HomeMy WebLinkAboutRes 2006-09-05 Replacing Resolution No. 2006-07-05CITY OF ANNA, TEXAS RESOLUTION NO. 2006-09-05 A RESOLUTION OF THE CITY OF ANNA, TEXAS, ABROGATING AND REPLACING RESOLUTION NO. 2006-07-05 AND ESTABLISHING NEW PROCEDURES FOR CONDUCT OF COUNCIL MEETINGS AND FOR PLACING ITEMS ON COUNCIL MEETING AGENDAS. WHEREAS, the City Council has determined that the efficient and effective conduct of council meetings would be enhanced through more clearly defined policies for conduct of meetings; and WHEREAS, the City Council has determined that the process for consideration of suggestions by council members for future agenda Items should be clarified and better defined; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ANNA, TEXAS, THAT: Section 1. Presentations to Council a. Regular city council meeting agendas will include a `Public Comment' item. Under this item members of the audience at the council meeting are permitted to address any topic relating to City business operations. The following procedures will be folkmsed: • The speaker will state his/her name and address for the record • Remarks will be limited to three (3) minutes • The speaker may address the council only one time • The council will not respond to questions or comments by the speaker, except a council member may respond by making: (1) a statement of specific factual information given in response to an inquiry; (2) a recitation of existing poky in response to an inquiry; or (3) a motion that the item be placed on an agenda for a specified future council meeting. L Public hearings will be conducted as follows: • The petitioneriapplicant, if any, will be offered an opportunity to discuss the petitionlapplication prior to other public comment • The petitioner/applicant will state his/her name and address for the record • The petitioner/applicant will be limited to three (3) minutes to discuss the item • The staff member who worked on the public hearing agenda item will be given up to five (5) minutes to discuss staff comments and recommendations • A person wishing to speak during the public hearing will state histher name for the record • A person wishing to speak during the public hearing will be limited to three (3) minutes to discuss the item • A person may speak only one time on a public hearing item • The petitioner/applicant, if any, will be offered an opportunity to respond to commentstquestions but will be limited to not more than dwee (3) minutes If an agenda item does not include a public hearing, it is the discretion of the presiding officer to allow public comment. If public comment is permitted, the procedures outlined in paragraph a of this section will pertain. d. The presiding officer may change the time allowed to individuals to speak regarding an Rem on the agenda. However, in order to provide for efficient, effective, and orderly conduct of meetings, such changes will be allowed only under unusual conditions. 'aLL'» ii Under the City Charter of the City of Anna the City Manager sets the agenda for meetings of the city council [Section 4.01(%5)]. b. An "Agenda Item Request Form will be made available to persons requesting that items be placed on a council agenda. The Agenda Rem Request Forth must be presented to the City Secretary not less than five work days prior to the city council meeting at which the item is to be considered. An Rem titled 'Future Agenda Consideration" will be placed on each regular City Council meeting agenda. Under this item a council member may request that an issue be placed on the next regular city council meeting agenda, and should specify whether the Rem should be for discussion, consideration andfor action. The suggested agenda item shall not be subject to discussion or debate. The City Manager shall either include the item as an item on the next regular meeting agenda as requested or include the Rem under "Future Agenda Consideration. An item listed under "Future Agenda Consideration" shall be placed on a future agenda if a minimum of three council members vote in favor of same. d. Notwithstanding any provision of this resolution to the contrary, items of an emergency nature shall be permitted to be placed as an agenda Rem as necessary and in accordance with the Texas Open Meetings Act.
