RESOLUTION NO. 2006-09-03
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS,
GIVING NOTICE OF AN OFFICIAL DETERMINATION TO ACQUIRE
PROPERTY FOR THE PURPOSE OF LOCATING WATER TAKE -POINT
FACILITIES, INCLUIDNG A METER VAULT, PUMP STATION AND
GROUND STORAGE TANK AND A UTILITY AND ACCESS EASEMENT;
ESTABLISHING PROCEDURES FOR ACQUISITION OF SAID
PROPERTY, AND AUTHORIZING NEGOTIATION FOR, AND AN OFFER
FOR, SAID PROPERTY.
WHEREAS, there is a need to provide water system improvements to benefit the City of
Anna, and
WHEREAS, it is necessary to acquire property not now owned by the City of Anna for such
water improvements; and
WHEREAS, it is necessary to establish procedures for determining the establishment and
approval of just compensation for the easement(s) to be acquired for such project; now
therefore
IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS:
t. That the City Council of the Anna, Texas, hereby officially determines that there is a
public necessity for, and the public welfare and convenience will be served by, the
acquisition of the property described in the attached "Exhibit A," and it is the intention of
the City of Anna, Texas, to acquire the property set out and described in "Exhibit A"
attached hereto and made a part of this Resolution for all purposes as part of the City of
Anna water improvement project, forthe purposes of expanding and improving the City of
Anna water system.
2. That the City Manager is hereby authorized, pursuant to the exemption of L.G.C. §
252.022(4), to contract, on behalf of the City of Anna, Texas, with professional appraisers
for appraisal services, and with attorneys and title companies for preparation of title
opinions needed by the City from time to time in connection with the acquisition of the
property, with environmental consultants as necessary to survey such property, and with
attorneys for preparation of necessary documents to institute and complete acquisition of
the property, including such documents as are necessary to institute condemnation
proceedings should such become necessary.
3. That the City Manager is hereby authorized and directed to examine the
independent appraisal reports as they are submitted to the City to determine whether said
appraisal reports are supported by sufficient data. Based upon such examination of said

appraisal reports, the City Manager shall make a recommendation to the City Council as to
establishment and approval of the amount of the just compensation for each property
4. That after consideration of said recommendation, the City Council shall establish
and approve the amount determined to be just compensation for acquisition of each
property.
5. That upon establishment and approval by the City Council of the amount of just
compensation forthe acquisition of each property, the City Manageror his/her designee is
authorized to communicate a written offer to the owner of said property for acquisition of
said property at the full amount established and determined to be just compensation, to
negotiate with said owner on behalf of the City, and to determine the amount of, and
transmit to the owner, a final offer for acquisition of said property, which may be the
amount determined by the appraisal to be just compensation for the property.
6. That the City Manager is hereby authorized to execute all documents necessary to
begin acquisition of said property on behalf of the City of Anna, Texas, and to execute all
documents necessary to acquire each easement(s) needed for said project on behalf of the
City of Anna, Texas.
That this Resolution shall take effect immediately from and after its passage.
