RESOLUTION NO. 2008-01-02
A RESOLUTION AUTHORIZING THE CITY MANAGER TO: (1) PROVIDE NOTICE
OF INTENTION TO TERMINATE RESIDENTIAL SOLID WASTE COLLECTION
CONTRACT; (2) NEGOTIATE AND EXECUTE ON BEHALF OF CITY AGREEMENT
WITH CURRENT RESIDENTIAL SOLID WASTE COLLECTION PROVIDER
TEMPORARILY EXTENDING THE PARTIES' RESPECTIVE OBLIGATIONS UNDER
THE CURRENT SOLID WASTE COLLECTION CONTRACT; (3) ADVERTISE A
REQUEST FOR PROPOSALS FOR RESIDENTIAL SOLID WASTE COLLECTION
AND RECYCLING SERVICES
WHEREAS, the City of Anna, Texas ("the City") desires to exercise its option to
terminate its Solid Waste Collection Contract for residential solid waste; and
WHEREAS, the City desires to seek proposals from qualified providers for residential
solid -waste collection and recycling services; and
WHEREAS, the City desires to extent the obligations of the parties under the current
Solid Waste Collection Contract pertaining to residential collection services while the
City seeks new proposals;
WHEREAS, the City Council of the City of Anna believes that these measures are in the
best interests of the City and its citizens to provide for the public health and safety;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ANNA, TEXAS:
Section 1. On or before January 15, 2008, the City Manager or his designee shall
provide written notice by certified mail, return receipt requested, to Joe W. Bradshaw
d/b/a Bradshaw & Sons Trash Service of the City's intention to terminate the current
Solid Waste Collection Contract.
Section 2. The City Manager or his designee shall negotiate with Joe W. Bradshaw
d/b/a to extend the essential terms of the current Solid Waste Collection Contract with
said provider for a period of 120 days, with an automatically renewal provision for
successive 60 -day periods, unless either party notifies the other party in writing, not less
than 30 days prior to the expiration of any successive 60 -day period of its intention to
terminate the extension.
Section 3. The City Manager or his designee shall as soon as practicable advertise a
request for proposals seeking qualified providers for the collection and recycling of
residential solid waste.
