distance between a commercial
driveway and a street intersection.
Staff Findings:
• The requested waiver is for a distance reduction of 42.7%below the required minimum
spacing.
• There are existing driveways on Throckmorton Boulevard north of FM 455 and South of
FM 455 which were constructed in the past, and do not meet the 150-foot requirement.
• Per the developer, not granting the extension would likely result in the loss of the
proposed tenant.
• In the future, Throckmorton is intended to be constructed as a commercial collector
road, connecting from FM 455 to Taylor Boulevard. This is shown in the Master
Thoroughfare Plan.
• Currently Throckmorton Boulevard south of FM 455 is a dead-end paved surface which
functions solely as access to adjacent commercial properties. Traffic volumes on this
section of Throckmorton are very low, and the road is not currently functioning as a
Collector Road.
• Staff finds that the proposed driveway will not have a negative impact on traffic safety
for Throckmorton Boulevard in the current conditions. However, when Throckmorton
Boulevard is extended and functions as a commercial collector, left turning movements
into this driveway will likely cause negative impacts to the intersection of Throckmorton
and FM 455.
• See attachments A thru D included with this memo for more information.
Staff finds that the proposed layout and location of the proposed driveway is acceptable for the
current roadway conditions, but recommends adding a stipulation to the approval as follows:
The proposed driveway is approved as shown and shall be allowed to remain in place until such
time that a traffic engineering study of Throckmorton Boulevard demonstrates that the traffic
volumes on Throckmorton have risen to a level whereby the left turn movement into the
driveway presents a traffic safety concern. At such a time, the City reserves the right to
reconfigure this driveway to be right in/right out only, prohibiting left turns into the driveway.

2.5 Median Openings, Width, Location and Spacing
Arterial thoroughfares in Anna are to have raised medians. Arterials having single lane two-
way left turn lanes are discouraged and may be allowed only in special circumstances with
the approval of the City Council.
Median openings at intersections shall be from right-of-way to right-of-way of the intersecting
street, unless otherwise approved by the City's Engineer.
The width of mid -block median openings shall not be less than 60 feet, or greater than 70
feet.

2.6 Driveway Locations
Minimum standards for driveway separation accessing the same site are shown in Figure
2.3. This standard applies to all non-residential uses.
There is a minimum distance upstream and downstream from adjacent intersections within
which driveways should not be located. This separation distance varies with the classification
of street and is shown in Figure 2.3. This standard applies to all non- residential users.
At mid -block access points, there is a minimum distance from a median nose, within which
driveways should not be located. This is shown in Figure 2.3 and is equally applicable along
both major and minor arterials for non-residential uses.
2.7 Block Lengths
In general, streets shall be provided at such intervals as to serve cross traffic adequately and
to intersect with existing streets. Where no existing plats control, the blocks shall be not more
than 1,200 feet in length. Block arrangements must provide access to all lots, and in no case,
shall a block interfere with traffic circulation.
2.8 Street Intersections
More than two streets intersecting at one point shall not be allowed. All streets and
thoroughfares should intersect other streets and thoroughfares at an angle of ninety (90)
degrees unless otherwise approved by the City's Engineer.
Arterial and collector street intersections shall have property line comer clips with a
minimum tangent distance of thirty (30) feet. Residential streets shall not normally be

Council Members,
We at Bluestone Partners have submitted a Site Plan for approval. We respectfully request that this Site
Plan be approved with a waiver to Section 2.5, and Figure 2.3 of the City of Anna Design Standards sets
the minimum driveway spacing for non-residential driveways. Per the Design Standards, the minimum
distance from an Arterial/Collector intersection with a driveway on a Collector Road is 1504eet. The
decreased distance requested in the waiver is 86-feet. We have also responded to the items below with
the waiver request.
(A) Granting the waiver/suspension will not be detrimental to the public safety, health or welfare,
and will not be injurious to other property or to the owners of other property, and the
waiver/suspension will not prevent the orderly subdivision of other property in the vicinity;
Bluestone Response: To address any potential safety concerns with granting the waiver, we have
included a right-hand turn -only lane and used a small triangular island to help enforce. We
believe that under the current and future roadway conditions, this will eliminate any left (South)
turning traffic from this entrance and address the possible safety concerns. We also do not
believe that this will be injurious to other property or to the owners of other property, and the
waiver/suspension will not prevent the orderly subdivision of other property in the vicinity.
(B) The conditions upon which the request for awaiver/suspension is based are unique to the
property for which the waiver/suspension is sought, and are not applicable generally to other
property;
Bluestone Response: The condition upon the waiver request is unique to the property for which
it is sought. Due to the parcel's current roadway conditions and uniqueness to accommodate the
proposed site plan.
(Cj Because of the particular physical surroundings, shape and/or topographical conditions of the
specific property involved, a particular undue hardship to the property owner would result, as
distinguished from a mere inconvenience or increased expense, if the strict letter of these
regulations is carried out,
Bluestone Response: The waiver request is being submitted without consideration of
convenience or increased expense. The basis of the request is for site plan acceptance of a
nationally recognized pharmacy tenant and to allow drivers maneuverability within the
development.
(D) The waiver/suspension will not in any manner vary the provisions of the zoning ordinance,
comprehensive plan (as amended), or any other adopted plan(s) or ordinance(s) of the City; and
Bluestone Response: The waiver will not in any manner vary the provisions of the zoning
ordinance, comprehensive plan, or any other adopted plan or ordinance of the City.
(E) An alternate design will generally achieve the same result or intent as the standards and
regulations prescribed herein.
Bluestone Response: An alternate design will not generally achieve the same result.
In addition, we are requesting that when determining the future conversion of the driveway to an exit
only (right turn only), the traffic counts be based on 15,000 VPD.
