RESOLUTION NO. 200"9-02
A RESOLUTION BY THE CITY COUNCIL OF ANNA, TEXAS AUTHORIZING THE
ASSIGNMENT OF THE CONTRACT FOR ENGINEERING SERVICES WITH R&B
ASSOCIATES, INC., TO THE GREATER TEXOMA UTILITY AUTHORITY
WHEREAS, the Greater Texoma Utility Authority has entered into Amended and
Restated Contracts for Water Supply and Sewer Service with the City of Melissa and the City of
Anna; and
WHEREAS, the Greater Texoma Utility Authority has been requested by the Cities of
Melissa and Anna to assist in financing and construction of a new sewer outfall line utilizing
funding from the Texas Water Development Board CTWDE')'s Clean Water State Revolving
Loan Fund; and
WHEREAS, the Greater Texoma Utility Authority has sought and received a notice of
award of funding for $7,300,000 for the construction of this project, submitted the required
application to the TWDB prior to the deadline; and
WHEREAS, the TWDS requires that a contractual relationship between the Greater
Texoma Utility Authority and R&B Associates. Inc., be identified as part of the application
approval process;
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF ANNA,
TEXAS that the City of Anna hereby formally accepts the assignment of the contract which
currently exists between the City of Melissa and R&B Associates, Inc., to the Greater Texoma
Utility Authority for the purposes of compliance with the regulatory requirements of the funding
source for this project.
Upon motion by David Crim seconded by Keith Green the foregoing Resolution was
passed and approved on this 12 day of Member, 2006, by the following vote:
AYE: 7 NAY: 0 ABSTAIN: 0
